Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

To start, marijuana is illegal in my country of origin. When I was applying for my green card I admitted to trying marijuana when I was in my 20's (I'm 49 now). I got my green card and have lived in the US for 5 years. I'm in the process of applying for citizenship. What answer should I give to the question: "Have you EVER committed, agreed to commit, asked someone else to commit, helped commit, or tried to commit a crime or offense for which you were NOT arrested? Yes or No" given that I admitted to past marijuana use during the GC process?-

I'm 23F 🇨🇿, my partner is 29M 🇺🇲
We want to get our visa going sometime this year and want to be together as soon as possible but we are still unsure which visa would serve us better. I'd like to get married in my home country but on the other side i wouldn't mind getting married paperwise in the US and waiting for my work permit and etc if it would allow us to be together faster and then save up for and have our dream wedding in my home country.
What do you think ? All of this is so overwhelming and confusing and we just want to do the right thing.
I asked the same question on reddit, so many people recommended me to go with fiance visa, two suggested marriage visa. I need more input and advice from experienced people. Thank you

1 RepliesHello, me and my partner (USC) are filling out all the forms for me to change from an F1 to a GC, but there is some confusion. I have been out of status for a while now without leaving the country, but there is some confusion regarding the I-485 form.
- For question 13 under part 9, Have you ever violated the terms or conditions of your nonimmigrant status?
I put down Yes here since I overstayed.
However,
- For question 76 under part 9, Since April 1, 1997, have you been unlawfully present in the US? You were unlawfully present in the US if you were present in the US after the expiration of the period of stay authorized by the DHS Sec or were present in the US without being admitted or paroled.
What exactly do I answer here? My I-94 states Duration of Status (D/S) and I entered the country legally. Haven t found a clear answer anywhere online regarding this question. Would it be No since I have D/S on my I-94 and the Fed hasn t found me in violation of my status?

2 RepliesMy fiance is working from and applying for a K1 visa in Freetown, Sierra Leone (but he is from a nearby West African country). The application is at the last stage--the Embassy has received it, and he just needs to schedule his interview. My fiance had been able to schedule his B2 visa interview through the same consulate last year without a problem, just that it was about 4 months from when we scheduled it. So we were expecting that the appointment we found might be a few months out, and we would have to wait. What we didn't see coming was to get to the appointment page and see a message that "Currently, there are no appointments available for the selected location."
We submitted the DS-160 on April 8 immediately after learning the case had been forwarded, and have been checking the appointments page several times daily since then. I was able to contact the consulate and was advised that they usually post new appointments at the beginning of the month, so since April 30 we have been checking the page much more frequently, several times every hour. At one point since then, I did notice that the AVITS website displayed the message "This application is currently undergoing updates and is temporarily unavailable. Please check back later." It did this several times. There was also a period where the appointment page was loading too slowly for me to access it, and I tried logging out and back in. I wondered if this might be when appointments were being added, but when I was able to access the page again, it displayed the same "no appointments available" message. It's hard to believe that maintenance message and lapse in loading (which happened early on the morning of April 30, Freetown time) was due to new appointments coming online and getting booked so fast.
I'm aware that this problem is not new, and that many people have had to try at it a lot longer than us before they found an appointment, so we understand these things take time. But like with the DS-160, it is just challenging enough that we are starting to ask ourselves, "Are we doing this right, or are we missing something?" Any thoughts or tips welcome!

I wanted to ask a question that s a bit complicated. for starters, I ve obtained my GC through SIJS. Not sure that it s relevant here.
I ve had a name change a few years back. It s now time for me to apply for N-400. I ve lost my PR card for about two years now. Will it be needed during the naturalization process?
the complicated problem is that
my name on my actual birth certificate is quite long. When changing my name, I really just removed one and changed the last name.( nothing marriage related) I was able to get a new SS card and a new drivers license. The folks at the drivers license said they would not shorted the name to just a MI that it has to reflect everything on the name change document.
I don t know how my previous attorney was able to shorted all the names from Birth Certificate to just First MI and Last Name on GC. Which I used to get my DL at the time. Maybe it s the USCIS character requirement? I want to be able to do the same after naturalization and essentially have it reflect on the new drivers license.

name on Birth Certificate:
Greta Nicole Mary Anita Johnson
Shorted on GC to get drivers license: Greta M. Johnson
Social Security: Greta M. Johnson
Current new name: removed Greta ( drivers license has entire name) Anita Mary Nicole JonesSocial Security: Anita M. Jones
Will it be possible to keep it short when applying for N-400? Like Anita Mary Jones? Or will this be an issue?
I just became aware of the ADIT stamp as proof of green card. Old country passport has expired and I m also not sure if they ll require naturalization certificate to actually reflect name change.

My wife's green card will expire soon. We're filling out Form I-90 to renew. Besides her passport, a copy of her current green card, birth certificate, proof of residence, etc... what supporting evidence do we need?

4 RepliesHi, my husband and I have lived in his home country in Latin America for over a decade. We have a house, two kids in school, and are well established here. He has had multiple tourist visas and we've visited my family several times over the years. His current visa was issued for ten years and expires late 2026. We'd like to visit my family in June for a few weeks during the kids' summer vacation. However, he recently quit his job and is still looking for other opportunities. I didn't think it would be an issue, but a friend who works as an immigration paralegal told me he shouldn't try to visit without being employed, under the current administration, because they will think we want to stay and deny his entry. I feel like as a family we have good strong ties to his home country and a history of making this sort of trip, but wanted to ask if anyone has had similar experiences under the Trump admin?
