Does the 2008 tax return (or the older tax returns as well) need to be notarized? If so, this is not a problem for me, but can someone confirm this, for London (putting this incase the topic gets moved!)? Thanks!

no, not needed.

A lot of your questions are answered many times in this section of the forum as well as in the embassy section. Just search and click away!

Sorry :( When I've seen questions about notarization for the tax things, I have only seen questions regarding notarization of the i-134, not the tax returns! And I didn't know that since copies are accepted, it means you don't have to get them notarized..sorry :(

NO, the I-134 is no longer required to be notorized . The reason is because the I-134 is unconstitutional to Us american citizens , only for the reason its filled over seas . And anything you put on the I-134 they cant hold you too that , so they cant attack your income , if your fiancee becomes a public charge while in the united states . When you have a document notorized , you agree that all the information you supply is true and correct to the best of your knowledge and belief . And if you make any false statements with in the document , you can be charged for fraud ( that can be a fine of thousands of dollars and decades in prision ). The I-134 is very old , and so much out of date , and recently the legislation has deemed the I-134 as unconstitional . You can do a search like in altavista , this is where i found this information . But on the other hand the i-864 has to be notorized , and if you knowingly make any false statements on the i-864 , it will be held against you . And the united states federal government will do what ever they want too , to make you pay for commiting fraud against the usa government .

Yes I know the i-134 does not need to be notarized, also, the reason I asked this question in the first place is because on the London Embassy website, it DOES say the tax returns need to be notarized. However, no where on this forum have I seen that, so I wanted to confirm it.

ack! laura! i wasnt criticising. just telling you how i do things. : )

ive found the embassy website to be out of date for some forms and requirements, which is so not okay!

but, you know, notarization doesnt hurt. so if you feel more comfortable having things notarized, i suppose you could.

i am under the impression that copies will suffice. i have frequently heard people say that essentially, if you prepare for the I-864 (the $ support form for the AOS part of the process, which is more stringent and requires a bit more proof) that you will be in very good shape as far as the I-134 form goes at the interview.

here is a blurb from the instructions for the I-864:

All sponsors must submit the following documentation with their I-864:

* Proof of current employment or self employment

* A
photocopy
or an Internal Revenue Service-issued transcript of a
photocopy
or an Internal Revenue Service-issued transcript of your complete Federal income tax return for your most recent tax year, or an explanation if it is not submitted. Your W-2s and/or 1099 forms may also be required, see the I-864 instructions for details.

You may also, at your option, submit a
photocopy
or an Internal Revenue Service-issued transcript of your complete Federal income tax returns for your second and third most recent tax years if you believe these additional tax returns may help you establish the ability to maintain your household income at the governing threshold set forth in Form I-864P, Poverty Guidelines.

(does anyone else see that it doesnt explicitly say 'a photocopy of a IRS issued transcript'?

i see:

a. photocopy of tax return

b. IRS issued tax return transcript of a photocopy (huh?)

c. IRS issued tax return transcript

just because i have been suggesting that copies of the transcripts would be acceptable. dont want to be spreading lies!)

Thanks to both of you! I am actually going to be submitting copies of the actual returns...my dad files all of our returns and all of that, and he is SUPER organized and copies everything he sends in...making my life easier right now!!

mr and mrs - sorry for taking your comment the wrong way! people on VJ lately have been a bit (and thats an understatement) jumpy/quick to criticize people, so I guess I have gotten used to that! Believe me, I spend far too much time on here reading through posts, trying to prepare!

To add to the fact that the embassy website is kind of out of date, not only are my parents super organized, but extreme overachievers, and are making this co-sponsoring thing really difficult. They have TONS of assets, etc, and are being really insistent about including EVERYTHING on the i-134, so I am going to be waiting awhile for them to get everything together (income alone is more than enough, which I told them, but...). I'm being way over achieving about the rest of the things I am sending to my fiance for the interview, but the I-134 stuff seems like its going to be so difficult to get in the first place...I just want to get what I need and be done!

This addresses certified or notarized tax returns. It's for the I-864, but could be interpreted to be applicable to any tax return submitted for Affidavit of Support purposes since the I-864 is more rigorous than the I-134.

Affidavits of Support on Behalf of Immigrants [ 71 FR 35732 ] [FR 23-06]

DOCUMENT NUMBER: FR 23-06

FEDERAL REGISTER CITE: 71 FR 35732

DATE OF PUBLICATION: June 21, 2006

Income Tax Returns

Section 213A requires the submission of certified copies, but the interim rule and the Form I-864 itself make it clear that, by signing the Form I-864, the sponsor certifies under penalty of perjury that the copies are true copies. The final rule does give the sponsor, substitute sponsor, joint sponsor, household member, or intending immigrant the option of submitting either photocopies or IRS-generated transcripts of the required tax returns. Along with the transcripts or photocopies, the sponsor, joint sponsor, or household member must submit copies of all Forms W-2, Forms 1099, and schedules, as specified in the rule.

That is saying that at one time certified copies were required, but a rule changed that and by signing the Affidavit, you are certifying that you are submitting true copies of the tax return.

Does that help convince anyone that tax returns don't have to be notarized?
