Hi guys, I am looking for a little help and after reading the forums am still a little confused. My fiance came here on a K-1 with her two children on K-2's ages 10 and 16 both have birthdays in November (obviously a year older then). Am I right to assume that I have to pay $1010 for my wife (we got married two weeks ago) and $1010 for the 16 year old and $600 for the 10 year old to file the I-484's???? Also if that is the case can I just do my wife's 484 and then file for the children when she is approved? Thanks for any help you can give me.

First of all it is the I-485 not I-484

You are correct with the filing fees IF and only IF the 10 yr olds I-485 is submitted concurrently with the K-1's I-485. If it is submitted a day or more later the fee becomes $930.

This is correct. According to the instructions for the I-485:

Filing Fee :

$930 plus a biometrics fee of $80; the fee total is $1,010. Exceptions listed below. There is no fee for applicants who are filing Form I-485 based on having been admitted to the United States as a refugee. Applicants 79 years of age or older are not charged a biometric fee; the fee total is $930. Applicants under 14 years of age: - Filing with the I-485 application of at least one parent have a fee total of $600 - Not filing with the I-485 application of at least one parent have a fee total of $930

The 16 year-old will always have to pay $1,010 regardless. And yes, you can wait to file for them but make sure you get them a social security card before their I-94 expires so they can at least have a SS number.

K-2's are not eligible for a SSN unless they have EAD or GC...

That's true. I remember now Parkpapa had to file an I-765 so the children could get a SS #.

I have a question about this subject also.... Diana, Angie will be here first, and then her daughter will come in December.... you must file this prior to the end of 90 days for Angie, as we will be wed during this time, but with her daughter coming in December (2 months later) and she is nearly 15, it doesn't matter that we file at the same time as no cost savings will come my way... correct... and furthermore, she will have 90 days from time of entering the country,,, so if she comes in 1st of Dec, she will need to be filed by the end of Feb. Correct??? Thanks!!!

the 90 days referred to is the time a K-1 has to get married after entering the country. It's good to file for AOS before the end of the 90 days, but it is not required. for the K-2 following to join, 90 days does not apply. file for AOS as soon as you can after she enters the country in December.
