Q about me taking my daughter with me to USA

Hi guys! I really need your help. Is anyone here who is a single parent but filed for a fiancee visa (I believe it's K-1 and K-2 visa) and is going to take her son/daughter to USA? My fiance applied a visa for me and my 4 year old daughter. Someone has told me that I should need to get an Affidavit of Consent coming from my daughter's biological father even though we're not married. I didn't know that I need it. I would appreciate a lot if any of you could give me an advice with regards to this matter that way I can get that affidavit before the schedule of my interview at the Embassy.

Oct 8 - 20, 2007 - He stayed with me and Chin for his trip

July 3, 2008 - Visa on hand! yaaayyy!!!

September 3, 2008 - Left Philippines via JAL / AA

September 3, 2008 - Arrived Florida USA

It all depends on whose name is on the birth certificate - if a father's name is there, then you may need such a letter - if there is no name, then either nothing is required or a document from a court is required depending on the country's requirements to leave. Post a little more details and someone can tell you exactly what you will need - many people have done the same. Good Luck

It all depends on whose name is on the birth certificate - if a father's name is there, then you may need such a letter - if there is no name, then either nothing is required or a document from a court is required depending on the country's requirements to leave. Thanks a lot for the reply. Yes, the father's name is on the birth certificate. The problem is I don't know how I could get a hold of him. I no longer have any contact with him. I dont know where he lives. Last time I heard from him was he is working in Malaysia. That's it. He never bothered to communicate with me.

Suggestion.

Go to NSO office and do another Birth Certificate, and for father leave blank or put in Unknown.

I wouldn't recommend removing the fathers name from the birth certificate - many places have mechanisms for taking a child out of the country if the father is not traceable - you may have to ask a local attorney. I don't understand why you would make the child to not have a father - that would be very humiliating once the child grows up and looks at you with resentment. Good Luck

Suggestion.

Go to NSO office and do another Birth Certificate, and for father leave blank or put in Unknown.

I wouldn't recommend removing the fathers name from the birth certificate - many places have mechanisms for taking a child out of the country if the father is not traceable - you may have to ask a local attorney. I don't understand why you would make the child to not have a father - that would be very humiliating once the child grows up and looks at you with resentment. Good Luck

I disagree. The father has left the scene. He got her pregnant and moved on. This is very common in PI.

Divorce is illegal in Philippines, and child support does not exist.

I will assume you have never been to the Philippines, nor do you know the ways or culture.

Is this only in the case where there was never a marriage/annulment? If the biological parents were never legally married, the requirements for a notarized letter of permission from the biological father is waived?

based on my limited knowledge of the Family Code of The Philippines, my own experience, and what I've seen posted by others in similar situation, no consent need from biological father for children born out of wedlock. I'm not as familar with the situation of children from an annulled marriage.

Since the parents were not married at the time of birth, the father's name should not have been indicated on the birth certificate. Unfortunately, the father is on the birth certificate so his written consent might still be needed before the child can leave the Philippines.

I suggest that the OP contact the DSWD and get their advice on this since it's the DSWD folks who will be looking for this certification at the airport.

* A minor traveling to a foreign country accompanied by a person other than his or her parents.

WHO DOES NOT NEED TRAVEL CLEARANCE?

* All minors other than those cited above, for example:

o A minor traveling to a foreign country with either parent or with his or her solo parent or legal guardian;

o A minor traveling abroad whose parents are in the Foreign Service or living abroad or are immigrants, provided he/she is holding a valid pass such as a dependents visa/pass/identification card or permanent resident visa/pass/identification card which serves as proof that he/she is living with parents abroad and their travel does not constitute child trafficking.

The above is not applicable in the OP's context. The missing top lines from this quote state...

TRAVEL CLEARANCE FOR MINORS

A travel clearance is a document issued by the DSWD to a Filipino child (below 18 years of age) traveling abroad alone or with someone other than his/her parents

This is for a child to travel with somebody besides their parents (plural), not immigration and even fails to address the requirments for traveling with just one parent instead of both. It is a PI requirement that has nothing to do with what USEM would require in the OP's specific situation. I would email USEM directly for the requirements applicable to the OP's specific situation with regard to USEM issuing a visa and assure you their answer will comply fully with PI laws.
