:star: hi all!

i just wanted to post an update on the progress of my hubby's visa process.

his interview was in london on july 11th. and it went absolutely fabulous!!!!! :thumbs:

he was asked about his convictions/caution (from 10 yrs ago) and if he'd ever do it again, to which he replied NEVER!

and that was IT! the immigration officer sped right thru them as if they were peanuts!

they basically approved the visa BUT needed more paperwork from me before they issued it! they needed my 2007 tax return, but since i've lived in the UK for the past few years i hadn't filed. so i received a letter from the IRS stating i did not file and also included my current proof of employment and income, and also proof i was working in the UK for the last year.

we hope this will satisfy them and they will return my hubby's passport and visa ASAP, so he can catch the next flight to omaha!

Dec05 I-130 approved

May 09- case forwarded to London embassy

May 30- received interview date!!!!!!!

June 27-medical exam London

July 11- interview London: visa held, more paperwork required

July 13- courier p/u passport and paperwork

July 31- passport sent back- paperwork not acceptable

Aug 07- courier p/u passport and cosponsor paperwork

Aug 10- letter received, need co sponsor's proof of citizenship

Aug 14- sent in co sponsor's proof of citizenship

Aug 25- courier delivered passport/visa, nobody home!

Aug 29- passport w/ VISA successfully delivered!!!!!!!!!!!

Aug 31- robbie flies to omaha USA!!!!!!!!!!!!!!!!!!

Sept 25- received SS#

Oct 31- received Permanent Residents card

Since you won't have to file 2007 taxes until April 15, 2008; I take it you meant 2006 taxes? If you earned over the threshold that triggers filing ($8450 for single, $16,900 for married filing jointly), and you were a US resident for tax purposes you are required to file a US tax return. You file a 1040 with a Form 2555 to exclude $82,400 (plus possible housing expense exclusion if met the conditions) from US taxes.

Also, if you were married before the end of 2006 (which I assume is the case) you should file as Married. You can file as separately (and you husband does not have to file since he was not a US resident for tax purposes) or jointly if your husband earned little enough to benefit your tax position. To file jointly, get an ITIN for your spouse by attaching a W7 and mailing the whole return to the ITIN Operations center in Austin, TX.

04/14/2008 - medical report pickup, no problems

04/16/2008 - interview date- APPROVED!!!!!

04/18/2008 - both of us are home at last, POE JFK!

05/21/2008 - sent AOS and EAD

05/27/2008 - received NOA1 for AOS and for EAD

06/02/2008 - received Biometrics appt letter

06/19/2008 - Biometrics appointment scheduled - DONE

06/19/2008 - both AOS and EAD touched because of biometrics

07/29/2008 - EAD approved.

05/13/2009 - AOS Interview - APPROVED!/ Card production ordered email

05/18/2009 - Welcome Letter received

06/12/2009 - Second card production ordered email

06/19/2009 - Approval notice send email

06/22/2009 - Green Card received

04/09/2012 - Applied for Citizenship by Express Mailing N400 to NBC

04/10/2012 - N400 received by USCIS

06/23/2012 - Biometrics appointment

07/27/2012 - Appointment scheduled for N400 interview

09/05/2012 - Interview passed, oath ceremony completed, and Naturalization certificate received.

Nobody asked for your 2007 tax return. :no: A letter from the IRS saying you didn't file the 2006 return is not going to satisfy them. A letter from the IRS saying you weren't required to file would. Generally, you are required to file, even if the foreign income exclusion would result in no tax owed.

Facts are cheap...knowing how to use them is precious...

I'm in the same boat as you. I've been working in the UK the last two years and didn't know I had to file either. I was just completing my I-864 and decided to check with IRS and was stunned. Anyways, we are sending off our tax filings to the IRS today and also sending copies of those with the I-864 today to the NVC and hoping by the time we get to the interview it's all good.

Anyways, hope the rest goes quickly for you!

12 Oct 2005 - Chels moved to UK with hubby

27 Feb 2007 - I-130 Sent

08 Mar 2007 - I-130 approved

28 May 2007 - DS-3032/I-864 Bill received

05 June 2007 - paid I-864 bill

10 July 2007 - Receive I-864 package

18 July 2007 - Retiurn completed I-864

22 July 2007 - D 230 Package received

04 Aug 2007 - D230 returned to NVC

11 Aug 2007 - Letter from NVC advises I-864 need correction

13 Aug 2007 - I-864 corrected and returned

31 Aug 2007 - Case Completed at NVC!!!!

05 Sept 2007 - Case forwarded to London Embassy

03 Oct 2007 - Medical appointment

10 Oct 2007 - Interview - APPROVED!!!!!!!!!!!!!!!!!!!!!!!

For all you UK-based USCs out there, the IRS guys at the London Embassy are awesome -- very friendly and helpful. It is so easy to backfile your returns if you never completed them while you were over here, and it's more than likely that you owe nothing so no penalties are incurred either. If you've never filed, you will need to do 1040s for the past three years (2004/5/6) and 2555-EZs (exclusion of foreign income) for the same years.

If you are in the London area, you can even file them at the Embassy IRS office and they will stamp them as received by the IRS. If you have any questions, call them on (020) 7894 0477 Mon-Fri between 9am-12pm. Walk-ins are available Tuesdays-Thursdays between 9am-4pm.
