I petitioned my daughter who is turning 20 next month, I would like to know if she needs to submit a Certificate of No marriage even if the petition is based on IR?

No, her being married or not has no affect on her immigration since it is not marriage based. What may affect her is turning 21 before the immigration process is complete.

First trip 01-17-07

Married 02-05-07

What Service Center was filed at? Nebraska transferred to California

Provide dates for the following:

I-130 sent (Mailed)..........................3-12-07

1st NOA (Receipt Notice) .................3-29-07

2nd NOA (Approval Notice) e-mail.....6-15-07

Bill for I-864 processing fee rcd and sent..7-24-07

I-864 Packet Received......................8-18-07

I-864 Mailed to NV............................8-20-07

Bill for DS-230 received....................8-29-07

Payment for DS-230 sent..................8-30-07

DS-230 Packet received..................10-25-07

DS-230 Packet sent to NVC..............10-29-07

Case Completed..............................11-16-07

Case Forwarded to Embassy.............11-30-07

Packet recieved from NVC................12-07-07

Medical complete...............................1-04-08

Only unmarried children are eligible to obtain a visa as a step-child of a USC, so she may well need to certify she's single. If so, she'll get a list of items to bring to the interview and that will be on it. If you want to know for certain sooner, I suggest you contact the Consulate directly.

She won't need a Cenomar at petition filing. If she needs one it should be issued as close to the interview as possible.

Unless you are now a US Citizen what really should have happened is the USC step-father should have petitioned. That would make a visa immediately available. A LPR petition will take years, during which she must remain unmarried or be disqualified. I hope you meant your USC spouse petitioned for your daughter.

I would suggest for you to still obtain her CENOMAR solely because she is being petitioned under the unmarried sons or daughters of the USC.

Great. If you have further questions regarding your daughter, it would be good to indicate your USC spouse petitioned. No confusion that way.

In any event, I'd count on needing that CENOMAR.

I stand corrected, you will need a CENOMAR to prove she is unmarried. With the length of time taking for I-130 process it will probably be useful for you to know about NVC speeding up applikcations if your daughter is going to turn 21 within 2 months.
