Historical fraudulent document & digital signatures

Greetings,

So my fiancé from Mexico has previously applied for three tourist visas to visit the United States. The first one was over ten years ago, and they denied her because they stated her social security paperwork from Mexico was incorrect, or believed it was fraudulent. Apparently around the same time, consulate officers had told other people something similar, that their social security paperwork was fraudulent.

The second time she applied for a tourist visa over a year ago, she was with her sister. Her sister did not get a visa that time, and my fiancé was denied also. They did note the past problem with the social security document in the interview with my fiance. When her sister applied again (alone) and went for a second interview she was granted a tourist visa, and the officer suggested my fiance apply again once she had her diploma from university.

The third attempt for a tourist visa was within the past months. When my fiancé met with the consulate officer, he was very short with her. The officer asked if her sister had a problem in the past with a document, and she said no. Then the officer proceeded to ask if it was her who had the problem with a document, and she said yes. At that point the officer said he could not issue a visa to someone who had problems with a fake document in the past and has been at their job for a short time (less than a year).

While I know obtaining tourist visas can be difficult, I am not sure if the officer was only using this information to build a case against her so she could not get the visa, or if they denied her more so because she is in a new job. While I feel it was completely unprofessional, the officer finished up by telling her she would not be able to get a visa until she was 90.

So, what is the best rout to deal with this problem?

We are currently in the process of filing our fiancé visa, and would rather deal with these past problems now if possible, to know if she is eligible for the visa in the first place, and also prevent our application from being delayed in the future.

Second question, is there any way to digitally sign (then email) the fiancé visa documents (g 325a) and the letter of intent? We wanted to avoid snail mail, but I think that’s not likely for these documents.

In any case, I would like to avoid lawyers if possible, but will consider as needed. Any insights to either question are much appreciated. Thanks very much in advance.

You cant digitally sign the forms and email them. They have to written in black or blue ink then mailed. Theres no other way around that. As for the problems with the visa.

The best advice I can give is for you to visit your fiance or get an immigration lawyer involved. If shes been denied in the past, sthe will more and likely be denied again.

I do not think that denial of tourist visa has anything to do with a K1. I totally disagree with Wallace on that. The only thing is that since she has been repeatedly applying for tourist visas they will look at the relationship angle more thoroughly - so make sure and go with her to the interview. Best of Luck

I'm in agreement with Motu on this. You will definitely want to go to the interview for this. Furthermore, you need to examine your relationship for its validity if she has repeatedly tried to come here on a tourist visa and been denied...you never know, she might think that the only way into the US is through a marriage based visa. I'm not trying to question your love for each other, but be prepared, as the embassy will be questioning HER love for you and the validity of her love for you. Most definitely, they will ask her about her wanting a tourist visa to come to US and then they will ask you if you knew about it. Also, the whole issue with the fraudulent documents - very risky and suspect.

Good luck...prepare yourself, this could be sticky.

The requirements to get a B-2 are completely different than the requirements to receive a K-1. Many have been denied a B-2 and have received a K-1 with no problems at all. A B-2 denial does not mean a K-1 denial, two different procedures and 2 different visas for different purposes.

BUT given the fact that your fiance has been "accused" of submitting altered or fraudulent documents to the U.S. Embassy on the past, it could be possible that her name might appear in their system and that these previous incidents are going to come up again during the interview. You might want to consult that with a lawyer.

They suspected her social security paperwork was fraudulent. Although, she said other people who were at the embassy at the same time had a similar problem. Nonetheless, I was not there, and it happened over ten years ago.

Thanks for the advice thus far. I thought perhaps there was another option, of maybe settling this past problem before the interview. I imagine we'll have to deal with it at that time.

Thanks for all the advice and suggestions so far. A few things to note.

When we met, it was I who made contact first. We have know each other for a number of years. Also, she's pushed fairly hard for me to move there, rather than her move to the US. We intend to move back to Mexico in a few years anyhow. I only need some time here to finish with some past obligations.

While I know she's applied for past tourist visas, I would not call it "frequent." This was over a ten year period of time, and during two of those applications I have known her.

Can you obtain proper up to date SSN documentaton from the Mexican government?

Also prepare her for the interview very well. Here is list of sample questions:

--How did you meet your fiance?

--When did you meet in person?

--How long have you known each other?

--When was the last time you met him, and where?

--When did your fiance propose marriage to you?

--What do you love about your fiance? What type of personality does he have?

--Have you ever been to the U.S.?

--When is your fiance's birthday?

--Where was your fiance born?

--What kind of job does your fiance have?

--Where does your fiance work? What is his job title?

--Does your fiance have any brothers and sisters? If so what are thier names?

--What do your parents think about your engagement? Do they approve of it?

--has your fiance been married before?

--Does your fiancee have any children? If so what are thier names?

--When and where will you have your wedding?

--How much time have you spent together?

--Did you have an engagement party? Did you announce your engagement to family and friends?

--What are your fiance's hobbies?

While not every question may be asked key is sincerity and preparation. The consular officer needs to be convinced that your relationship is sincere and will result in marriage. Make sure she has a full copy of all docs submitted during the K1 process as well as the financials which come later.

Because your case is complicated. I recommend this to you.

1. Attend the interview with your fiance.

2. Bring lots of documental proof

3. Make sure papers are perfect.

4. Bring explanations for the false documents.

5. Maybe hire a lawyer.

I do not believe we will have issues providing evidence for our case.

Currently she has all of the proper paperwork for her SSN and has presented that at the two most recent interviews. The problem arises from the first interview when they felt there was a problem with her social sercurity paperwork, and they keep noting that on future interviews.

While I intend to be in the city of the interview, it is my understanding I will NOT be allowed into the consulate or interview in Juarez Mexico. I've read up on this through the forums, and this seems to be the consensus. Although, perhaps I can put in a request that I be present given our case.

Ideally I would like to get some feedback from the consulate prior to the interview and see if they have some suggestions with respect to the past confusion about the document so this wouldn't be an issue once we meet an officer for the final interview. I noticed there is a complaints number posted for the consulate where she reciently interviewed and am considering a call in to them requesting some advice about these past problems.

Does anyone have some other suggestions of how we might deal with the past problems with the social security documents or provide some evidence the paperwork was correct; which is what we believe.

It would be helpful if the consulate or another government agency here had someone you could speak with regarding these concerns with the visa process and would offer some advice.
