Hi...

I got my first RFE for the AOS I filed in July (it's good in one way since I didn't get a NOA1 and with the RFE I know that they are actually working on my papers...). But anyways, my husband is a student now and got out of the military last year in October. His income wasn't quit enought over the 125% poverty line so I'm guessing they want me to get a joint sponsor, which is no problem. But I don't want to send off the papers not knowing 100% that they are the right ones and risking a denial!!!! So here is what my letter says...

F.(40) The sponsor or joint sponsor (if required) on Form I-864 Affidavit of Support must submit the following:

- W-2's, 1099s, and/or all schudles submitted to the Internal Revenue Service (IRS)- a copy of his/her Federal income tax return was submitted and/or the sponsor or joint sponsor requested an extension to file his or her Federal income tax return.

That was the first page. The second one says...:

F.(43) The sponsor or joint sponsor on Form I-864 indicates s/he is using assets to meet 125% of the poverty guideline. All assets must be supported with evidence to verify location, ownership, and value of assets. Any liens and liabilities relating to the assets must be documented. Use only assets that can be readily converted into cash within one year.

... than it tells me what I can use.

The other question now is, it would take my husband about 2 month to get a bank statement cause his bank is in Kansas and we are in PA (that's how long it took them when I needed one for my K-1 visa), so insted getting the statements from his savings can we just file the I-865 again without the assets and use a joint sponsor?!?!?!? My joint sponsor (I didn't use him when I send off I-864 for the first time) would be my dad in law and he's earning way above the poverty line for like 6 people, so that would be perfect.

WEll, You could at least let me drink my first cup of coffee here. Today was the first day I've seen your post. You file an amended I 864 and add your father in law as a co sponsor. Make sure you have his income tax for 3 years and all his w-2,s and/or 1099,s .. then you won't need to bother with your assets,,, good luck

You need to show income 125% of the poverty line (or use assets as well). It appears to me that they are asking for your cosponsor information. So you need to get your cosponsor to filll out an Affidavit. If the income is over the 125% of the poverty line, then there is no need for bank statements of information about assets.

I don't know what your husband sent in, they may also want his......

Well, we send his tax returns but not his W2's cause he couldn't find them. I just looked through his papers and I found them so I can send them off with the papers this time. I decided to send his affidavit of support with (this time) all the papers, like W2's, 1099's and tax returns. I'm not gonna bother to wait for his bank statemant and just not fill out the assets. I will also send off my dad in laws affidavit of support as a joint sponsor with his W2's and tax returns from the last 3 years, copy of his birthcertificate to show that he's a USC. He doesn't have his 1099's though so I hope that's not gonna be a problem.
