hey everyone ,i am happy that i am here on this website..!!

how are you everyone ?i am new on this website my name is hamed and i am from morocco - casablanca,i had my interview for a fiance visa in FEV - 4 - 2008,i got 221 g ..!!would you please help me to understand what does mean 221 g?it says :

section 221 g which prohibits the issuance of visa to anyone whose application does not comply with the provisions of the immigration and nationality act or regulations issued pursuant thereto, the following remarks apply in your case :

we have returned your application and petition to the departement of homeland security's citizenship and immigration service,any further inquiries to your application and petition can be directed to their attention and the CIS office.

Hello and welcome to VJ. If your 221G states your application has been returned to Homeland Security, then this is not good news; it has been denied. You need to have your fiancee act on this immediately and stop the petition from being returned, if possible. Calls need to be made quickly. There is a thread pinned at the top of this forum that addresses the issue of being denied and what to do. If you can find Chi's name and PM her, she knows what steps need to be taken now. There are many on this forum that will try and direct you but please listen to those that have been through this process. This is a very long and hard time but it can be overcome. I wish you the best.

Ok your first object is to get it held there and quickly, do you know for sure its left casa, do you know the pouch number. Have your fiance come here to talk as it is her that will have to do the actions, she will need to get in touch with her rep to send email and letters trying to get them to hold it there for further reviews. If it continues to get returned to calif it will prob be left to expire if vermont then it is takeing at least 18 months for them to even touch it. So you need to be very quick to jump in the middle of all this now, did they not ask for any return papers just the notation as you noted? What did the interviewer tell you at the end? any problems you were aware of ahead of the interview? there is much to do NOW also have your fiance get a email to CHI as she is very good help for this. I keep saying to have her as it is her petition FOR you and she will be the one to follow thru

That is good that your case is still in Morocco. Your fiancee should contact the consulate about the denial and wanting it held there. She will need to get in touch with her representatives and congressmen/senators. If she hasn't signed the paperwork to give them permission to inquire about her petition, she needs to do so now. This all has to be done now to keep the petition in Morocco. There are more steps and Chiquita has been through this process and has success. I am at work at this time so I can't do much research. Please try to read the thread at the top of this section about Returned Petitions. If not, you are welcome to have your fiancee email me at home at myfellah@yahoo.com and I have a list of things there that might help and would be more than happy to send it to her. You just need to pull together now and work fast.

sorry to hear you were denied a visa. this is not a time to freak out though.

your fiance needs to get help asap.

she needs to call/email the consulate to see if she can stop your case from being returned.

do you have any idea as to why you were denied a visa? do you have red flags? did you have lots of proof to establish a valid relationship?

here is some help for you >>>

What can you do immediately when faced with this issue:

Immediately have the beneficiary send a scanned copy of the 221(g) issued.

Contact the consulate directly (immediately) and attempt to have the petition reviewed by the senior consular before it is returned.

If you are unable to get through to the consulate on the phone, contact them via email, and if you're mail has a "read verification" use it.

Contact your congressman/senator, get them involved immediately. You will need to sign a release form giving them permission to make an inquiry on your behalf.

Provide your congressman/senator with as much information as possible about your case, the interview, and the result.

If your congressman/senator is top notch, they will not just send an email or letter to the consulate, they will call on the phone and try to get the petition reviewed again before it is sent back.

If they are not successful, they can request the diplomatic pouch number the petition is being returned in. This number will allow you to track the petition until it is received by the local service center.

If you do not know who your congressman/senator is, use the following links to find out who represents your area:

US Congressional Representatives (By State)

US Senators (By State)

If the petition is returned, you are in for a wait. The diplomatic pouch the petition is returned in is sent from embassy to embassy picking up other returned petitions along the way. It could take up to 2 or 3 months for it to be received by fraud management at the NVC...then the NVC has the petition for about 1 month before sending it to the local service center where it was originally filed. One thing to also know is that returned petitions do not take priority...they are reviewed in the order they are received...that is after new petitions have been processed.

What you can do in the meantime while you wait:

Continue contacting the consulate to get an actual reason for the return...not the blanket "validity of relationship" response.

Stay in contact with your congressman/senator, they can assist you in getting the actual reason for denial.

Immediately file a Freedom Of Information Act request for the Department of State asking specifically for the consular notes on your returned petition: DOS FOIA

Immediately file for a Freedom of Information Act request for the USCIS asking for the same specific consular notes on your returned petition: USCIS FOIA

Continue to document your relationship, emails, letters, phone bills, visits to their country, etc.

Be ready for the opportunity to rebut the consular findings.

Contact a good immigration attorney...preferrably one who has experience in returned and denied petitions.

If the reason for the denial was that your fiance is not working they would have requested that she get a co sponsor. There is something that makes them think that the relationship is real.

How long have you known each other?

Is there an age difference?

Does your family know and approve of the relationship?

Do you have family in the US?

How did you meet?

Did you take picture to the interview that included family and friends with your fiance?

Did you have a party that could have resembled a wedding?

Have you been denied a visa in the past?

Those are a list of things that I can think of on the top of my head that could create issues for you. If you can figure out what they are thinking and have your congressman/senator send them proof before it is sent back to the USCIS it could stop the return. This has happened to a few, but it is rare.

One note, a letter of support of your relationship from family and friends (from both you and your fiance) could help greatly, but you must act quickly, and have your congressman/senator send it. It is unlikely that they will accept it from you at this point.

she asked me how many time i sent the letter to my fiancee,i said : 3

in the end she said : I AM SORRY .....

Your answers don't give us much to go on really. You sent your fiance 3 letters? So does that mean that of the 19 letters you showed her, 16 were from your fiance? That would not look good in the eyes of the consulate. Don't get me wrong, but my husband and I hate writing letters, and to me that fact that we were online with each other for hours on end every single day with a web cam and headset is much more proof of a relationship than writing letters, but the fact is that they view this as important.

BTW, I forgot to mention, my husband and I also got that same 221g letter. Ours was sent back to the USCIS, but it was in Morocco for around 3 months before they sent it back. They lied and said it left that same day, but it didn't. If they tell you it is already gone then request the pouch number. I highly doubt they will send it back quickly, but I know for a fact they will lie about sending it already.

Fifteen months after my husband interview he was finally given the visa, but it was a nightmare, and it took a lot of work and patience. I hope you can stop the petition from being sent back, otherwise you will more than likely have to file again, and prepare the initial petition better.

But don't think that far ahead just yet, fight for it to stay there and be reviewed again.

sorry to hear that, was it the blond lady ? she gave me the 221g and told me that they will sent our petition back, we did not do anything at that time and we did not know about this website, that happended in 2006, now we are married and our k3 is in process ... so hurry up and ask your fiance to do something and thanks VJ members for their help, God bless everybody and good luck to you .
