To start, marijuana is illegal in my country of origin. When I was applying for my green card I admitted to trying marijuana when I was in my 20's (I'm 49 now). I got my green card and have lived in the US for 5 years. I'm in the process of applying for citizenship. What answer should I give to the question: "Have you EVER committed, agreed to commit, asked someone else to commit, helped commit, or tried to commit a crime or offense for which you were NOT arrested? Yes or No" given that I admitted to past marijuana use during the GC process?-

I'm 23F 🇨🇿, my partner is 29M 🇺🇲
We want to get our visa going sometime this year and want to be together as soon as possible but we are still unsure which visa would serve us better. I'd like to get married in my home country but on the other side i wouldn't mind getting married paperwise in the US and waiting for my work permit and etc if it would allow us to be together faster and then save up for and have our dream wedding in my home country.
What do you think ? All of this is so overwhelming and confusing and we just want to do the right thing.
I asked the same question on reddit, so many people recommended me to go with fiance visa, two suggested marriage visa. I need more input and advice from experienced people. Thank you

Supporting evidence for AOS following K1 marriage?
smilingstone posted a topic in Adjustment of Status (Green Card) from K1 and K3 Family Based Visas,
I entered the US on my K1 last week and we'll be planning to get married over the next few weeks. Throughout the whole K1 process I had in my head that we will need further supporting evidence of our relationship/marriage for the AOS process, such as co-mingling finances, opening joint accounts, health insurance, etc. However, now that I'm revisiting guidance on our next steps, there isn't any mention of this.
I am wondering if I misread something early on and it just stuck in my mind, and that we actually don't need to provide anything like this. VJs AOS guide doesn't make any mention of it, and nor does any other immigration-based sites. Is this something needed for the potential interview (from what I understand not all people get called for AOS interview)?
Can anyone confirm or clarify what we need? A run down of the docs you provided, when filing and/or for interview, would be really helpful.

Tourist visa denied.. worried this will impact future family visa

Hi, I’ve been thinking about this for a few days and feeling a bit worried. I wanted to have my husband visit me while we await our I-130 as I’ve heard some people have been approved while waiting. However he applied for a tourist visa in Jan 2024 and was denied as he said he was planning on visiting with his brother and had no family members here (true we were just snapping/texting).
We got married in July 2024 and he went in Sept 2024 at his 2nd attempt at a tourist visa - this time mentioning our marriage. The embassy worker didn’t give him a chance to speak and just said he’s “lying” because he mentioned last time he didnt have any family members in US (which he didnt). I’m worried this was written down as fraud and he will never get any visa. I’m not sure what the embassy would have written down for his denial?-

Wife was denied entry into her interview due to Copy vs Original Doc

My wife was denied entry into her interview on Dec 20th 2024 because she had a copy of my divorce papers and not the original. Our lawyer tried to argue that the original was not required. But the embassy sent us a link that clearly showed the rule has been in place since 2022. Her new interview date is now Jan 23, 2025- 17 replies

I m not sure how many of us are in the same boat but I ve been waiting for an interview to be scheduled for N-400 since 5 June 2024. The adjudicating office is West Palm Beach and I have a pending I-751 with a marriage based two year green card. I note that the average processing time is 8 months and I believe that only in April I can send a case inquiry.
I was wondering if there is any point in calling the live USCIS agent or to just sit tight and wait. It s so frustrating because it seems that there are lots of people getting quicker interviews.
Any advice or words of encouragement would be greatly appreciated!

My question is: why did they only scan a few random documents I sent from my packet and why is it under my uploads when I never uploaded anything?

4 RepliesMy fiance made it to USA from the Philippines. We got her SS card then we got married. She would like to change her name. I understand we would have to go back to the social security office. How does this work when her main ID is her Philippines passport with her old name? If she wants to fly somewhere, she has to book in her old name? We want to get a bank account setup, is it easier before or after the name change? Basically, we don't know how the name change works.
Is there anything we will need to do differently on the AOS paperwork?

4 RepliesFor my fiance and I to be eligible for the CR1/IR1 ... are there any pitfalls to avoid marrying outside the US?
I think I'd prefer to marry here because my children are here. However I'm worried that my fiance won't be allowed here on a travel visa right away because we were, up until now, following the K1 path. We haven't completely discarded the K1 path... as we're very much in the middle of it... but due to our recent epiphany regarding the requirements of financial proof and income, we're definitely weighing all of our options now.
Our situation is, up until now we have been invested in the K1 process. My fiance has his interview next Thursday. I didn't 'do my homework' and properly understand the requirements for the I-865 and the AOS process because we went step-by-step and only looked at the current process to get him here and get married. For that (the 100%) I meet the requirement.
Now we are considering if this is the best option for us or not. Do we go forward with the K1 process and ask a family member to joint-sponsor?
Or do we wait until I finish nursing school and make more money and then apply for either K1 OR
Do we get married now and then applly for the CR1?
Another factor and possibly one of the main factors for going forward in any form now (and before the finances are a moot point thanks to my projected nursing salary) is that his daughter will be 19 in April and likely 'age out' before then. Of course we want her to come as well. Of course the other factor is we are really tired of the back and forth and want to be under one roof asap!
If he's working, we'll be able to cover the difference of the 125%. As I understand it, with the CR1/IR1, he'd be able to come and work right away? And even we could apply for him and his daughter to come while waiting for the CR1 and he could work and she could work/go to school?
That's what I'm reading here: https://www.uscis.gov/family/bring-spouse-to-live-in-US and I just wanted to understand if I'm seeing that correctly. I don't have to meet the 125% alone with this? He can work and his salary can be included?
Or would I still need a joint-sponsor to qualify for the CR1 but could he at least come while we wait for approval and the financial burden would be offset because he can come work immediately?
So the main question I have is... will he be able to COME to visit me if we stop the K1 process and marry me here? Or will immigration consider we are trying to cheat somehow? (Even if we've been together over 8 years now with a well documented relationship and getting married was always the plan.)
If it's the case... what else can we do? Will marriage in another country count against us in any way?

5 RepliesI applied for a K1 VISA for my fianc e in October of 2024.
My fianc e lives in Portugal, but is a Peruvian citizen and came to Portugal under a tourist visa with only a passport more than two years ago. She began to live and work there, and continues to do so. (At the time of her arrival, Portugal allowed immigrants to do so without a VISA. Since that time, laws have changed and immigrants now have to have a VISA to move there and work legally).
My fianc e applied for a residency status in Portugal almost two years ago, but has yet to receive any action on her Portuguese residency. Because she has an expired tourist VISA, she currently cannot travel in the European Union until her residency is resolved in Portugal.
In our I-129F application, we put Lisbon, Portugal as the embassy that would process the case. However, when I was researching online, I saw that the U.S. Embassy in Portugal now conducts immigration interviews in Paris, France. I also wonder if they will decide to change the embassy location to Lima, Peru because she still doesn't have a residency in Portugal.
Any insights into what we should expect or advice in regard to actions we should take would be greatly appreciated.
