K3 but Mtl changed it to CR-1! confused!

Hi - so, we've been waiting for 113 days for our K3 interview in Montreal and nothing - over the past few months we've made several inquiries with Montreal and all reply emails back confirmed that we were on the waiting list and that the interview should be around late Nov., early Dec. Our lawyer contacted Montreal and received a very confusing email back from them saying that they would schedule an interview date once they received further forms back from us in order to process the CR-1!!!! We thought maybe it was a mistake but apparently NOT. We don't understand this b/c we went the K3 route, not the CR-1 route. We were told by NVC that on Nov. 14th, Montreal requested our CR-1 file. We are very upset b/c we suspect that we will now be put on a new waiting list which could take another 5 months. Our lawyer is doing some research and will be contacting them as well. has this happened to anyone? Any help would be appreciate :(

Did your I-130 got approved. Have you gotten stuff from NVC and been sending it back... Sorry, but once that's done, the Consulate will not proceed with the K-3, they have to go with the CR-1.

Did your I-130 got approved. Have you gotten stuff from NVC and been sending it back... Sorry, but once that's done, the Consulate will not proceed with the K-3, they have to go with the CR-1.

The K3 was approved in June and the I-130 was approved in July. Do you know what the wait time for an interview is now?

It's 4-6 months for either at Montreal - no big difference in the interview wait times.

Ok - sorry - just want to clarify. Is it 4-6 months from the time they receive this new set of forms (230 form Part I and II) or 4-6 months from packet 3 that we sent back in early august?

Sounds like a blessing to me.

CR-1 is an IMMIGRANT visa that results in green-card upon entry. NO adjustment of status ($1010) and can get a job immediately upon entry using the green-card, NO waiting 90 days or more for an EAD card.

Is now a US Citizen immigration completed Jan 12, 2012.

I agree that the CR-1 seems great too BUT we don't want to have to wait much longer for an interview - we have already been waiting for almost 4 months. Would anyone happen to know approx. how long we will have to wait for an interview date? are we put on a new waiting list or do we continue with the same waiting list as the K3?

Good question. I would think they go by case number, so your case should remain in the order it was before. Nonetheless, is MTL answering emails or phones these days?

Maybe your name won't be moved at all. Maybe they'll keep your name where it is on the list and reserve that interview for CR1 instead of K3?

Or is that wishful thinking?
