Hello my friends.

We've been told again and again by the SSA staff that my wife, who entered via K1, needs the EAD to apply for her SSN. I've explained them that she does not require it but with no avail.

Anyway.....her I-94 expires on Feb 4. We are about to submit the paper for AOS. Does the SSN is necessary for the I-485? If I file them without it will I receive an RFE or a denial?

January 21, 2010 - Submitted AOS

January 25, 2010 - Cory received her SSN

March 9, 2010 - Received appointment for biometrics - will be on March 18

March 18, 2010 - Biometrics done

March 19, 2010 - Touches on I-485 and I-765

March 25, 2010 - Advance Parole approved..received on April 1 in the mail

March 29, 2010 - I-485 notice date, received on April 4, 2010

May 3, 2010 - EAD approved

May 5, 2010 - Date interview....approved

Print out of the special internal directive from the SSA and bring that to the office so you can educate them. Be professional.

Print the following webpage out (K-1 Visa Holder Only); pay attention to section C:

Social Security card/number is not needed to file AOS - they ask for the number if you have it - but it isn't required and you won't get an RFE for it.

If the I-94 still has at least 14 days remaining, the SSA should issue the card - as suggested in the "How to get an SS Card Guide," print THIS out, return to the SSA and ask to speak with a supervisor if you still get rejected.

I had the same problem. And after the first visit to the SS office I came away thinking this was so stupid....

It helps getting the green card by having my wife on my health insurance (bonafide relationship).

For health insurance she needs a social security number.

And I was being told that for a social security number she needs the green card..... :wacko:

So I went looking on the internet and printed out the social security regulations posted here and made a second trip to the SS office. They finally figured out how to give my wife (K1) a social security number, but they couldn't figure out how to give her daughter one (K2). They at least seemed like they wanted to give her one but they couldn't figure out how to bypass the field on their computer where it asks for the green card information.

And after the first trip to the SS office when they said we would need the green card and the marriage certificate (for name change), on the second trip when we brought the marriage certificate they said her SS number would still have to be under her maiden name until she gets the green card. :huh:
