I started reviewing the information that I have to fill out for the I-134, Affidavit of Support. I have a question though. I think I know the answer but maybe somebody else has gone through this to.

I am divorced with two girls from my previous marriage. My ex-husband and I have joint custody. This means I have my girls one week and then my ex has them the next week. We alternate. On my taxes, I claim one of my daughters and my ex claims the other one. Should I only show the daughter I claim on my taxes to Question 8 - the following persons are dependent upon me for support or do I include them both?

Any help would be appreciated!

I, too, have 2 daughters from a previous marriage. The way that I figured it out was based on child support. I pay child support for both girls, but then so does their mother (technically speaking). Therefore, I said that both girls were partially dependent on me. Oh, and I claim both girls on my taxes.

Without knowing the specifics of your case, it sounds like you and your ex are both partially responsible for both girls.

Look up a response JanaknJanet gave to a similar question on Apr 17, very helpful. Also, you are required to claim all your kids on the visa forms whether or not you claim them on the tax forms, look under the I864 requirements.

There are two categories for showing dependents on the I-134 are there not?

Sounds to me as though your daughters are both partially dependent on you (and partially dependent on their father).

There is no child support involved. We waived that. I will have to see if I can do some more digging on this.

No child support makes it even more clear-cut. You and your ex- have joint custody, the kids live half of the time with you and half the time with their father. They are 50% dependent on each of you.

There is no child support involved. We waived that. I will have to see if I can do some more digging on this.

If there is no child support involved, then they are partially dependent on you. While they are with you, you pay for them. While they are with your ex, he pays for them.

Seems pretty clear cut to me. I don't think you need to do any more research on this.
