I am started on our taxes already and ran into a question right off the bat. My wife and I are filing jointly but she does not have her SS# yet. Does anyone know what I need to do? I'm guessing I need to get her an EIN but don't know for sure. Turbo Tax wasn't much of a help.

Employers have EINs. Taxpayers have SSNs or ITINs. File a W-7 along with your return to have an ITIN assigned.

I guess that make sense :blush: I knew EIN means Employer identification number...just didn't think about that before I posted. Anyway, thanks for the info!

I just read the instructions for the W-7 and it says that if you are eligible to receive a SS# that you should not apply for an ITIN. My wife is eligible as a K3 visa holder. Any ideas?

The K-3 status does not make her eligible for an SSN unless she also has an EAD. If she has an EAD, go get the SSN, otherwise she should apply for ITIN.

I called the IRS just to check and see how and where to file, etc. and here's what they said:

Attach W-7 with tax return and include three certified forms of ID, which would be notarized copies of her passport, visa, and her Peruvian national ID card. The lady said I could go to any bank or notary and they should know what to do. The SS# box by her name should state "applying for ITIN".

The tax return, W-7, and proof of identity should be all sent together to:

Internal Revenue Service

ITIN Operation

P.O. Box 149342

Austin, TX 78714-9342

graet information , I might have to do this incase I dont get my EAD aproved in time to file Taxes , but will waite another month or so to file

On March 9, 2010, we ordered production of your new card.

12 March 2010 received approval letter in mail

16 March 2010 10 year Green Card received in mail exp date March 09 / 2020

04/25/17 credit card charged 

04/25/17 e mail NOA send 

05/01/17 hard copy of NOA dated 04/25 received in mail

05/06/17 biometric hard copy in mail 

05/19/17 Biometric appointment in Hartford CT 

07/17/17 Inline for Interview 

07/24/17 Interview letter in mail 

08/24/17 Interview in Springfield MA ... Yes Aproved

09/14/17 Oath Ceremony .... done I am a US citizen

09/22/17 Applied for Passport ( per reg mail ) 

10/04/17 got passport in mail  

10/13/17 got certificate in mail  , updated status with social security office 

AM DONE YEAHHHHHHHHHHH
