Travelling w/in the US w/ an expired I-94

My fiance and I will be traveling to Hawaii for a cruise in September for our honeymoon. At that time, his I94 will be expired and we may not have the AP document or an unexpired California ID card. He will have to use his foreign passport as identification at the airport. Will he have any problems using his passport with the attached expired I94? If so, I can try to reschedule the cruise before his I94 expires. Any advice would be helpful.

He'll be in the country on the K1 then waiting for AOS.

My understanding and I am sure someone will correct me if I am wrong, but as long as it is a domestic and NOT an international flight you should be fine.

I thought the same thing since he will not be leaving the country. I'm just concerned that a TSA person will see the expired I94 in his passport and think he's out of status. any thoughts from anyone who has traveled w/in the US by plane with an expired I94? Or knows of someone who has done this?

TSA ID checkers at one time were directed to look at immigration status if they suspected something... they have now been told to not to....

generally speaking... A cruise is a bad idea, particularly if you venture into international water and the ship is subject to immigration upon return

It leaves from Honolulu and stays in Hawaiian waters the whole time. Never leaves US territory. I guess I'll check with the cruise company but I choose this particular cruise because it never crosses any international borders.

Ok. Thanks for your advice. I'm going to call the cruise line tmrw and TSA (if they even allow people to call them) and see what they say. I have until the end of June to cancel the cruise so I guess I have time altho that'd be sad. We also plan on applying for AP in May or June so I hope we'd have the AP doc by then. Just being cautious. Thanks everyone for the advice.

I'd be careful because you do technically leave the country when you enter international waters. In particular if something happens and you have an unexpected stop (it happens, happened on my last cruise in fact). You'd be safer if you just flew for a Hawaiian vacation.

I spoke with the cruise company today and they said it wouldn't be a problem. I just need to check with TSA. In all likelihood (if there is a such a thing with immigration stuff), we will have the AP by the time we go on the cruise.

You have filed the AOS, did you receive the receipt NOA? He should be able to travel within the US with no problems other than providing identification and the passport should do that.

Yep, I did the same. I did bring my AOS NOA and my marriage certificate with me, as well, just for my own peace of mind. Never had a problem, and I flew a lot too. No experience with domestic cruises, though. Unless you count the Jungle Queen Riverboat Cruise.

Seriously, though. I imagine if you're just cruising around the Hawaiian Islands and not venturing 200 miles out into international waters you'll be fine. If you don't go through Customs at any phase in the cruise then you're good to go. Have fun!

I did bring my AOS NOA and my marriage certificate with me, as well, just for my own peace of mind.

This is a VERY prudent action at all times, perhaps even driving around one's home city. I won't let my wife out of the house without either document. Everyone is so frustrated about being unable to do anything about illegal immigrants that they'll look for any excuse to take it out on the lawful-but-not-yet-legal... so avoid giving them that chance, si man.
