Hello-

My fiance is Moroccan and hopefully he'll be here this summer or fall on a K-1 visa. I am going to be graduating at the end of this year from my university and am day dreaming about going to Paris for culinary school afterwards. Is this even possible? Let's say that I would start in a year or two over there. Anyone know?

Merci beaucoup

Sarah

Sarah,

I do know that once he is here on a K1 you will need to marry within 3 months and file for his adjustment of status. That can take from 6 months to a year on average from what I can see, but you can check the timelines for better accuracy for your area. I don't think you're supposed to be out of the country very long (after he gets Advanced Parole, which you have to file for and takes at least a couple of months itself to get) during that time. If he does leave the country without AP, or violates whatever rules there are for length of absence, you have to start all over again.

He will get a 2 year green card at the time your AOS is approved, but I'm not sure how much of the next two years he has to spend in the US to be able to file for the 10 year green card after the 2 years. Hopefully somebody that has their green card already can answer that, maybe in a different forum.

There is a limit on how long a LPR can be outside the U.S. without having problems re-entering. I think you have to get some sort of re-entrance thingy if you are gone more than a year.
