When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

2 RepliesHi, My i-751 was reopened after it was denied and is now currently pending. I initially filed under abuse and battery in 2021 and in 2024 it was denied without an interview. The denial letter said I failed to submit mental health evaluation and i am not qualified for abuse wavier. I later submitted mental health evaluation with I-290B and also requested them to consider my i751 under divorce category. Although the I751 that was reopened after my Motion to reopen/reconsider, it remains pending as of today and while My lawyer also applied for another i751 which is also pending so currently I have 2 751s with USCIS. I have consulted with numerous immigration attorneys and paid them for their consult just to get myself confused. Some are saying you should go for N400 it will help expedite you r 751 and some are saying you should wait until your 751 is adjudicated cause it will create a mess and while getting hodgepodge responses from lawyers about my N400 I am in immediate need of travel. My I551 stamp is expiring on 29th of this month and I am scheduled to go to USCIS field office on Monday to get the new stamp. With all due respect i am trying to get help on these questions. Please advice!
1. Should I travel with I551 stamp while I have 2 i751s pending? Will it cause any issues while coming back?
2. Should I apply for N400 or wait?

RFE: Joint Sponsor Taxes

1 RepliesHi all, I'm trying not to panic; I received an RFE on my Form I-485 regarding my joint sponsor.
The RFE stated they couldn't determine whether the joint sponsor is qualified.
They requested:
- 2024 tax returns
- All supporting files for 2024 tax returns
- Assets (can't use)
He didn't meet the 2024 Poverty Guidelines, but did in 2023 and 2022. In 2025, he exceeded the poverty guidelines by around $3000 we dont have tax returns from 2025 yet. But as a response to the RFE I'm planning to submit the last 6 months of his pay stubs (YTD), employment letter, and January 2026 pay stubs (YTD) as well, along with a cover letter explaining the situation about his employment.
Is this a good approach for this type of RFE?
Or should I wait for my sponsor to file his 2025Taxes?

I have applied to remove conditions and got the 48 months green card extension. I think 2 years have passed. Pending app.
#1 My home's country passport has expired, does this affect in anyway my application when I get called for interview? Should I renew in prior? (Not easy).
#2 I'm married 3 years from k1 visa. For naturalization should wait 3 or 5 years? I can't clearly understand. Greencard Received: 2023-01-23
#2b if is 3 years is better to apply or just wait the lift of conditions?

Need advise on Potential H1B issue while AOS

1 RepliesI have been in the US on H1B for over 10 years. In 2023, I had a change of location with the same employer. While the payroll reflected the change end of Nov'23 and I made the move to the new city around this time while submitting the AR-11 (and making USPS change), the immigration team at my employers' were informed late and the H1B amendment for change of location was finally approved end of Dec'23. There is a 1 month gap between my move to the new city and the H1B amendment's start validity. Since Dec'23 the status has remained compliant with no issues associated with a renewal and a transfer. I realized the one month discrepancy as I was preparing my application for AOS I-485 where I have to provide specific dates associated with my last and current residence, where my current residence shows Nov'23 as last date in my previous location but my job history shows dec'23 as last date in my previous location based on I-797 records.
Any advises or thoughts on how to tackle this situation and its impact on AOS as well as future H1B petitions/ current H1B status if flagged during AOS.
