Missing 'NOA2 Approval of I-129F'

Timeline

We are putting our AOS package together, and the only thing I don't have is the NOA2 Approval of I-129f.

We were in Thailand for the approval portion of the K-1 process, and that form seems to have gone away in our subsequent moves.

We used a lawfirm for the process, but I am not sure we can get a copy from them in time.

Suggestions?

Just send the package we have and hope? Maybe send later if they request further papers?

Any help is much appreciated.

Same thing happened to us and we filed form I-824. The fee is now $340.

You can either file for this and wait for it to be processed (took almost three months for us) before filing your AOS paperwork. Or file the I-824 and go ahead with your AOS application and if you're sent an RFE for a copy of your NOA2, you can send them a letter stating that a replacement has been ordered and will be provided at the interview along with a copy of the receipt for your I-824.

We never received the NOA2 so we had the same problem. But because we had saved all the correspondence regarding our attempts to obtain one, I sent that in with an explanation in the covering letter. I also included a printout of the online approval notice. Karly-n-Bruce gave good advice, and I would tend to follow it in your circumstance. However, if you have any of the aforementioned evidence and want to take a chance, you can try that instead.

I was living in my finace's home country and we also didn't receive NOA2. We sent in the printout of the approval notice from the online status, and got an RFE. After that we sent in a letter from the Vermont office from when I called to change my overseas address to a US address, and hopefully they will accepted it as sufficient proof.

I'm confused - did you guys get an RFE or not? You didn't mention.

No, no RFE. I was very thorough in providing everything with the original submission, along with a detailed explanation. It was pretty obvious that the error was on their end and not mine. (I tend not to go down without a fight. lol) If you were thorough in your response to the RFE, they'll probably accept it. If it all looks very vague then you may get another RFE. Good luck.

What exactly is the NOA2 Approval for I-129f. Is it a single piece of paper, or a packet or what?

Does my Fiancee having a K-1 Visa not show we were approved?

Sorry, but we went with a lawfirm, and they just did the papers, and just asked us for stuff when needed, so I was kind of insulated from the whole process. So I am just not sure what this item is.

Is this something the lawyer should have and be able to send?

Timeline

The NOA2 is a sheet of paper indicating that the initial I-129f packet has been approved and sent to NVC to be sent to the appropriate consulate/embassy for the visa interview. The fact that your fiance was consequently approved for the visa matters not. They specifically ask for a copy of the NOA2 as part of the AOS submission, so you will either need to get the original from the lawyers, or you will have to apply for and pay for a replacement.

The lawyer should have given you any and all originals that have been received or submitted during this process.

The "NOA2" is the I-797C form that is generated when your I-129F petition was approved. Once that was approved, it went onto the NBC and then to the consulate, where your fiancee applied for her K-1. The law firm should have it. It's a single sheet of paper.

The reason they need that form is that's the only piece of information that has YOUR name on it, and your fiancee can adjust status having entered on a K-1 only by marriage to YOU. So you're creating a paper chain for them: you had an approved petition, on the basis of that petition she received a visa (the K-1), on the basis of that visa she entered the U.S. (the I-94 in the passport), then you two married (the marriage certificate) and you adjust status based on that whole chain.

(This should all be in their computer somewhere, but that could be said about 95% of this process.)

That's great! Good for you guys. I was looking at your timeline, Krikit - did they give you AP at the infopass meeting?

Yes, they approved an emergency AP at the InfoPass appointment. Around 8:00 o'clock the next morning they called the house and told me it was ready to be picked up. All told, it took about 3 or 4 business hours.
