I have read so many different posts about what is required for the "medical" for AOS! We were thoroughly confused! So we made an infopass appt, and showed up with a list of questions for the immigration officer, just to be sure of what we needed to do.

Here's our scenerio:

My husband got here from Nigeria April 26, 2008 (K3) He got all the required "medicals" in order to meet the visa requirements.

1. physical exam (blood pressure, temp, pulse, height, weight)

2. blood test (HIV, syphillis)

3. Chest xray (TB)

4. immunizations

a. TT

b. MMR

c. Hep B (one shot, then return for 2nd, 3rd to be done here)

He asked for a copy for everything, but was told they could not provide it to him...but he did get a copy of the immunizations he received. (unfortunately he lost it, but had the receipts which listed each)

They were given in a sealed envelope as required...and collected at the POE

So...at the infopass appt we asked;

1. "Since we just had "medicals" done...is it necessary to get it done again?"

answer: "yes...u must go to a designated civil surgeon (he gave us a list) and have another HIV test, a chicken pox

vaccine (not required for original medical), and another TB test, and the immunizations you recieved

will be transferred onto another form by the CS"

FYI--it is not necessary to get a second "physical"

2. "We lost the immunization report received at first medical...we have these reciepts that list each one done...will they accept that"

answer: "yes...the CS surgeon can use those"

So....we scheduled an appt at one of the CS on the list...(without calling around for what the fees would be!) which I assume vary by CS. We ended up paying $86.00 (lab fee) $130 for the chicken pox vaccination, $10 for the TB test, and $140 for the "immigration form" (for them to transfer, and fill out, authorize and seal it!) They then gave us the sealed envelope. We asked for a copy of everything, but they said they were not allowed to give us one...but they did give us the results of the labs, and proof of a negative TB test. They were very nice, and knew the process. This CS was right down the street from the immigration office...so I assume they do alot of these.

We submitted all the AOS/EAD documents, along with the sealed "medical" envelope to USCIS...We are awaiting the NOA. We pray we don't get an RFE, and further delay this nightmare of a process!!!!

I am just curious what others who have successfully gotton the AOS have done. It seems many have gotton RFE's, or medicals were lost etc. I know people who only sent the immunization form from the original "medicals", and never got the chicken pox shot, or anything transferred by a CS in the US. They are also awaiting NOA, so we don't know what the outcome is yet.

There is so much conflicting info, wrong information and differences in embassies etc! It's amazing any of us get the correct info, and get approved at all!!!!

Understand something.... The "K" visa does NOT have a vaccination requirement.... It is strongly reccomended but not a requirement.

You did not have to get a second medical for AOS. The "K" medical was included in the MBE that your husband handed over to the CBP at the POE. If that medical was less than 1 year old, all you would have needed to do was provide proof of vaccinations required for AOS. This could have been accomplished by submitting a copy of the DS-3025 (if provided) or the Vaccination Supplement to the I-693 transcribed by a CS.

It appears you have provided way more than you were obligated or required to do.

That's exactly what we thought..prior to the Infopass appt!!!! Which is the point I was trying to make...Is that people are told the wrong information at all levels of this process. Even the CS told us everything was necessary (of course they just wanted their money!...lol)

My intent of this post was to just share our story, and illustrate how difficult getting the correct information can be...

I hope others can avoid the extra time and cost...but at least we feel confident we won't get an RFE for a "lost" medical!

Dang girl I wish I had talked to you before you went and done all that!

Oh well I think this is a really good topic though. Because it is very confusing of what you need.

I will tell you my story. I learned about a civil surgeon on here that is in Texas and she transfers everything from the copy of your immunizations from Komorass onto the I-693-A for just $20.

I had called her and asked her what I needed to do. My husband came on K-3 visa in Nov. 2007 his medical was less than a year old and he had received his entire medical and immunizations and only had a copy of the immunizations.

She said to mail her the copy of his immunizations from Komorass and give his personal info like name, date of birth, and all that kind of stuff and she would transfer the immunizations onto the I-693A and send us an original in a sealed envelope to send with his AOS package and a copy for us.

I did this. Dr. Arnold's office contacted me back and told me that he needed a chicken pox vaccine for him to be eligible to AOS. So we went to our local health dept. and he got a Chicken Pox Vaccine for $65.00 they gave us a copy of this and I faxed it to Dr. Arnold's office. Then they sent me everything in the mail. It took at the most a week.

We sent the sealed envelope with our AOS package and we filed at the end of Dec. we received no RFE's and he now has his permanent resident card within 5 months.

I am sorry you spent all that money but how were you to know when we don't have concrete instructions or requirements on this issue concerning K-3.

I was discussing this with another VJ member that husband is here on K3 and told her what I thought she should do and what I did. She wanted me to show her where it says you have to do this on the USCIS website. I could not find it to save my life. I swear I have seen it before on the I-485 instructions but it seems to have disappeared. The rules and requirements seem to change everyday. I just told her that the decision was up to her but I didn't want to take any chances on getting a RFE.

I am so glad you brought this up really I don't know how they distinguish their RFE's and approvals. Something they might do for one they don't do for another.

Thanks for the reply Ara...I totally agree!!!!! There is no simple, step by step instructions for this process. You have to search all over, and find out what everyone else did...and even then it seems you hear stories of RFE's and being told misinformation by immigration officers, and others. Its a dang shame! I have always been one to rather be safe than sorry..so I always "overdue" everything anyway!...LOL As long as we get thru this friggin process! I guess I should be thankful that we got thru the initial approval process without a problem....Thank God for that!

We are just going thru medicals for Rin and children to file for AOS. Rin had to get a second medical as her last one was March 2007 (we elected to wait to file AOS so they would get 10 yr greencards instead of conditional GCs). When I scheduled the medicals, the CS admin said the children would also require medical exams. I told her "No, I don't think so!" She asked me why and I quoted to her from the USCIS I-693 instructions (K visa holder with medical conducted within the past twelve months - see link). She said OK, she just needed to know why (I took a copy of the instructions with me just in case). Total cost for Rin was $140, children were $40 each for transposing the vaccination records.

If your SO had his medical within one year of filing for AOS, a medical was not required. The immigration officer and civil surgeon gave you bad information.

p.s. Ara - you are right, the rules change frequently. The I-693 was updated April 2, 2008. The I-693a no longer exists. If a medical exam is not required , then only parts 1, 2, and 5 have to be completed by the CS. The info you were looking for to show your friend is in the link above, not the I-485.

Hey everyone

My story is we received the full medical in Nigeria and the beginning of the vaccinations, the civil surgeon form for vaccinations from Nigeria was given to us.

I never got it transcribed, transposed or anything. I made a copy of it and sent it in. Now mind you I recived an RFE for birth certificate from Nigera, I responded there was none he was born during the war. They sent me another RFE for birth certificate and a newer I-864 with 2007 W2. I did the I-864 over but sent back the exact same information about the birth certificate and was approved for AOS 2 weeks later.

My point is that I was very strict with my documents before my husbands arrival, but now that he is here we decided to try, and all we lost was being approved 2 months sooner, without the hassle and expense of sending someone to his state (village) and trying to obtain a document that does not exist. USCIS has rules and regulations, but it is up to the interpretation of the adjudicating officer to determine what is required. Everyone has to follow their own minds and weigh their options when it comes to matters like this.

Hey Girl Sorry to hear you went through so much tring to get work permit and ss.. Applied for Wish you would of emailed me I could of told you what t do..Friday had never had chicken pops in Nigeria so he only had to get one shot 90.00. We tok it to surgeon with copies of his shot record he got in Nigera with HIV and Tb the transfered iit all and sealed envelpe 25.00 and we sent off.. I guess nothing is easy on this Vj.. But we learn from mistakes.. Thank God its almost over thou next is work permit SS card got to work wait on Interview for Green card.. Friday has been wondering how you all doing.. He sits at home alot talks on line with his friends from Nigeria.. Looking up jobs we did a Resume and sending out some letting them know he will be haveing work permit soon, If he has nothing to do have him to call Friday to talk on cell phone.. 1-706-877-4843 thats his direct line...
