PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

Case basics:

Principal and derivative cases now updating together

My nationality: Colombian (born in Venezuela)

Spouse s nationality: Venezuelan
Short timeline:

Dec 14, 2025: Interview placed under 221(g)

Feb 18, 2025: Requested 221(g) documents submitted

Throughout 2025: Several Case Last Updated changes, no status change

Dec 2 3, 2025: Passports submitted and processed

Dec 16, 23, 30, 2025: CEAC updated multiple times

Late Dec: CEAC stopped accepting NA/NA and now requires real passport data

Jan 7, 2026: Another CEAC update, still shows Refused
Questions:

Is this pattern (frequent updates + passports retained + still Refused ) typical before Issued in 221(g) cases?

For those who ve been through this, how long did it stay as Refused before changing to Issued ?

Based on real experience (not speculation), could recent Trump immigration policies affect a consular EB case already at this stage, considering our nationalities?

At this point, is it better to keep waiting or to email the consulate after a certain amount of time?

Long delayed consular interview (Guangzhou), several queries

1 RepliesAfter a delay of years, my in-law (who we are sponsoring) will finally have a green card consular interview in Guangzhou, China (somewhere between 2 weeks and 2 months from now). Since we filled out our information with the NVC years ago, both my spouse and I have gotten new, much better paying jobs. We are now way over the minimum income requirements to sponsor (we were over those requirements, but not by much, when we filled out the NVC material). My in-law's spouse is also now here on a green card and has employer benefits, including health insurance that would cover my interviewing in-law.
I seem to remember that a few years ago the consensus was that in such a situation (i.e. where we have had changes for the better in financial situation), the general consensus was to not try to update things in the NVC website (since this could cause a delay) but instead to write statement letters (with evidence such as W-2s, etc.) and have my interviewing in-law take copies of these with them to the interview. And then that the consular officer might ask us to update the system afterwards. Is this still the general consensus?
Any other tips/advice would be appreciated as well. My interviewing in-law is over 55 and so if there are new things that we should be thinking about in terms of health, insurance or even a letter of interest in hiring them from a prospective employer (my company's cafeteria has expressed interest in hiring them should they arrive with a green card), thoughts/advice would be appreciated. Thank you all!

1 RepliesHello, I booked my k-1 visa interview appointment last week, and noticed that I used a different Ds-160 number for scheduling my appointment and the one I sent to the consulate via mail. Is there gonna be any issues at all regarding them being different, both info on Ds-160 numbers are the same. Do I need to cancel and create a new application with the same ds-160 number( the one i sent to the consulate).
