    DV Lottery of K1 Visa - Can I file for both?
    I applied for the DV lottery 2025 and hope to be selected this year. My fiancé and I discovered that there is a fiancé visa for the USA. Do you think if we apply for the K1 visa but are selected for the DV lottery that we can stop the fiancé visa process? What are the timelines and options here :)?

    Confused about steps after marriage
    My fiancee arrived last month on K1 fiance visa and we got married yesterday. It seems from what I have seen online that I made a mistake by not getting SSN prior to marriage? I am going to the SSN office on Monday to gather more information... also worried about employment authorization and travel authorization(s). Thanks for any insights!

    Tourist visa cancelled by CBP agent.  Can we still get a CR1 or K1 Visa?
    Upon my gf's most recent arrival, her tourist visa was cancelled at the airport due to her frequent visits last year and suspicion of working here. She was denied entry and sent back same day. Is a CR1 or K1 visa process an option still? I would appreciate any advice or tips you can provide!

    Hello. VJ is showing my approval is now past due.

    I had two missed calls on October 5th from Private Number. They were blocked and I didn't notice them. I was expecting that if/when they did call it would come from a 202 area code number.

    My case still shows 4 months estimate in the portal. I have heard they will put minimal effort into contacting you and then just close the case out due to being unreachable. I tried calling in but it won't send me to an agent, and the portal says I can't send a message to check on case status.

    Was this USCIS trying to get in touch? Will they send correspondence through the portal or mail before closing the petition out? Is there anything I can / should do proactively?

    I-130 51a, Beneficiary's Employment Information for PhD on Stipend and F-1 Visa

    My beneficiary and spouse who is currently in a PhD program with a stipend (which means filling in W-2 forms every year). Are they considered "unemployed" because they are technically a student, or do need to count their university as an employer due to the stipend?

    My dad lives in the U.S. and recently became a citizen. I've visited him every year on a tourist visa since I was young. However, during my last visit, I stayed nearly six months because my return flights were canceled twice due to COVID outbreak. The year before that, I stayed around 3-4 months. Because of this, my tourist visa application was denied two years ago, likely due to concerns I overstayed or may have worked during my stay.

    Now, it's been two years since my visa denial, and I'm considering my next steps:

    - Apply for a tourist visa again to visit my dad.

    OR - Apply for a J1 internship as I'm finishing my master's degree. I would genuinely attend the internship and use that opportunity to be in the U.S. An alternative option would be to apply for an F1 visa to study for a second masters degree - however I'm leaning more towards J1 because I think it makes more sense and would be easier to get approved.

    OR - Have him file the I-130, but then I likely won't be able to visit him while waiting. And from my research I read that the wait could be 10 years. Ideally, I'd like to be able to visit my dad during that time, but if that's not possible, my hope is to start the immigration process while in the U.S., so I can be with him in the meantime.

    Which option would be easier for obtaining a visa, and could potentially lead to an adjustment of status if I'm in the U.S.?

    To give some more context: I'm 26, male, own an apartment that I rent out, and am currently a master s student, currently freelancing so no really permanent job.

    When I was denied last time, the officer asked why my dad hadn't petitioned for me, and I said it was because I only intended to visit, not live there at that time.

    Any advice is appreciated!

      Days just ticking away and no action. 216 days since they received the application and still under review. We completed the inquiry and we were told to wait until the Milwaukee office has opening for interview.
       
      I am starting to doubt if we would get interview before Christmas.

      Hi there! I came across your review post and was wondering if you could help me out as I'm in a similar situation as you were. My sponsor is a USC who just started grad school this fall but was working full time before that. Sponsor is on a full scholarship and monthly stipend. Also has a new address. 
       
      We have already been DQ(before grad school) and waiting for IL. The stipend is still above the poverty guidelines limit but we're wondering if the grad school situation will be an issue during the interview process? What about the address? Do we need a joint sponsor at this stage?

      February 8, 2023: We went in for the N-400 interview but were told on the spot that the i-751 Interview would also be done, which threw us off. It was our fault for not doing more research and bringing a hard copy of what we sent. Thankfully, we were approved for the i-751 removal of conditions. However, the N-400 was canceled pending rescheduling.
      July 18, 2024: Received notice: "We are actively reviewing your Form N-400, Application for Naturalization. Our records show nothing outstanding at this time."
      August 26, 2024: Received notice: "We scheduled an interview for your Form N-400, Application for Naturalization. (September 30, 2024 Irving)"
      September 30, 2024:
      8 am: Complete interview
      9:30 am received notice: "We recommended that your Form N-400, Application for Naturalization, be approved. Your case was submitted for quality review."
      12 pm: Receive notice: "Your Form N-400, Application for Naturalization, was placed in line for oath ceremony scheduling."
      1:30 pm receive notice: "Oath Ceremony Notice Was Mailed (October 19, October 2, 12 pm Irving, TX)."
      We got there at about 7:45 am. They only let her in, and I stayed in the car.
      According to her, she went through security and had to wait 10-15 min for them to call her. The officer interviewing was pleasant and spoke good english. She starts with an oath where she stands, raises her right hand, and swears to tell the truth. No small talk at all. The first thing was to read and confirm her full name. Then the officer asked my wife to read out loud one sentence. Then the officer said, "California has the most people," and my wife had to write it on a tablet.
      Civics Test:
      -Name of national anthem
      -Where is the Statue of Liberty?
      -Who makes laws
      -Who signs bills to become laws?
      -I forgot the last one.
      From there, it was an N-400 walkthrough. The first minor hiccup was how long we've lived at our current address. We have lived in the same building address for 4+ years but moved apartments, so technically, our current apartment has been there for only two years, but the building has had the same address for 4. My wife had to point that out to the officer.

      Things got really tense once it came to how long she'd been out of the country. The officer said, "You've been out of the country longer than you're supposed to, which is more than six months in a year."
      My wife had only been out of the country 2-3 weeks a year for the past five years, so this was very confusing. The officer showed my wife the screen, and it showed a bunch of dates that we did not submit on our N-400 or I-751. As it turns out, the system added the 1+ year she needed to wait outside of the country for her CR-1 to be approved and lawfully enter the US. We are really grateful the officer showed the screen and a willingness to listen because it allowed my wife to walk through with the officer that it's counting time before she was a lawful resident and we lived in Colombia right after getting married because our understanding was to change her Visa from visitor to spousal, we HAD to leave the USA until the CR1 was approved, a new visa was added to her passport and mailed back to her. 
      The officer said that made sense and let my wife know that if she hadn't clarified that, she would have denied her and was actually wondering why my wife came to the interview if we knew she was going to be denied based on being out of the country for so long. 
      After that tense back-and-forth, the officer made all the updates in the system and said my wife was recommended for approval.

      We were shaken at the fact an error happened that was no fault of our own, and that error was pointing us to being denied. But we are SUPER grateful the officer was willing to let us explain our side and not just try to push us through to get to the next person. Overall, it was like a 45-minute interview, and the happiness kicked in with them being so quick to schedule our oath ceremony (October 19).
