They will return the whole packet back to you for not being complete.

Yes and once she gets it back she can attach the check and return it and they will then continue the processing.

I know some people get tired of hearing it but terminology and timelines are critical to our understanding of a poster's circumstances.

A US Citizen doesn't have a K3 application. A foreigner does. I take it your wife is the USC and has filed a petition. If she just now filed the I-130 without a check, she'll need to attach a check. If it was an I-129F petition she filed, then yes, there will be no fee after July 30 but depending on how long it has been since the I-130 was filed, there may also be no point in filing an I-129F. Unfortunately, we don't know what was filed because there is no timeline given.

If a K3 visa is important to you, why not just file again now or as soon as possible instead of waiting for an indefinite period of time, particularly if it is the I-130 she just sent off.

Facts are cheap...knowing how to use them is precious...

04/25/2007 the I-130 sent

05/01/2007 the application recieved

05/25/2007 NOA1

due to insuffiecient account funds the case was suspended till 07/05/2007 (they sent an invoice and she paid it back to them and they recieved the correct fees)

07/06/2007 touched

07/13/2007 I-129F sent

my wife forgot to attach the check with the application

NOW we are waiting the application to be sent back

Thanks for the timeline. You can put this data in the timeline function under "my controls".

Just to clarify, the I-130 and I-129F are "petitions" not "applications". Later there are visa application(s) for the immigrating spouse to fill out. Please don't continue to confuse the terms.

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

but when i check my case status for the I-130 then i see that "Case is now pending" in addition the last update date is 07/06/2007 and there has been no change since that

what do that mean ,is it in process ??? or is it waiting to be processed???
