My wife and I were married in October. Her I-94 expired on November 7 so we did get married within the 90 days of entry. I understand from other posts that we're "okay" even though we haven't filed AOS yet.

We were waiting for the marriage certificate to arrive and now that it's here, I have some questions:

1) we'll be moving across the country at the end of december. Should we try to hurry and file I-485, I-765, and I-131 documents BEFORE moving? Or can we wait until January after we've moved and have a new address?

2) When can my wife apply for a SSN? Does she have to wait for the EAD (I-765) to be approved?

3) For the I-864, I have greater than 125% of the poverty guidelines. Do I need to submit past tax returns -AND- a letter showing my current employment, or will just my tax returns be sufficient?

4) If all three documents are filed simultaneously (per the instructions) and if each form requests a copy of the birth certificate, passport, etc, do we need to include duplicate copies or will one copy suffice since all three forms are filed together?

2007-10-07 Wedding

2008-01 Moved across the country

2008-05-13 Filed I-485, I-765, I-131 simultaneously

2008-05-20 NOA1 for the above

If you don't have a problem doing so, I would suggest waiting until after you've moved to file for AOS because I've read way too many horror stories on VJ regarding people not receiving documents and important letters from USCIS months after doing an address change.

Since your wife's I-94 has expired, she will have to wait for her EAD in order to apply for an SSN.

I don't want to provide bad advice for #3 so I'll leave it for someone else.

Treat each form individually, even though they are being filed together in the same package.

Thanks for the advice! As a follow-up, will my wife be precluded from applying for a driver's license without a SSN?

I think the reason why we didn't request a SSN first thing was because we didn't want to apply using her maiden name and then apply again requesting a name change.
