In Part 3 (Processing Information) of the I-485 form:

Give your name exactly as it appears on your arrival-departure record (I-94)

Her last name was missing ONE character because the immigration official wrote it down and then hurried her out of the area.

Anybody have a similar experience with that or another form?

I was thinking of indicating on the I-485 that it was not misspelled by her but by the officer.

I suspect the best bet would be to call the PoE at your nearest international airport or border crossing, and try to get a new I-94 with the correct spelling.

The name on the I-485 has to match the I-94, which has to match the passport. It all has to match.

I have a feeling you're right and I will contact them before I send in the I-485.

I also have a feeling this was done "accidentally on purpose" as she was denied

the temporary EAD at the POE.

Heads up for those with pending EOD's - Check the friggin' spelling if you let anyone but yourself spell your name.

Thanks a lot, will check that out. Today I hopefully will get her squared away as

my spouse at work & also take care of insurance. We have her SSN application pending.

Should an alien enter a CIS office and ask for a new I-94 based on an I-94 issued at a port-of-entry or otherwise by CBP, the CIS officer should direct the alien to CBP in accordance with that agency’s procedures.

I called the general phone (above) and they said she has to go to the airport with her

passport in hand and get the I-94 adjusted

We're going to JFK next Tuesday to have that corrected. Should be no problem.

I had another thought - since they didn't give her the temporary EAD at the Anchorage POE

and since we will be seeing a new immigration officer, could we ask them for the temporary EAD

when we go to get the I-94 fixed?

Okay, but if you wife or whatever has a temp EAD and gets a job, she has to STOP working as soon as her I-94 expires, and can't resume working until she gets her real EAD or greencard... this can take some time or a month or so. I would wait if i were you unless you're desperate for money because it's just not worth the hassle of quitting a job, especially if she likes the job, and then getting another one later or trying to get the same one again.

There is no temporary EAD and I have a feeling that we will just file for it the normal way, as you said,

to not mess things up. We will file for the AOS as soon as we get the I-94 amended.

I don't think we can get a temporary EAD now in any case at this late date.

A guy I work with who used to work at the airport and was associated with immigration

officials said they might try to stick the blame on her for the I-94 not having her name

right, even if the immigration official was the one who filled it out.

He said we have a 20% chance of getting it corrected without paying the #&%$! $320 fee!

Anybody else there had problems with the I-94?

That's because it WAS her fault. If she had filled out her I-94 correctly, he wouldn't need to fill out her name.

The I-94 is supposed to be completed (by the immigrant) before reaching immigration. When I brought my fiancee back, I filled out her I-94 on the plane. The only thing CBP fills out is the expiration date.
