Fiance or Marriage Visa in 2025 ? Pros and cons?
    I'm 23F 🇨🇿, my partner is 29M 🇺🇲
We want to get our visa going sometime this year and want to be together as soon as possible but we are still unsure which visa would serve us better. I'd like to get married in my home country but on the other side i wouldn't mind getting married paperwise in the US and waiting for my work permit and etc if it would allow us to be together faster and then save up for and have our dream wedding in my home country.

What do you think ? All of this is so overwhelming and confusing and we just want to do the right thing.

I asked the same question on reddit, so many people recommended me to go with fiance visa, two suggested marriage visa. I need more input and advice  from experienced people. Thank you
Ps: is it possible to have dual citizenship so i don't lose one from my home country? How does that work ?

Supporting evidence for AOS following K1 marriage?
I entered the US on my K1 last week and we'll be planning to get married over the next few weeks. Throughout the whole K1 process I had in my head that we will need further supporting evidence of our relationship/marriage for the AOS process, such as co-mingling finances, opening joint accounts, health insurance, etc. However, now that I'm revisiting guidance on our next steps, there isn't any mention of this.

I am wondering if I misread something early on and it just stuck in my mind, and that we actually don't need to provide anything like this. VJs AOS guide doesn't make any mention of it, and nor does any other immigration-based sites. Is this something needed for the potential interview (from what I understand not all people get called for AOS interview)?

Can anyone confirm or clarify what we need? A run down of the docs you provided, when filing and/or for interview, would be really helpful.

    Thank you

Tourist visa denied.. worried this will impact future family visa
Hi, I’ve been thinking about this for a few days and feeling a bit worried. I wanted to have my husband visit me while we await our I-130 as I’ve heard some people have been approved while waiting. However he applied for a tourist visa in Jan 2024 and was denied as he said he was planning on visiting with his brother and had no family members here (true we were just snapping/texting).

We got married in July 2024 and he went in Sept 2024 at his 2nd attempt at a tourist visa - this time mentioning our marriage. The embassy worker didn’t give him a chance to speak and just said he’s “lying” because he mentioned last time he didnt have any family members in US (which he didnt). I’m worried this was written down as fraud and he will never get any visa. I’m not sure what the embassy would have written down for his denial?

Wife was denied entry into her interview due to Copy vs Original Doc
My wife was denied entry into her interview on Dec 20th 2024 because she had a copy of my divorce papers and not the original.  Our lawyer tried to argue that the original was not required.  But the embassy sent us a link that clearly showed the rule has been in place since 2022.  Her new interview date is now Jan 23, 2025

Can I Travel to the USA with a Pending I-130 Petition?
I have been invited to speak at a conference in the USA. My partner, who is a U.S. citizen, has filed an I-130 petition for me as we plan to move there eventually. I also have a job offer, and the employer is in the process of sponsoring an O-1 visa for me.

    1. Can I apply for an ESTA to attend the conference, and am I likely to be admitted?
    2. Will traveling to the USA on an ESTA impact my I-130 petition or future O-1 visa application?

    Thank you!

DV Lottery of K1 Visa - Can I file for both?
I applied for the DV lottery 2025 and hope to be selected this year. My fiancé and I discovered that there is a fiancé visa for the USA. Do you think if we apply for the K1 visa but are selected for the DV lottery that we can stop the fiancé visa process? What are the timelines and options here :)?

    Hello,

I am currently living abroad in Jeddah with my non-US spouse. Due to restructuring, I am being made redundant and my contract will finish in 3 months, at which time we will need to leave the country. Would we be elegible for DCF of form I-130 with the embassy in Riyadh? Has anyone done so from KSA before? I emailed the embassy, but got no response so far.

    Thanks in advance.

I've been waiting a total of 85 days through contacting USCIS and NVC with enquiry and I contacted a week ago the congressman but I don't have any news yet. Even though the i797 was sent to NVC, in the portal of uscis says still only approved. NVC didn't receive the case yet. They congressman've made a inquiry and we are waiting. My i130 petition was sent through mail, maybe is causing a delay. Before the 90 days came, I want have some informations for what to do next.

Taking a domestic flight Boston - Hawaii while Adjusting Status from ESTA OK in current political climate?

Basically the title, just seeking more opinions.

I (M32) came on an ESTA in Nov and circumstances changed, ended up marrying my boyfriend a few weeks ago. We just filed everything last week, before my 90 days expires on Feb 7th.

We're working with an immigration lawyer. We booked a honeymoon to go to Hawaii at the start of March. Lawyer thinks it should be OK, but as I may not have a receipt from USCIS for filing before we travel just in case lawyer has given me a letter I can use in an emergency saying I have a pending I-485 & I-130 so am not subject to expedited removal/being detained, but it does just make me nervous!!

I'm basically just looking for some peace of mind or more feedback from anyone who has travelled domestically while adjusting status. Should i be OK to take a direct flight Boston -> Hawaii next month while adjusting my status from an ESTA to a green card?

Green 221g London, UK Parent interview
    12:40 pm today

Parents received a GREEN 221g. Officer asked for my W2 (but did not specify what year) for my dads case - which was already uploaded at the NVC stage - but I uploaded again today when mum told me. Weird that its also requested for dad's case and not mums too.

The only box that is checked on the 221g is for me to DX courier my british birth certificate.

They did not keep their passports.

If I courier my BC via DX, do I need for them to acknowledge and expect and ask for their passports to be couriered?

Just thinking of what might happen if or when its suffice for them that they received what they asked for....

Would there be harm in sending the passports together with the BC?

I got the Courier-In Authorization Certificate generated from https://ais.usvisa-info.com/en-gb/iv/users/sign_in

But not sure what to do with it?

Says "This certificate authorizes tadeo, nenita to use the designated CSRA courier to deliver supporting visa application documents to the United States London Consulate free of charge"

I also emailed DX for a quote on pickup and delivery and return service - is this the correct procedure on using the DX certifcate and for DX to pickup from mums house?

Even though I uploaded my W2, I will send to mum with my british BC to then DX courier to the consulate - or should I not do this?

*URGENT HELP NEEDED* FedEx Providing Conflicting Advice on CBP Form 3299 for Household Goods Shipment
    11:57 am today

    Elavod

    Hi everyone,

I m a U.S. citizen relocating back to the U.S. after living abroad for 17 years. I m shipping my household goods, personal effects, and tools of trade to the U.S. and seeking duty-free entry under HTSUSA codes 9804.00.05, 9804.00.15, and 9804.00.20.

I ve completed CBP Form 3299, and I m working with FedEx to clear my shipment through U.S. Customs. However, I m getting conflicting information from a FedEx representative, and I m hoping someone here can clarify.

    Issues I m Facing:

    1. Residency Status Emigration vs. Returning Resident

    - The CBP website states that U.S. citizens who have been abroad for 3+ years qualify as non-residents (CBP guidance: https://www.help.cbp.gov/s/article/Article-1329?language=en\_US).

    - Since I have lived abroad for 17 years, I selected Emigration on the form.

    - FedEx is saying I should select Returning Resident because I have an SSN, but my understanding is that customs residency is based on time spent abroad, not SSN ownership.

    2. Marking Multiple Boxes in Section 10 (Statements of Eligibility for Free Entry of Articles)

    - The CBP Form 3299 instructions clearly state: X all that apply.

    - The CBP website (source: https://www.help.cbp.gov/s/article/Article-1329?language=en\_US) also confirms:

Statement of Eligibility for Free Entry of Articles: Mark statements that apply to the articles being imported note that more than one statement may be marked.

    - Since I am importing household goods (HTSUSA 9804.00.05) and tools of trade (HTSUSA 9804.00.15), I believe that I should mark both categories on the form.

    - FedEx is saying that only one box can be checked and that checking multiple boxes will cause a rejection.

    My Questions:

    - Has anyone successfully checked multiple boxes in Section 10 of CBP Form 3299 when shipping with FedEx?

    - Has anyone had issues with CBP rejecting shipments based on selecting Emigration instead of Returning Resident ?

    - Does FedEx have an internal policy that differs from CBP s official guidance?

    - If FedEx continues to insist on their interpretation, what is my best option?

I d really appreciate any insights from anyone who has dealt with this process before. Thanks in advance!

      How long this will take???

I had my interview at the US Montreal Consulate on the 15th of December 2022n.   At the interview, I was told that I didn’t have a current visa available for my category since I had outgrown it from child of a permanent resident to adult child of a permanent residence and I was told that another option for me was that I must have "sought to acquire lawful permanent resident status within 1 year of a visa becoming available to Me." According to the Consular officer I was then told the only option was to wait till a visa is available for that category and gave me a paper. I checked the visa availability on the visa bulletin it’s just on January 2017 and my priority date is 09/feburary/2017    I tried tracking my visa application and and I noticed it wrote expired when initially it used to refused and that it was undergoing administrative processing and now when I check it says “ you have been notified your immigrant visa has been cancelled, and any petition approved on your behalf was also cancelled. We informed you that your application might be reinstated within one year if you could establish that your failure to pursue your immigrant visa application was due to circumstances beyond your control” I was never informed of this I didn’t even get an email. “    “Since you have failed to do so, the record of your registration and any petition approved on your behalf and all supporting documents have been destroyed.  Any Department of labour certification has been returned to your prospective employer.

I literally logged into my CEAC.state.iv and it showed that my case was still at the US consulate in Montreal with all of my documents that was initially submitted.

does that means it’s truly expired or what do I do in this situation

Permission to post admin. Thank you.
We are still waiting for a case number but I want to make sure I am prepared and knowledgeable about the forms 😊
I have a question about the tax information for the past 3 years, since my fiance is young he has had part time jobs before and didn't last. In 2022 is when he's got a full time, quit it and did 3 other part time jobs. Until 2023 when he worked on his current job, now fulltime. He earns a minimum of $16 per hour. Works 8 hours or more in a day with 2 days off.
He's an office admin there and it's a fulltime, papers are good too. I just want to know if this is sufficient? Or do we need a co-sponsor? We're both single and no kids, so it's only the two of us. But he only plans to get an apartment when Im there, since he's the only child helping his mom with the rent.
Will there not be any issues with his tax for the past 3 years too considering his previous work both part time and fulltime.
      Thanks very much!
