help needed.... what next?

Timeline

i hope some of you could help me. here is my situation:

in october of 2005 applied for k3 visa for my husband who is in pakistan. in november 2005 got noa1 and filed for i-129f for my husband. i received noa1 later that month. in december 2005 i received letter from nvc for copy of original marriage certificate in its original language. i sent it that week. then earlier this month i received letter from nvc stating they wanted me to send them a money order/cashier check for $70 to them. they said they will send me more paperwork once they receive the funds.

will these papers be the affidavit of support papers or something else?

then the other day i received a letter from nvc requesting information for agent of choice letter DS 3032 form. is this so that they can have an address to send information about my husbands case to? i sent the letter to pakistan my husband because they need his signature. i'm going to give them my address so that i'm the agent. is that what i should do? has everyone elase gone through this process as well?

should i be expecting to get a noa2 soon? if not, what should i be expecting to receive from now on from ins?

also, how do i check the status of my case online? is there a way to check that with my case number?

one more question, how do i set up a timeline at the bottom of my posts like many of you have set up?

Cons, I see that you haven't gotten any answers...

You'll probably get more replies if you post this in the K-3 forum. This is the Off topic forum. :yes:

I came here on a K-1 visa, so I'm afraid that I can't really help you too much.

To check your case status online, go to the USCIS website and root around...you'll find a place for case status there.

As for making your timeline/signature, if you go to the link for "My Controls" located at the top of the page and then click on Edit my Signature, you will be able to figure it out.

Ok.....lets see how I go sorting out what you have posted :)

What you are describing is the I-130 process for CR-1, nothing to do with the I-129F process for K-3 visa.

Your I-130 was approved and forwarded to NVC and you received the AOS Bill (affidavit of support) $70. You have also received the DS-3032 (choice of agent) Your husband in Pakistan would also of received the DS-3032 and it is him that will complete the choice of agent form. If he has not received his you can fax or email the one you received to him for him to complete and forward to NVC. It is recommended that the USC be made choice of agent due to international mailing times.

Have a read of the CR-1 flowchart HERE which will show you the NVC process. Bare in mind that once the USC is made choice of agent, all correspondence will be forwarded there, even the DS-230 which the beneficiary must complete and sign.

What you are describing is the I-130 process for CR-1, nothing to do with the I-129F process for K-3 visa.

another poster on this site provided me with the uscis site where i could check the status of my cases.

both my i130 and i129f were approved last month in january.

as i stated earlier i have put myself (the usc) as the choice of agent. i have sent the forms to him for him to sign. he will mail it to nvc and also fax it as soon as he receives and signs it. it's stated in the following thread http://www.visajourney.com/forums/index.php?showtopic=117 that there is a way for the beneficiary to EMAIL their choice of agent to NVC. is this true, and if so, what is the email address that my husband can send this to??? :blink:

with the case # that i have from nvc, is there a way i can check the status of my case online or can i only check it through the phone?

also, now that my i129f has been approved, what can i expect from that? should i be getting more stuff from nvc regarding my i129f??

Lorelle, i just noticed that our timeline is almost the same! i sent out my intial i130 application on october 24, just a few weeks after you. cool!!! however, we are US & pakistan as opposed to US & australia.

The only form you really have to send him to sign is the DS-3032. He can download, fill out and sign the DS-230 and mail to you in readiness for when that needs to be sent to NVC. The other option as you mentioned is emailing by using the example in the link that you posted. The email address is NVCInquiry@state.gov. Always make sure you put case number in the subject line when emailing NVC.

The only way to check on your I-130 petition is via the automated phone service.
also, now that my i129f has been approved, what can i expect from that? should i be getting more stuff from nvc regarding my i129f??
The I-129F once approved at service center usually only stays at NVC a short time before being forwarded to embassy. You will then receive packet 3 which contains more forms etc.

Have you decided which way you are going to go........the CR-1 or the K-3?

We are procrastinating a little at the moment but hopefully once we do what we have to, we can still be on target so I will get my interview early/mid April sometime.

why did they give me this address? can i found out the staus of the case through this address?

you asked if i am going to go CR1 or K-3 route....at this point i just want him to get here ASAP. so far, it seems like it will be K-3 visa as it is on its way to the embassy already. the CR1 (i-130) seems like it may take a lot of time before it reaches the embassy ...at least another 2 or 3 months based on all the paperwork (i-864, IV bill, ds-230) that still needs to be filled out. i also found out that the IV bill is $380!!! that's a lot of money for me right now. it seems to me right now that the $380 will be a waste of money. am i right or wrong?? do you think that we should still pursue the i-130???

at this point i'm getting all the following together:

1-A copy of the entire I-129f and I-130 package

2-notarizedAffidavit of Support form (i will need a co-sponsor as well, should i prepare co-sponsor i-134 as well??)

3-A copy of the letter above that i received in the mail from nvc

is there anything else i should be gathering together before i send it to my husband for his packet #3?

The I-129F for K-3 visa only stays at NVC a very short time in general before being forwarded to the Embassy. No this is not your NOA2. You do need the NOA2 to my knowledge for the interview.

Totally up to you Molly. You dont have to persue the I-130 by paying the fees as can do AOS once in the US via the K-3. You are still going to be up for costs though once there for this.

Your husband should also have on hand for the interview, any originals of documents etc that were sumbitted as photo copies.

just an update on our situation since i haven't posted in a while....

as far as the K-3 goes, my husband received packet 3 (or 3.5?) last week. his interview is scheduled for April 7, 2006!!! we are both very happy and excited to hear the good news!!!

this is the list that we have compiled so far for the K-3 interview:

- DS-156 (2 forms)

- DS-157

- birth certificate

- marriage certificate

- evidence of relationship

- I-134 (myself & sponsor)

- 2005 federal tax return

- job letter

- evidence of assets

- passport

- medical report

- police clearance

- photos for visa

- $100 visa fee

is there anything missing from the above list? i will send two I-134's to my husband, one will be mine, and the other will be my brothers, who is the co-sponsor. will my brother and i need to send 3 years federal tax forms or just 2005's?

will my husband need to send any of the documents on the list right now, or does he just need to have everything on the list ready when he goes for his interview?

i hope everyone else is doing well!!!

by the way, i still don't know if we should continue with the I-130, since we now have an interview date for K-3 visa......any thoughts on whether or not we should still pursue the I-130???

Hi Molly,

You should also send your hubby a complete copy of the entire package and any correspondence (RFE's etc) of the I-129F petition. Also any original certified copies of anything that you submitted as a photocopy.

Im unsure what Pakistan requires as far as how many years tax returns. The I-134 only requires one year when it is used for K visa's, however from reading other posts some embassies have wanted 3 years. You would be best checking in the Regional Forums to find out what is needed there.

You and the co-sponsor should send your hubby the I-134's etc well in advance of the interview so he has them on hand ready. Anything that is required to be sent by your hubby will clearly indicate that, otherwise he just brings everything to the interview.

i'm still working on sending the affidavit of support papers to my husband for his k-3 interview next month. i have a few questions i hope some of you can answer for me:

1 - what form does the co-sponsor, my brother, need to fill out? is it still the I-134 that we BOTH need to fill out or is it a different form?

2 - i still don't have NOA2 for the I-129F, is there anything i can do because i've already called VSC and they said they will send it, this was over a week ago??!!

3 - i'm still filling out I-864 AOS for the I-130 process, i will need my brother as a co-sponsor, will we BOTH need to fill out an I-1864?

1. Same form.

2. I was under the impression that if an NOA2 was sent, yet one hadnt received the NOA2 for what ever reason that one had to pay something like $200 to have a new one issued. Had they sent you one originally? Was the request for a replacement?

3. Yes. Unless he lives with you and you are using his income as well as household income on your I-864, which in that case he needs to complete an I-864A
