I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

My 48 months I751 extension letter is set to expire by the end of next month. I filed for my I751 via divorce waiver in Jun 2023. My questions are:
1) What should I do now to maintain my legal status?
2) Should I be receiving an update for my case soon?

1 RepliesMy fianc e went to her Interview Appointment at the Manila Embassy on 7/15. At the first stage, her documents were checked and two mistakes found.
1. Incorrect father's middle initial on CENOMAR & damaged birth certificate.
2. She was given a yellow slip with a checklist, instructed to acquire the updated documents, and reschedule the appointment.
Two questions:
Once she gets the updated documents:
1) Does she need to do VAC/Biometrics again first, and the Counselor Appointment second? Or straight to Counselor Appointment? The usvisascheduling website has not populated the appointment schedule, yet, when it does, maybe that will answer my question.
2) The yellow checklist has two QR codes, "Scanning and Uploading Instructions" and "Rescheduling and Register Delivery Address". We have never used the CEAC system to upload any docs. Our email from NVC in response to Inquiry Request back in May stated document submission was not required for this type of case. Since it was not required in the past, it is probably still not required, correct? She just needs to bring the physical documents?

The Intending immigrant and the petitioner filled taxes as MFJ. Total income on line 9 of the 1040 was $33k which is above the income required for a 2 household size. The $33K consists of $25k from the intending immigrant and $8K from the petitioner. Per the I-864 A instructions, no I-864A is necessary if the intending immigrant does not have any accompanying dependents. I wanted to confirm this is correct and the only form that needs to be completed is the i-864 and no joint sponsor is necessary. Thank you!

10 RepliesPlease help with what to do when the medical expires because the visa is still processing to be delivered. The interview was approved on 7/1/25. No visa yet 14 days later. Medical expires 7/22. What do we do after the medical expires. Are there visa application expenses along with updating medical. What do we need and steps to follow. Your information will be greatly appreciated. Thanks.

18 RepliesMy divorce is currently in progress, as well as my I-751 petition, which I filed jointly with my husband in January 2024. In March of this year, we began divorce proceedings.
Last month, I sent a letter to USCIS to formally request a waiver of the joint filing requirement and to inform them that I would submit the final divorce decree once it becomes available.
However, this weekend I received an acknowledgment letter from USCIS stating that I had requested to withdraw my petition, which is completely false I never made such a request.
Today, I consulted with two different immigration attorneys, but they each gave me conflicting advice, which has left me unsure about the best next steps.
One advised me to refile I-751.
The other one told me that my case was closed already and my next step is to go to court since the letter stated the following:
Therefore, in accordance with INA 216, your CPR status is hereby terminated. There is no appeal to the decision. However, you will have the opportunity to seek review of this decision in removal proceedings before an immigration judge. See INA 216(c)(2)(B); and 8 CFR 216.4(a)(6).
I would like to know if anyone here has any advice to offer or has experienced a similar situation.
