    PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this
    When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1."  The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!).  I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
     
    Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before....  I would kindly remind the officer "We married >2 years ago.  We can enter with an IR-1 visa now right?"

    Traveled to Canada for 20 days after entering the U.S. on a K-1 visa (June 1–22). Seeking reentry under Automatic Visa Revalidation (AVR).
    I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?

    Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…

    Seeking advice for Thai/US couple - What US visa path to take?
    My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time.     Good afternoon!

    My ex-husband and I filed the I-751 together in July 2023 and it's been pending ever since. Things didn't work out as our goals in life just changed too much, and we filed for divorce on good terms with no children in November 2024, which was finalized in April 2025.

    The day I received the divorce degree, I immediately sent a letter with an official copy of the degree to the USCIS to notify them that I would like to change my case to a divorce waiver. I spoke to them on the phone after my USPS tracking indicated that it'd been delivered, just to make sure, and they confirmed that they received the documents.

    My 5 year mark is coming up and I'll be able to apply early for N400 in July, meanwhile my I-751 is still pending and no action has been taken since receiving the original receipt + extension letter. I'm hoping for my I-751 to be pushed once I file for N400 like a lot of cases I've seen here, but my concern is that I haven't heard anything back from USCIS regarding my I-751 (no RFE either), and I don't want my I-751 to be potentially approved as a marriage-based case instead of a divorce waiver.

    Should I be safe since the USCIS themselves did confirm that they received my request to change to a divorce waiver by mail and is this just something that will be brought up in the interview, or is it safer for me to wait to file N400 until after my I-751 is approved so I can be sure it was approved on basis of divorce?

    I hope my question isn't too confusing!

    Hello,

    My father in law who is permanent resident petitioned my sister in law who is single and over 21 years old (F2B). If my father in law applied N-400 to become US Citizen (assuming he passed) then by law Does he need to report to USCIS to change my sister in law petition from F2B to F1? It seems F2B is faster than F1 and he had submitted F2B petition for a while now.

    Anyone from the bay area has received interview notice lately?

    Saw someone mentioned that the N400 processing seems on pause in No Cal for some reason, which somehow aligned with my feeling. I have not heard anyone from either SJ or SF getting an interview lately. Myself submitted the application last July and heard nothing back either.

    Wondering if anyone has received any interview notice these days.

    Born U.S. Citizen: Can Past Marriage Block New Spouse Petitions Under INA 204(c)?

    I am a U.S.-born citizen, and I previously filed an I-130 petition for my ex-spouse (a foreign national) several years ago. We divorced before the petition was fully processed, and I never received a final decision from USCIS I'm not sure if it was approved, denied, or if there was any finding of marriage fraud under INA 204(c). I didn't pursue it further after the divorce.
    Now, I am remarried to a new spouse (also a foreign national), and I want to file a new I-130 petition for them. My question is: Does INA 204(c) or any prior marriage issue automatically prohibit me, as the U.S. citizen petitioner, from filing and getting approval for petitions for future spouses? Specifically, since I don't know the outcome of the previous petition, could there be a hidden fraud bar that affects my ability to petition now? If there was no explicit fraud finding, can I proceed normally? I am confused that the internet has mixed responses where its saying that the previous alien would be banned and not the US citizen from filing petitions.

    Hello!

    We received RFE about my birth certificate which kinda confuses me, since i added it our i-485 application.

    RFE said: ''Submit an English translation with the applicant s foreign birth certificate issued by the appropriate civil authority. If the document is in a language other than English, you must submit a copy of the foreign language document and an English translation. For the foreign language document, we will only accept a long-form birth certificate which lists at least one parent''.

    I checked the requirments from uscis website and i did send english version of my long form birth certficate with stamp.

    So should i order my Finnish version of my birth certificate, since i didin't add that.

    Could that be the reason why we got RFE?

      Christina! We received our appointment notification email today! Our appointment was scheduled for April 9th 2026. We are very excited. We received the "you've got mail" ding while we were still in bed. I hope you received an email as well. If not, stay hopeful that it could arrive this week!

      Hello @RSJRGT: You made a post on the thread for appointments in Ciudad Juarez recently. I just noticed that many people with DQ dates in February and march are announcing online that they received appointment notifications in the past 2 days. I wanted to check if you have received any e-mails from NVC.
