POLICE CLEARANCE FROM CANADA

Greetings fellow VJers!

I have a big big problem! Let me explain my situation first..

I am from Cleveland, Ohio USA.. and my Wife is from Manila, Philippines.

I have filed my petition I-129F for my Wife on december 2006 and everything has gone smoothly up to this day.

She recieved her interview appointment letter a few weeks back.

She managed to complete all the documents needed for her interview to held on July 12, 2007.. which is a month away!

We were excited as hell that in a month we would be done with all this and finally seeing each other again

would be a plane ticket away..

All is well and good until she told me the bad news just yesterday!

she didnt realize and probably overlooked the fact

that she needed one last document......... A POLICE CLEARANCE FROM CANADA!!!

she completely forgot about the document! suprisingly i did too.. no blames pls. we know what we did wrong!

she and her family went to canada using a tourist visa and they were in the process of immigrating there..

they stayed there for a year (she was 16 years old to 17 years old.. talk about bad luck!)

but they had to go back to the philippines because of some family problems so they stopped the process.

I told her not to panic as i confidently told her that i'll find a way to get it before her interview next month..

Little did i know how hard its going to be to get that piece of paper!!

I searched and i searched.. i dug my way through this forums inside and out.. but i couldnt find the

answers i've been looking for.. that is why im posting right now hoping someone out there can answer me..

and shed some light and support on our path that is now blocked by a huge obstacle.

Let me first tell you guys what i do know..:

1. K3 applicants just need a Police Clearance Check by name and birth date that should be Canada Wide using the CPIC

2. The RCMP requires you to file a finger printing test to get a police clearance if you live outside of canada (eventhough you dont actually need the said test)

3. The results will take 2 months - 12 months to process (OMG.. *FAINT*!)

4. http://www.***removed***/immigration/police-certificates.html - this site states that we only need a name check based police clearance and not a finger print based. and that filing to the RCMP is just a waste of time.

5. we dont need a finger print based check because my wife has no criminal record, so a name based check is sufficient

6. my Wife has no way of going back to Canada.

Is there someone out there that could help us?? we are trying to find out a way of getting a name based police check

without having to use the long process of finger printing blah blah blah.. we cant afford to lose another 2-12 months!

also the interview is in a month.. this suxx.. im so stressed out.. im spacing out at work.. my minds completely fixated

on finding a solution to this problem.. is there any developments out there towards getting a police clearance from canada.

i think its the hardest police clearance to get in the whole world..

PLS SAVE US.. thanks you kindly!

Sounds like you're going to have to make a call or two

THis is what I found online: Police Clearance from Canada:

HOW TO OBTAIN A CERTIFIED CRIMINAL RECORD CHECK

1) Full set of fingerprints required

To conduct a criminal record check we require a full set of fingerprints, including both rolled and flat impressions of all ten fingers.

Complete all fields on the fingerprint form. Incomplete applications will be returned to the applicant unprocessed.

If you are IN CANADA: you must have your fingerprints taken on form C-216C at your local police station or private accredited fingerprinting agency. Depending on the police jurisdiction, a fee may be required.

If you are OUTSIDE OF CANADA: contact the nearest police force which offers fingerprinting services. The RCMP will accept fingerprint forms from foreign countries that contain the following:

* rolled and flat impressions of all ten fingers taken with black ink

* full name, date of birth and sex of the applicant

* the name and address of the police agency

* the signature of the official taking the fingerprints

Note: Canadian embassies and consulates may not have adequate resources or facilities to provide this service.

2) Reason for Application

Clearly indicate the reason for your certified criminal record check :

* Adoptions - Canadian and International

* Foreign travel - Visas, U.S. Waivers, Border Crossing

* Employment *- federal, provincial, municipal governments; private industry; Canadian police forces

* Airport access screening

* Applications for immigration to Canada**

* Applications for Canadian Citizenship

* Applications to obtain criminal record to apply for a Pardon

* Volunteer work *

* Name change

* Permanent residency in foreign countries (all countries except Canada)

* Applicants for employment or volunteer work must specify the job title or position sought in the "REASON FOR APPLICATION" portion of the fingerprint form.

** Applicants for immigration to Canada must enter the name and address of the Canadian Immigration Center, Embassy, Consulate or High Commission handling the case in the "Name and Address of Contributing Agency/Dept" portion of the C216C. If you have an immigration file number, write it below the address as a reference for immigration officials.

3) Personal Information

Ensure you provide your full name, date of birth, sex, mailing address and phone number and/or fax number and/or e-mail address. (No further information is required , such as social insurance numbers, passport copies, photographs or addresses of former places of residence.)

4) Identification of police service or fingerprinting agency

Verify the information recorded by the official taking your fingerprints and ensure that the official's name and signature, and the name of the agency is indicated on your fingerprint form.

5) Processing fee

The processing fee is 25.00$CAN or 18.00$US, and is payable to the "Receiver General for Canada" by certified cheque or money order. Payments by credit card are not accepted.

The processing fee is in addition to the fee you may have to pay to have your fingerprints taken.

This fee does not apply to all types of applications. Read the following information carefully to identify which type applies to you:

FEE REQUIRED

FEE NOT REQUIRED

Adoptions - Canadian and International

Applications for Canadian citizenship

Foreign travel, Visas, U.S. Waiver, Border Crossing Applications for Immigration to Canada

Employment; private industries Federal Government Screening when requested by Departmental Security Officers

Permanent residency in foreign countries (except Canada) Canadian Police Force personnel when requested by Canadian police force officers

Applications to obtain criminal record search to apply for a Pardon Volunteer work (e.g. Boys and Girls Club). Request must be accompanied by written confirmation from a bona fide registered non-profit organization.

Name Change applicants Airport access screening

* NOTE: Applicants must submit a fingerprint form and a fee for each separate type of request. (i.e. US Waiver and Pardon Applicant requires two fingerprint forms and two fees.) To avoid delays, please submit both applications together.

6) Release of information to a third party

The release of personal information is governed by the Privacy Act and ministerial directives. If you want the results of your criminal record check forwarded to a third party, such as an agency, lawyer, friend or family member acting on your behalf, you must provide written consent authorizing the RCMP to release your criminal record information to the individual or agency.

The consent must contain a statement that you are aware that refusal to give consent to release information to a third party will not negatively affect your request. Your consent must be an original document.

NOTE: Faxed or photocopied consent letters are not considered valid and will be returned unprocessed.

7) Final step (checklist) :

Before sending your application, make sure it contains the following:

* original fingerprint form

* full name

* date of birth

* sex

* mailing address

* phone number, fax number or email address

* reason for application

* processing fee ( if applicable)

* third party consent letter (if applicable)

8) Mailing addresses:

Forward your request with all relevant documents by mail or courier. Note: Hand-delivered fingerprint submissions will not be accepted by local RCMP offices:

By mail:

RCMP

Civil Fingerprint Screening Services

P.O. Box 8885

Ottawa, ON K1G 3M8

By courier:

RCMP

National Police Services Building, Loading Dock #1

Information and Identification Services

Civil Fingerprint Screening Services

1200 Vanier Parkway

Ottawa, ON K1A 0R2

If you wish to have your results returned by courier, you must enclose a prepaid return envelope (not C.O.D.) according to the following conditions:

* If you are outside Canada, the prepaid envelope must be from an internationally recognized courier service.

* If you are in Canada, the prepaid envelope must be from Canada Post or from an internationally recognized courier service.

* If you are using a courier service company, the attached waybill must bear an account number which could be from your own contractual agreement with a courier service company or from a courier service agency, in which case a temporary account number would be given upon payment of one prepaid envelope.

* If you have difficulty obtaining a temporary account number from an agency, call other agencies until you find one that will provide an account number.

* All conditions above must be met, otherwise documents will be returned by regular postal service, even if funds or credit card information is provided to pay for courier service.

9) Release of pardoned record for a U.S. waiver

Through international agreements, the RCMP shares criminal records information with foreign authorities who may register this information in their databank.

If you have been convicted of an offence, you may subsequently be refused entry into another country, even if you have since been granted a pardon in Canada.

Many foreign countries, including the U.S., do not recognize a Canadian pardon unless you produce a copy for their evaluation.

To obtain a copy of your pardoned criminal record:

Follow the procedures portion outlined above in HOW TO OBTAIN A CERTIFIED CRIMINAL RECORD CHECK and write "Request for PARDONED Record" in the REASON FOR APPLICATION box of fingerprint form C-216C.

Complete and sign a Privacy Act, "INFO SOURCE, Personal Information request" form TBC350-58. Faxed or photocopied signatures will not be accepted. Paper versions of the form are available from:

Treasury Board Central Distribution Centre

300 Laurier Ave. W. RM. 140

Ottawa, ON K1A 0R5

and are also available at your Local Employment and Immigration Centre and your Federal MP Office.

Clearly state that the request is for the "release of information for which a PARDON has been granted."

Send your application to:

* BY MAIL:

I did this when I was in canada, so not sure if they would mail out of Canada---have any friends in Canada they could amil it to" I contacted the Winnipeg City police http://winnipeg.ca/police/BPR/info_request...m_record_search Instructions for mailing are on there!! I had to say it was for Immigration, and that was reflected on the paperwork I received from them, and it did say it was a Canada wide search!! Cheers

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied,that is if ur polite and didn't lie! Refer to #1

i read about someone who wasnt in canada that got her police clearance by asking her father to go to a police station and file on her behalf.. she provided 2 IDs and a authorization letter to her father..

can i use this method to get my wifes police clearance?

i would do anything to avoid filing fingerprints to the RCMP because the RCMP takes too long to process

If she has anyone in Canada that she can send her ID to, and an authorization letter to, then you could try that way. I think I saw something on this site quite awhile ago about that as well. You might search for that thread here on VJ and send that person who posted that a message and request further clarification. Barring that, as flames suggests, call the police where she lived and just ask them on the phone what they will require. Just tell them you need a name check, not a fingerprint check.

The only other thing I can think of, is that she puts in the paperwork now..yes, it might take a few months. If the Consulate or Embassy refused to grant the visa until that name check has been received by them, then you'll maybe have to just wait until it's received and send it in then. I know this will probably delay her visa approval and arrival for another month or so, but other than the above suggestions, I just don't know what to say.

One could always hope that they don't ask for it!

Wishing you luck in finding a speedy way of resolving this!

When I did my name check police clearance, they had taken a digital photo of me which was put into the police clearance record I received from them. Is that why they do not do a name check Police record for people not in Canada?

Not all places in canada take pics!! The RCMP in greenwood NS didnt,nor did the Winnipeg one I had done(which I didnt use) there really is no set standard for the police background check, even when dealing with the RCMP!!

Ditto- I got mine done in St. Albert outside of Edmonton and there were no fingerprints (I have no criminal record) and no picture taken - which was good, if I remember the fact that I looked like cr@p that day.

For the original poster: I am not too sure the RCMP will accept whichever pieces of ID in someone else's name and release the records to her parents or anyone else.-I think the best to do is indeed, like falmes said, CALL the RCMP detachment or police station where you are planning to do this - if you are lucky (and i hope you are), they may take the power of attorney and the IDs. ANd, if she has no criminal record, the process is waaaaay shorter (say 72 hours for me).

Good luck, L.

I'd call the RCMP, maybe even try Kingston, Ontario

I went in for my police check and there was a poster on the wall that said $25 for Immigrant visa's. I told the receptionist what I wanted she just took my driver's license and some basic information,came back 5 mins later with my CPIC.

I don't see why you can't fax ID to them with the fee and have them mail it to her.

EDIT: I just don't understand the time difference across the country, even the local police station will do ours in a few minutes if they're not busy, otherwise it's the next day.

EDIT again!! ARE YOU SURE SHE NEEDS ONE IF SHE WAS UNDER 18??????????

OK. this just in. :reading:

after 23 hours of surfing the net non-stop for different police stations and fingerprinting companies i can call across Canada..

i think i may have found a solution to my problem!

i called IFS, Commissionaires, RCMPs 3 differenct detachments, 6 different police stations.. ill just say i called em all

maybe even dialed a wrong number and got your house by mistake :jest:

they all told me "nope, nope, nope.. we cant help you.. you have to do a finger print check with RCMP",

"right now i'd say it will take 6-8 months to process"

*FAINT* :crying:

i gave up during that time.. and left my chair which i had patented with my butt mark!

i thought about sleeping but a PM popped up on the screen of my laptop and i was back on my warm chair with the mouse in my hand!

it was a pm from vanee here in VJ. we talked a bit till she mentioned about winnipeg police station..

yup the same one flames9 was talking about. then it hit me, "OMG, i forgot all about that police station"

it was on my list of police stations to call. i did call them but a machine always picks up. so i thought to call em back

at another time but never got to it because it slipped my mind. good thing vanee made me remember!

so i called em up again.. with all hope that was left in me.. !%$%$# MACHINE AGAIN :dead:

good thing i wasnt in the mood to just call it quits

i went back online clicked the link to the winnipeg police station vanee gave me

looked at their hours of operation (clearly they were open)

looked for different numbers i could call

saw one...

dialed...

woman answered.. we started talking

*conversation*

"ok thank you, bye"

:mellow::o:blink::bonk:

turns out stupid me had the wrong number!!

i had the number for the "after-hours"

after a raised brow that i gave myself while looking at my reflection in the mirror

i called up the "right" number

and alas, my salvation began....

they told me that they could cater to our situation!!! :dancing:

REJOICE!!!

all we need to do is fill up some forms,

attach 2 IDs and the $30 Fee

and mail it to them.

if we do this correctly and in a timely fashion

we may have the results in time for my wifes interview!

no more 221-g weeeeeee

to good to be true, AYE? ;)

Cheers,

Ryan
