hi, i'm just here to vent really and wondered if anyone else has a similar problem. my husband and i got married within the 90 days, my k1 expires on july 20th so im sending off the AOS next week. my vent is that we tried to lodge our marriage papers on july 3rd only to find out the court was closed because of july 4th celebrations, therefore i couldnt do it until the following monday (being 6th july) then i went to the Social Security office to change my last name to my new married name on my SSN card ( which i needed the marriage certificate from the court house) to do, only to be told by them that my visa expires in less than 14 days so they cant do it. now today i tried to apply for a drivers licence in Louisiana but they told me seeing that im technically still a K1 i'm not allowedto get a driver's licence until i get my EAD, ugghh this is annoying, i cant work until i can get my ead i cant do anything until i get my EAD, i feel so bad for my husband that he has to work so hard, i think the laws need to change to allow people like us to be able to work, esp seeing that we arent allowed to apply for welfare (not that i want to or need to) but at the same time we cant work, anyone else feel as frustrated as me???

hi, i'm just here to vent really and wondered if anyone else has a similar problem. my husband and i got married within the 90 days, my k1 expires on july 20th so im sending off the AOS next week. my vent is that we tried to lodge our marriage papers on july 3rd only to find out the court was closed because of july 4th celebrations, therefore i couldnt do it until the following monday (being 6th july) then i went to the Social Security office to change my last name to my new married name on my SSN card ( which i needed the marriage certificate from the court house) to do, only to be told by them that my visa expires in less than 14 days so they cant do it. now today i tried to apply for a drivers licence in Louisiana but they told me seeing that im technically still a K1 i'm not allowedto get a driver's licence until i get my EAD, ugghh this is annoying, i cant work until i can get my ead i cant do anything until i get my EAD, i feel so bad for my husband that he has to work so hard, i think the laws need to change to allow people like us to be able to work, esp seeing that we arent allowed to apply for welfare (not that i want to or need to) but at the same time we cant work, anyone else feel as frustrated as me???

I applied my SSN before i got married. Put all my papers (insurance, bank account) under my maiden name. Today, i went to SS office to change my SS card name from my maiden name to married name and to have the work restriction taken off. I did not bother to think about changing my SS until i received my GC. Never got irritated with SS

I'm fortunate enough that I'm staying here in AZ. I'm required to get an AZ driving license if i plan to drive/stay for more than 7 months. I have been driving since i arrived last Dec here in AZ.

I tried to prevent frustrations by preparing for it ahead of time. Depression and being pissed off wont help me and my husband. Before depression and frustration kicks in... i look for things to keep me busy.

Just my 2 cents...

Yeah, that's all true with changing the SS# after marriage and the DL. Almost everyone needs EAD to do these two items. Some people luck out and can get the SS# changed to the new name prior to receiving EAD and/or get a DL, but most of us have to wait. Sorry you wasted time to go there. I looked Oregon's DMV up online and found we have to wait for the EAD as well.

I found that volunteermatch.org is very helpful - There are 225 listings within 5 miles of my house. You can even refine it to suit your interests.

The key I think is to keep busy. No, you may not be able to drive, but perhaps if it is close enough, you can walk or ride a bike there, or take public transportation?

The key is to keep busy, and to try to get out of the house. Volunteering may not bring in money, but you can feel accomplished, meet new people, and get out and see some of your new city!

January 22, 2010: Bogus RFE corrected through congressional inquiry "EAD waiting on biometrics only" Read about it here.

I'm very confused. My fiance is having his K1 interview in 10 days. I was told that he could get the EAD stamp when he arrives at the airport in NY. But reading your post, I'm wondering if this is the case. Did you try to get the EAD stamp when you arrived in the US? Thanks for your post!

I hear ya on the public transport.

Sorry if you have found the info hard to find.

It's really pretty basic and out there in loads of threads.

Maybe you should only research after your kids have gone to bed........... :P

I never had problems with ss but had similar problems with the DMV.

The DMV website said that a valid 1-94 would be sufficient proof that i'm legally here, however when I applied at the DMV I was told that the I-94 needed to have a one month validity to sit the written test and a two month validity to do the driving test and get your license... I explained to the girl that:

- the visa is valid only 90 days

- a social security card is required to apply for the license

- you can't apply for a ss card for 2 weeks after entering the US

- the card can take a further 2 weeks to arrive

Therefor my window of opportunity is zero....

Fortunately I have a car and can use my Aussie license until I receive my EAD, however I can't change the name on my bank accounts till I have my license :( they don't accept the marriage cert. Gonna be a race to get my license and change the name on the accounts before my AOS interview grrr...

Good luck and hang in there, just remember the situation is temporary!

Well girl, I am as frustrated as you. I've been here in Louisiana for more than 2 years now but received NO GC! And the worst thing is I did not apply for EAD (don't want to pay 340 bucks and get screwed more!). But, maybe I'm a bit lucky because i got my driver's license already.

Please check this out, that is OMV Louisiana website about driver's license issuance for aliens living in LA

http://dpsweb.dps.louisiana.gov/omv1.nsf/5...8f?OpenDocument

It is stated there that:

Fiancee of US Citizen (K1): once married to a US citizen MUST provide the Passport, Marriage License Certificate and Notice Of Action I-797 for change of status to be issued a DL/ID.

If in case you have not yet receive your EAD, you can still apply for license as long as you have your biometrics done. Just make sure you print out a copy of the above document. I needed to argue and showed them the document because they are not aware that I was qualified as I am in pending stage for I-485 application.

I will send you my email just in case you have any questions, I want to help because we share the same sentiments and i know exactly how you feel!

Good luck!

i think i m in the same boat as you...lol. i cant get my State ID, i cant work either ...i am blocked and the feeling of being useless is really deppressing. i applied for SSN after we got married so my marriage certificate shows my maiden name, but my SSN shows my husbands last name... my I-94 expired in april 9th i had to apply for the state ID, now i can not until i give them the proof that we sent the AOS to USCIS. i agree with your point of view that they need to change the laws; they should give the green card to k1 visa holders right away after they get married to US citizens, whats the use of these forms!!

Theres a really useful document you can print off here from the guides regarding a K-1 being eligible for an SSN. I'd print it and go back and wave it under her nose, I came up against an incompetent member of staff myself but felt unable to speak up incase I was wrong, now I have our congressmans office trying to undo the mess
