my fiance got divorced from her philippine husband . the divorce took place in hong kong will we be able to get her a k-1 visa

There is no divorce in the Philippines only annulment.

02/07/2011-USCIS online status update-

02/12/2011- Received Interview Letter Scheduled March 14

02/12/2011- Received Descheduled letter

02/17/2011- USCIS online Status update

02/22/2011-New IL arrived schedule for March 29

02/22/2011-Descheduled Letter Again ( 2nd Time)

02/23/2011- I called USCIS and I was told new schedule in the computer for March 22

02/23/2011-USCIS ONline update....

03/01/2011-Interview Letter for March 22 @ 7:15 AM

03/22/2011- Interview and Oath; US Citizen

If you both are free to marry and she has her divorce/annulment documents proving she is no longer married, you should have no problems filing for a K1.

If your fiancee was and is still a Filipino citizen then the divorce she obtained in hongkong will not be honored in the Philippines. Being a Filipino citizen, she still needs to follow the Family Code of the Philippines with regards to dissolution of marriage... and we don't have divorce in the Philippines, only annulment, a much longer and tedious process compared to divorce.

She needs to file annulment because that's the only legal separation that is recognized by Philippine Law.

She needs to file annulment because that's the only legal separation that is recognized by Philippine Law.

If there is a registered marriage with the Filipino government the enbassy will not process any fiance petitions until an annulment can be completed and proper documentation provided.

If she was married in the Philippines and divorced in Hong Kong the American Consulate in Hong Kong will recognize the divorce but Philippines will not

Not exactly true. Actually the philippines does recognize divorce for the philippine citizen in the following limited situation:

Filipino(a) marries foreigner in foreign country. Foreigner files for divorce in country where divorce is legal. Filipino(a) contests divorce but the legal system in the divorce jurisdiction does not recognize it and the divorce petitioner (foreigner) is granted divorce.

In the above scenario, the Filipino(a) new status will be recognized in the Philippines and he/she is free to (re-) marry.
