:help: I filed my petition for fiance visa and recieved my receipt on Oct. 2nd 2006. My petition was approved and forwarded to the embassy on Jan 25th 2007 but, my fiance didn't get an appointment at the embassy untill May 29th of 2007. We waited 7 months for her to get in front of a Visa officer only for her to get turned down. She says that the Visa officer asked if I had visited her since the time we met in the United States. She said no, and the Visa officer rudely told her that she was trying to commit visa fraud and that they are sending the case back to the NVC. Boy did that make me upset. Well since then I have visited my Fiance overseas and my case status has been updated to read that I have been sent a letter requesting additional evidence. That RFE letter was sent back on May 31st according to the Website, yet I haven't recieved it yet. I opened a service request on the missing letter only to be told that they don't know how long it will take to resend the letter. Anyone out there have any idea how much longer this whole thing will take? :help:

My suggestion is to get a GOOD immigration lawyer!

Who sent you an RFE letter? Once your case is approved by the Service Center, and passes the NVC, there isn't any 'tracking' available....so I'm not sure what 'case status' you're referring to. If your fiancee was denied at the interview, and the petition sent back to NVC, it would then eventually make its way back to the original service center you filed your petition with. Is that what you mean by case status reflecting an RFE? Perhaps this is your NOID/NOIR (Notice of Intent to Deny/Notice of Intent to Recoke) in which USCIS is notifying you that they have been returned your petition and asking you if you still want to pursue this....and asking for appropriate updated information? I'm sorry, I'm not very familiar w/ returned petitions.

When your fiancee was denied at the interview, was she given a letter? Did you contact the consulate to see if there is anything you can do to prove that there is no visa fraud? Where exactly is your petition now? Perhaps if you give a little more detail, someone can better assist you with some advice on next steps.

I talked to an American Citizen Services officer in the embassy overseas. He said that they sometimes send the case file back to NVC for additional verification. When I checked my case status online it says that they sent me a letter requesting additional evidence just like the officer said. Thing is though, the website says that they sent me the letter on May 31st but, I haven't seen it yet. I am not sure if the letter is lost or, if it is just taking this long to be sent out. If it's lost I'm curious how long it takes to get the letter after a service request (Notified NVC that I haven't received the letter) has been entered. Also curious that once I submit the additional evidience of which I have an abundance of, how long does it take for it be sent back to the embassy and another appointment to be scheduled.

Yes, I agree. Please post in the ME/NA forum, perhaps someone can offer some advice. I still think its strange if your fiancee's interview was 5/59/07, that they would send you an RFE on 5/31/07. That's not enough time for the petition to make its way back to NVC, and then back to the service center, which is where the RFE would be sent out from. At this point I would seriously consider a consultation w/ a qualified immigration attorney.

Please read through the guides offered here on VJ...especially the flowchart offered on the Guides page. Once your petition your petition is approved at the service center, and moves on, there would be no further communication from the service center, unless the petition is denied and sent back to them. But this takes time....I can't see it coming back and you being contacted in two days....which according to your dates is what hapenned.

Please also fill in your timeline....as it would help people here in trying to answer your questions.

was she given anything at her interview? any official paper to support her refusal? This question may be better asked in the Islamabad Embassy thread, as there are nuances in the Pakistan consulates that MENA does not always see.

I will move this thread to the EMbassy section as this is the stage it is at.
