PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Abandoned AOS and now regret it

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

5 RepliesMy spouse is a Kenyan citizen who has migrated to the states on a K-1 visa. We were married shortly after he arrived and are now working on filing his I-485. I just want to make sure that were are not overlooking an A#, but we can't find it anywhere including on the Visa nor Customs & Boarder Patrol passport stamp where he was Admitted at the port of entry. He was not given any documents when he entered. Are we missing something?

4 RepliesMy girl friend is applying again for a tourist visa in Colombia, our plan is that I'm going there to get plastic surgery and she's travelling to US with me to stay for a week.
Do you recommend that she adds me as her travel companion on the DS-160 and saying that's the purpose of her travel? Helping me on the trip and visiting for a week?
She was denied a couple months ago under section 214(B). She said she was staying with me but we didn't add that we were travelling together or my surgery, do you think this would help her case or could it look bad that she's not only staying a here but travelling with me?
I might travel with my kids (6 and 8yo), would it be a stronger case to say she's helping me because I had surgery and travelling with the kids? In that case, should I add them as travelling companions as well?

1 RepliesHi, I am filing N600 for my child under derived citizenship and will appreciate any advise or inputs who have filed N600. Appreciate any help or suggestions.
1. For the Port of Entry and Date section, should I list the child s very first entry into the United States or the entry prior to filing for lawful permanent residency, or the most recent entry as a lawful permanent resident?
2. Does the current online form provide an option to upload evidence of physical and legal presence? I came across forum discussions suggesting that there was no evidence section available while filing online specifically to upload physical and legal presence, and would like to know how recent applicants have handled uploading this information.
3. USCIS field office that granted LPR: Is it the office where the interview happened?

1 RepliesGreetings All, I do need your advices , I will apply for N400 by July with the following :
1- I have my Green Card through my US parent.
2- I prevouisly had a denied aslym case and got deported in 2010 , Then my mother petition to me I-130 Got approved, later on, I had to applay for 212 and 601 waiver ( for Unlawfel stay) both waivers got approved and I got my Immigrant Visa Issued and Im back to the US in 2021.
3- I maintain good Moral Character , and I never been outisde the US since i become green card holder. I have my attoerny with me in n400 filing.
My question here should I applay, Im afraid with all what I went through and the current fear with all immigration changes. your advice is apperchiated

2 RepliesHi wanted to know passport got expired and i94 also expires due to passport expiration. Now i renewed it and went back to orgin country and came back. in Total 40 days i was in expired i94. so for Citizenship naturalization will it be issue??
