Hi,

I am a bit confused. As our wedding date approches, my K1 fiance and I have been looking into the AOS and also a SS# for him. According to the many posts I have read here, he is fully able to get his SS# before the AOS. However, according to the Social Security website, one of the documents he is required to show is work eligibility. What is this exactly? To me, it sounds like they are requiring the EAD which we won't have at least until after we file his AOS. This is very confusing.

As a K1 holder, you are work authorized. Go ahead and apply for your SSN. Your EAD/GC is proof of that authorization, which you must obtain to legally work.

K1: 01/15/2009 (mailed I-129F) - 06/23/2009 (visa received)

AOS: 08/08/2009 (mailed I-485, I-765, & I-131) - 10/29/2009 (received GC)

As a K1 holder, you are work authorized. Go ahead and apply for your SSN. Your EAD/GC is proof of that authorization, which you must obtain to legally work.

So, his K1 visa is his proof of eligibility to work and then the EAD is his authorization to work?

Just by showing your I-94 and valid passport, you should have been able to obtain an SS#, which is what I did in my wife's case days after she arrived in the US. A K1 does NOT give one the autorization to work. This must be authorized at POE or when doing the AOS period.

You are able to obtain a SS # since your arrival as a K1 nominee. You will advise your CSR at the SS office your current status. You should wait at least 2 week after arriving to visit your local office. Your SS will be issued with restrictions - work permit only. I did this for my fiancee 2 weeks after the arrived in NY. Bring your passport that should have the I-94 and visa stamp [K1]

In any case, download and print this internal email from this link..... http://www.visajourney.com/forums/index.ph...page=otherforms. It is called SSN K-1 Authorization. Basically the email states that since year 2000 all K-1 holders are authorize to apply for SSN without needing the GC first. Also you might want to print RM 00203.500 from the SSN website at https://secure.ssa.gov/apps10/poms.nsf/lnx/0100203500.

January 25, 2010 - Cory received her SSN

March 9, 2010 - Received appointment for biometrics - will be on March 18

March 18, 2010 - Biometrics done

March 19, 2010 - Touches on I-485 and I-765

March 25, 2010 - Advance Parole approved..received on April 1 in the mail

March 29, 2010 - I-485 notice date, received on April 4, 2010

May 3, 2010 - EAD approved

May 5, 2010 - Date interview....approved
