PSA: If entering the USA 2 years after marriage, kindly remind the immigration officer of this

When we last entered the US, our immigration officer said "Oh, hmm I wonder if I could go ahead and change you an IR-1." The agent right next to him said "Yes, you can do that" and he acted surprised. His comments made it pretty clear he was going to erroneously issue us a CR-1 and he seemed to not even know he could change the visa status until his coworker advised him (THANK GOODNESS she overheard!). I don't know how onerous the process is to correct such an oversight but I'm glad we didn't have to find out!
Just wanted to pass this along in the hopes it saves someone from any problems with the wrong stamp being placed in the passport, as I've read about here before.... I would kindly remind the officer "We married >2 years ago. We can enter with an IR-1 visa now right?"- 20 replies

I entered the U.S. on a K-1 visa on June 1st and left for Canada on June 2nd, remaining here for 20 days. I am now attempting to return to the U.S. through Toronto Pearson Airport (YYZ) using Automatic Visa Revalidation (AVR). My K-1 visa is expired, but my I-94 is still valid. Am I ok?-

Wrong USCIS application form filed by my lawyer!

Hello, so my wife came in k-1 visa to USA and we got married and all. We filled for work permit and green card together but while doing that my lawyer filed for I-130 no idea why. Will that application make my process for work permit and green card slow? If so how do I withdrawal that application? My lawyer isn’t helpful at all. I need some help…-

Seeking advice for Thai/US couple - What US visa path to take?

My gf and I live in Thailand but spend 2-4months in the US per year. Once/if we have children age 5+, the time split would become vice versa. We have no plans to live full-time in the United States in the next 5 years, but I visit my family and friends 2-3x per year for 2-3 weeks at a time. I would love it if she can join me for those trips and experience that part of my life. What options do we have -- US visa wise, maybe a tourist or fiance visa later? Other?

Please be nice, I know I made a mistake... But got my K1 approved and arrived in the US June 25, 2024 and applied for AOS February 25, 2025 -- then left the US (abandoned my AOS). Will I be banned for re-entry to the US -- even under a spouse visa?-

I'm currently living and working in the United States. My fiancé currently lives in Japan. We have been dating for about 6 months, and we have met in person several times, but we are not yet married.
My fiancé will be visiting me in the United States on a tourist visa some time in March or April and staying for about 3 months. I want to file for a fiance/spouse visa asap -- what's next?-

1 RepliesHello, this case is about family-based Adjustment of Status (AOS).
I am currently on OPT, and my husband has been a green card holder for three years. I came to the United States on an F-1 visa about three years ago to study at the same university he attended. At that time, we were dating we have actually known each other since we were about 15 years old.
About a year later, during a school break when we returned to our home country, we got engaged and then came back to the United States. A few months after that, we traveled home again and had a ceremony with family and friends. However, we did not officially register the marriage at that time because the legal process in our country requires certain steps, such as medical tests, and we did not have enough time to complete them.
After the ceremony, we returned to the United States, and about five months later, we legally registered our marriage. It has now been four months since our legal marriage and nine months since my last entry into the United States. My husband now intends to petition for my green card.
At the time of our marriage, we were uncertain whether we wanted to settle in the United States or return to our home country, so we did not file a petition immediately. However, after beginning my OPT and consideration, we are thinking of building our future in the United States.
I would like to know whether this situation could cause any issues with my AOS application. I would really appreciate any advice you could provide.

4 RepliesHi everyone, I m seeking advice on a tricky situation. My wife originally entered the U.S. on a G-5 visa, which is technically still considered active as far as we know. After we got married, we filed the I-485 for her adjustment of status. Currently, her I-485 is under active review by USCIS. However, her mother is critically ill in the Dominican Republic, and my wife is worried she won t see her in time. We want to know what steps (if any) can be taken to allow emergency travel during this process. Does she attempt to travel on the G-5 (if it s still valid), or does the pending adjustment change her status? I m worried about leaving and disrupting the process. G-5 situations seem rare, and many lawyers don t have experience with them. Has anyone faced something similar or have advice on how to handle travel or paperwork in this scenario?
Applied For N-400 in February 2025 but Have not heard anything.

5 RepliesI am applied for i-751 in February 2024 and N-400 in February 2025. Received NOA for both but have not heard anything since then. I check myUSCIS at least monthly. No changes. I used to have myProgress tab towards the end of last year. I thought I would hear back by December but then the tab disappeared and jt is like we are back at square one. Is it normal to take this long? What actions would you guys recommend I take. Thank you

Does this include tourist visas from the far past? My spouse entered the US on tourist visas a few times many years before we met. She no longer has all these passports/visas. Are they considered "immigration-related"?

Similar question as above. I think we should be able to get all her I-94's online, but she no longer has the passports/visas she used to enter the country years ago
Can a US citizen spouse "cancel" a marriage-based spousal visa?

If the US citizen spouse is angry about something with their overseas spouse who is about to immigrate to the US on a marriage-based spousal visa (the one where he'll get a marriage-based green card), so much so that they want to "cancel" the visa, do they have the power or authority to do so? Such as threatening to "call immigration". As far as I know, there is no true "calling immigration".
Or, if they can't stop the spouse from legally entering on that visa, can they somehow stop the green card from being issued? Or anything else that they can sabotage?
