    DV Lottery of K1 Visa - Can I file for both?
    I applied for the DV lottery 2025 and hope to be selected this year. My fiancé and I discovered that there is a fiancé visa for the USA. Do you think if we apply for the K1 visa but are selected for the DV lottery that we can stop the fiancé visa process? What are the timelines and options here :)?

    Confused about steps after marriage
    My fiancee arrived last month on K1 fiance visa and we got married yesterday. It seems from what I have seen online that I made a mistake by not getting SSN prior to marriage? I am going to the SSN office on Monday to gather more information... also worried about employment authorization and travel authorization(s). Thanks for any insights!

    Tourist visa cancelled by CBP agent.  Can we still get a CR1 or K1 Visa?
    Upon my gf's most recent arrival, her tourist visa was cancelled at the airport due to her frequent visits last year and suspicion of working here. She was denied entry and sent back same day. Is a CR1 or K1 visa process an option still? I would appreciate any advice or tips you can provide!

    This situation is about a change in circumstances, not using a B2 visa with the intent to immigrate. The situation is:

    Father: Permanent resident
    Mother: Previously a permanent resident, abandoned green card to live overseas for a few years, now here on a B1/B2 visa with her duration of stay expiring in December
    Me: US citizen

    In June, my mother traveled to the US on a B1/B2 visa and in that time, my father was diagnosed with severe health problems, so she has decided to apply for a green card again to live here with him. However, her duration of stay is up in December, and it's not safe to leave him alone, so she wants to stay here and not have to fly back.

    My understanding is that since I'm a US citizen, if I petition for her/do concurrent filling so that the I-485 is in progress ASAP, the overstay will be forgiven, but I really don't want the legal obligation that comes with being a sponsor for personal reasons. I'd rather that my father be the petitioner/sponsor. If my father is the petitioner/sponsor, is her overstay still forgiven? Or is there anything else that can/should be done that can keep my mother here safely?

    Also, when submitting the forms, should we submit a statement/proof that she intended to return originally? Or is that something that will be explained later (like in the interview)?

    Canadian with American Citizenship wanting to move back to Canada with American Husband

    Hi,

    My husband and I have been living happily in the USA for many years and I have received my American citizenship a couple years ago. We are thinking of starting a family and I would like to move back to Canada with my husband. I'm not sure if I'm in the Canada part of this website, but I tried to. He is worried he would have to renounce his American citizenship. When I got my Canadian citizenship I didn't buy I've heard of you are a USA citizenship moving to Canada you have to. Is this true? Is there a way to have both still for him? Does anyone know anything about starting this process?

    Traveling through Texas inland border checkpoint while adjusting status?

    My wife has her K1 visa, which has expired as we are currently adjusting her status.

    She has had her I-795 approved. We are waiting on I-485 approval and have the 797c AOS letter.


    I see posts from several years ago stating passport + 797c AOS letter is sufficient to pass through inland border checkpoints.

    Just wanted to make sure that nothing had changed and/or find any official source, thank you!

    Clarification on Embassy Visit, DS-260, and I-864 Forms

    I have a few questions regarding our upcoming interview and embassy visit:

    1. Can we visit the embassy in our own vehicle since we have Diplomatic Enclave passes? Our children attend school within the Diplomatic Enclave, and we also have friends residing there, so parking should not be an issue.

    2. Is it necessary to update the DS-260 form now that my husband has retired and started a new job? We've already updated our residential address.

    3. Do we need to bring a separate photocopy of the I-864 form for each family member during the interview?

      Days just ticking away and no action. 216 days since they received the application and still under review. We completed the inquiry and we were told to wait until the Milwaukee office has opening for interview.
       
      I am starting to doubt if we would get interview before Christmas.

      Hi there! I came across your review post and was wondering if you could help me out as I'm in a similar situation as you were. My sponsor is a USC who just started grad school this fall but was working full time before that. Sponsor is on a full scholarship and monthly stipend. Also has a new address. 
       
      We have already been DQ(before grad school) and waiting for IL. The stipend is still above the poverty guidelines limit but we're wondering if the grad school situation will be an issue during the interview process? What about the address? Do we need a joint sponsor at this stage?

      February 8, 2023: We went in for the N-400 interview but were told on the spot that the i-751 Interview would also be done, which threw us off. It was our fault for not doing more research and bringing a hard copy of what we sent. Thankfully, we were approved for the i-751 removal of conditions. However, the N-400 was canceled pending rescheduling.
      July 18, 2024: Received notice: "We are actively reviewing your Form N-400, Application for Naturalization. Our records show nothing outstanding at this time."
      August 26, 2024: Received notice: "We scheduled an interview for your Form N-400, Application for Naturalization. (September 30, 2024 Irving)"
      September 30, 2024:
      8 am: Complete interview
      9:30 am received notice: "We recommended that your Form N-400, Application for Naturalization, be approved. Your case was submitted for quality review."
      12 pm: Receive notice: "Your Form N-400, Application for Naturalization, was placed in line for oath ceremony scheduling."
      1:30 pm receive notice: "Oath Ceremony Notice Was Mailed (October 19, October 2, 12 pm Irving, TX)."
      We got there at about 7:45 am. They only let her in, and I stayed in the car.
      According to her, she went through security and had to wait 10-15 min for them to call her. The officer interviewing was pleasant and spoke good english. She starts with an oath where she stands, raises her right hand, and swears to tell the truth. No small talk at all. The first thing was to read and confirm her full name. Then the officer asked my wife to read out loud one sentence. Then the officer said, "California has the most people," and my wife had to write it on a tablet.
      Civics Test:
      -Name of national anthem
      -Where is the Statue of Liberty?
      -Who makes laws
      -Who signs bills to become laws?
      -I forgot the last one.
      From there, it was an N-400 walkthrough. The first minor hiccup was how long we've lived at our current address. We have lived in the same building address for 4+ years but moved apartments, so technically, our current apartment has been there for only two years, but the building has had the same address for 4. My wife had to point that out to the officer.

      Things got really tense once it came to how long she'd been out of the country. The officer said, "You've been out of the country longer than you're supposed to, which is more than six months in a year."
      My wife had only been out of the country 2-3 weeks a year for the past five years, so this was very confusing. The officer showed my wife the screen, and it showed a bunch of dates that we did not submit on our N-400 or I-751. As it turns out, the system added the 1+ year she needed to wait outside of the country for her CR-1 to be approved and lawfully enter the US. We are really grateful the officer showed the screen and a willingness to listen because it allowed my wife to walk through with the officer that it's counting time before she was a lawful resident and we lived in Colombia right after getting married because our understanding was to change her Visa from visitor to spousal, we HAD to leave the USA until the CR1 was approved, a new visa was added to her passport and mailed back to her. 
      The officer said that made sense and let my wife know that if she hadn't clarified that, she would have denied her and was actually wondering why my wife came to the interview if we knew she was going to be denied based on being out of the country for so long. 
      After that tense back-and-forth, the officer made all the updates in the system and said my wife was recommended for approval.

      We were shaken at the fact an error happened that was no fault of our own, and that error was pointing us to being denied. But we are SUPER grateful the officer was willing to let us explain our side and not just try to push us through to get to the next person. Overall, it was like a 45-minute interview, and the happiness kicked in with them being so quick to schedule our oath ceremony (October 19).
