AoS - Pregnancy, Health Insurance, Argh

Timeline

In May, I took a part time position (in addition to my full time job which doesn't offer health care) with a business institute as an executive assistant, and was told that in July, my work would be reviewed and I would be made full time with benefits. My employer loves me, and she reviewed my work, gave me a cash bonus, but has said nothing more about going full time or getting benefits.

In the meantime, we managed to get pregnant (which please don't get me wrong, we are very happy about just worried about how we are going to cope health care wise), and I had to go to the emergency room for abdominal pains. I just got the bill today, and I'm sort of freaking out. I have not yet been offered the full time, or the benefits, and I'm starting to worry how I'm going to take care of this situation.

In PA, we have a thing where all pregnant women are to get health care - though I detest the thought of "medical assistance" it is starting to look like the only way until I am given the full time position with benefits. My questions are:

A. Does being pregnant effect the AoS - my mother is already our co-sponsor for my hubby and step son

B. Would me being on medical assistance effect the AoS?

C. My husband and step son do not yet have health insurance (we've just been paying via cash for anything they need) will this effect AoS?

D. Is anyone doing free vasectomies from the forum? :P Sorry if I didn't make jokes I'd probably be crying!

Our AoS interview is September 14th. I don't want to do anything that will put that in jeopardy.

I would def. ask your boss ASAP for your review. I alos would not mention you are preggers or else she may not give you benefits or hire you on FT. Not legal, bu ####### could still happen.

Take a breath. You'll be okay.

First off, you have a co-sponsor. To the best of my knowledge, and someone can correct me if I'm wrong, you being pregnant doesn't count towards an extra person in the household size. Having a baby would, but it's not an extra person for benefits purposes until it's actually born.

So assuming that your mother's help is already enough to meet the income guidelines for the AOS, you being pregnant won't change anything. It doesn't count as a baby until it gets here for household purposes.

So much for question A.

Onto B. You're the USC. You're not signing away your rights to public assistance with the I-864. The only issue, usually, is that to qualify for medical assistance sometimes means that you don't make enough money to exceed the poverty level (though PA's law may be different). (So there'd be an indirect issue in some cases.) But you have a joint sponsor. So that's not an issue at all as far as his AOS is concerned. Pre-natal care or medical insurance for you isn't a benefit for your husband. It's a benefit for you. And you're the USC.

C. Nope. They don't ask you to demonstrate that you have health insurance.

D. VJ may seem like it's good contraception, but it is a really poor substitute for a vasectomy. ;)

A) I don't know if your pregnancy affects the sponsorship. Just a disclaimer, I am only speculating and don't want to get yelled at it for it, so I'm saying that I'm doing it beforehand :) One would think that if you get the greencard before you have the baby, it wouldn't really matter if it was included on the I-864 as a dependent because the child was not yet born. However, I would wonder if you have the child before AOS is approved if a simple updated I-864 for yourself and your cosponsor would take care of the issue of another dependent child?

B ) I also don't know about the medical assistance, it all depends on what kind of program it is and where the money is coming from as to whether or not it is ok for you to participate. Look on the I-864 or do a little google research on government sponsored programs and what is ok for immigrants to use without worrying about conflicts with the I-864 agreement.

C)James and I did not have health insurance between our marriage and him getting the EAD (May-Oct) and got the greencard just fine. They can't really know whether or not you have it and I don't see it as an issue even related to AOS.

D) I have some scissors, snip snip!

Congrats on the little bundle to be! :) I absolutely agree with Devilette on asking your boss for that review. You can make it clear to your boss (it should be obvious already) that health insurance and those other things are important to you and that you would like to get that matter resolved as soon as is possible. You gotta take charge, if she told you July then she should stick to it, although sometimes people just get busy and forget what they said which is why it is important for you to take care of your own interests and be sure things stay on track.

She's the USC, not the immigrant, as I understand it, so that fortunately shouldn't be an issue.

It has no effect.

Again, as you have a co-sponsor, your application for medical assistance has no effect.

Nope!

Oops, if she is the USC then that does make it difference. Go for that medical assistance! You want to be sure you get the right care early in your pregnancy until you can get your own health insurance :)
