I want to double check my understanding of the K1/K2 process, especially regarding the child.

I am in the final stages of getting the initial I-129F submitted. There is nothing in there about my fiance's child other than a line item on the G-325. I believe that there is nothing additional needed at this time. My understanding is that during the interview at the consulate, the discussion of the K2 visa will come into play.

Is there paperwork that will be filled out on site? I ask, because in the docuemtation I have read, it does not seem to mention that Birth Certificates for the finance or child need to be included in the packet at the consulate.

Am I missing something?

The child will need a medical exam and submit a visa application along with the filing fee, same as your fiancé. If the child is under 16 no police clearance will be needed and the medical exam fee is reduced. I don't know the procedure of every embassy in the world, but I'm pretty sure that a birth certificate is going to be required for both of them

Yes mdyoung poster is correct. Please make sure of several important things , ok ?

Names of the birth certificates are correct

Check to see if the childs pinoy father is listed on the birth certificate

Please start this way ahead of time,ok

Brad,

You say your having problems in this area? I have a simular situation. My fiance has a 15 year old son who is coming with her. His BC is OK but there is no father listed on there. Is that something that will work for us or against us? I am worried about needing something from his biological father for him to leave. (that isn't gonna happen)

Maybe his bc is an abbreviated one? I know my childrens bc's were like that and I had to apply for their full bcs showing both parents? Unless you fiancee has full custody of her son the consulate will require consent from his father for him to leave and some consulates have been known to ask for a parent's consent even with full custody.

Maybe his bc is an abbreviated one? I know my childrens bc's were like that and I had to apply for their full bcs showing both parents? Unless you fiancee has full custody of her son the consulate will require consent from his father for him to leave and some consulates have been known to ask for a parent's consent even with full custody.

It is a full BC. The spot for Fathers name has N/A in it. It was a delayed submittion and by that time her and her ex were broken up. She didn't want the bum's name on it. Her son carries her madien name. At the annullment Luz was granted full custody although it has the customary "reasonable visitation" remark on it.

Hopefully that will be ok just check with the consulate in case they require additional consent.

Good luck to you both.

Luz's son has his passport now and that isn't a problem. I just have this nightmare that he will be turned away at the POE. He already calls me "Pop" and I really want to adopt him after his mother and I get married. I have been trying to get an answer from my lawyer about this but so far I haven't gotten an answer from him. I guess I will have to camp on the phone and wait my turn to talk to him. :angry:

hi, as for my experience ... my son were included in my K1 process, so he got K2 visa with me. As far as i inquire to DSWD who handles social welfare .. my son father is not included in my son BC means dat my son is handling my surname bcos me and my exbf wer not been married at all, i ahve no problem bringing him to US, tho in some cases father surname of child needs to get permit to travel from DSWD and maybe asked for approval letter from the father, that will make a hindrance.

So, in my case as well as ur fiancee .... u dont needed for permit to travel... just let remind your fiancee to bring original BC (NSO paper) and also a recopy of it, included in her son passport whenever she went thru Philippine Immigration at the airport, or else she will be hanged up inside the immigration office for questioning and possible delays askign for original documents.

spunky, everything falls into documents .... u need to have proper documents before you do so...
