PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies
Traveled to Canada for 20 days after entering the U.S. on a K-1 visa (June 1–22). Seeking reentry under Automatic Visa Revalidation (AVR).

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

4 RepliesHello friends; I'm curious if anyone else is experiencing "delay" regarding their application arriving to the embassy in their country. Almost all sources online, along with the other entries I keep up here, seem to indicate K-1 applications arrive 10-11 days after the NVC sends out the notification that the petition has been sent.
We received our notification on 19th of February, and it's been almost three weeks with no response from the embassy. We've emailed them, the interview portal, called the embassy, checked on the CEAC website; still looks to be in transit. Does DHL usually take this long? I know we might have a more peculiar situation since we're waiting on the Ankara embassy in Turkiye, and the current events may be making it harder. We're about to file our DS-160 anyway; is this normal? Thank you for reading!

My parents interview is scheduled for this month for an IR5 interview. Unfortunately, I have lost my BC. Here is the kicker:
I had two BCs . One was registered 5 years after my birth (normal in my birth country). Parents thought they lost it and applied for another. Due to the upgrade in the format and government structure changes, my parents were issued a new one. Same details but different registration number. I got an RFE for both birth certificates. I responded by providing the first birth certificate again with a certified english translation. Case was approved. Now that my parents are scheduled for an interview, I cant find the original BC. What should I do? Should I just have my parents take the second birth certificate?To make matters worse, I am from one of the 75 countries.
Seriously contemplating withdrawing the K-1 and switching to a CR-1

8 RepliesContext: My fianc is American and lives there, I have a NZ passport but based somewhere in Asia (we're both second gen immigrant asians).
We've been long distance for 2 years and got engaged last year, we sent the K-1 application in end of November 2025, and got the confirmation it was received not long after in Dec.
But with how things are unfolding in the States, I feel like I would feel so much safer doing the CR-1 and landing already with a GC, not to mention I would have the rights to work straight away without relying on my to-be husband until I get my work permit. (He can support the both of us financially but I'm not sure how not being financially independent will affect me)I don't know if it'd make me safer for sure, but the peace of mind seems like it's worth the maybe a year longer wait.
Statistically I know most likely I would be fine on the K-1 route, I know this is pretty much just "peace of mind vs shorter wait", but I feel like making a big move on a comfortably mind set is quite important. I do fear I might grow to resent a longer wait, but so far we've been really strong in our LDR.
Is this crazy to consider? Has anyone had experience doing this?

4 RepliesWe have already been documentarily qualified and are currently waiting to be scheduled for the interview. I m wondering if changing jobs at this point would cause any issues.
The new job would actually pay more than my current position and more than the income I originally listed in my application. I ve tried looking this up online, but I m finding conflicting information.
Since we ve already waited so long to reach this stage, I don t want to risk doing anything that could complicate or delay the process.
Would it be acceptable for me to change jobs now and simply update the financial information? For example, by submitting a new I-864 form along with 3 6 recent pay stubs and a letter from my new employer confirming my title, start date, and salary, and then having my wife bring those documents to the interview.
Or would it be safer to wait until after her interview before changing jobs to avoid any potential issues?
I would really appreciate any guidance from anyone who has experienced something similar or have any insight to share!
