Pete and I have to be married by February 19th...the wedding has been set for the 16th. Timewise....will we be ok? I told Pete I want to have everything filled out and ready to go..once we are married. Then we can over night the package if need be.

Other option...change the wedding date...and pray that his parents haven't purchased their plane tickets as yet.....

As long as you marry within that 90 day time frame, you are good.

You do not have to file AOS immediately. While many people do for their own reasons (SSN, DL, work, etc.) it is not required that you file that in 90 days. I've known people who wait a year or more. We waited a month and 1/2 to file.

The above reply is correct the legal requirement is to marry within the 90 days I have never seen it written anywhere where there is a time constraint to adjust status. HOWEVER once your 90 days is up you are "out of status" and what you will find is you tend to go into panic mode. You'll be perfectly fine with your plans as they stand but you'll feel an enormous sense of relief when you get it in and get the NOA1 which effectively puts you back "in status". One thing to remember you may have to wait for the actual marriage certificate we had to go back a week or so after the wedding to get ours (would also suggest getting more than one copy) ask whoever is marrying you how long it will take to get the cert back. we were about a month or so late in filing after the 90days and other than frayed nerves caused no problems whatsoever

I agree with the above posts. There isnt any formal time constraint for the AOS to be filed in. If you really want to get it in ASAP, check with your local county court to see if you can drop off the marriage license rather than waiting for whoever presides over the wedding to send it in, get it all processed and get mailed back to you. Definitely get more than one copy, as you have to send on in with AOS and everywhere asks to see a copy when you change your name and other random things.

Pete said something about having to take the white card off the passport and send it somewhere as proof that he is staying in the country. (according to what they told him at Newark---Oh...Newark DOES issue EAD's!!)....Does anyone know anything about having to mail in a card?

No, do NOT take the I-94 out of the passport and mail it anywhere. It shows that he is here legally, that he was checked by immigration when entering the country. Without it, it will seem that he entered the country illegally. In addition, you will need it when filing for AOS. When filing for AOS you will not send the I-94, you will make a copy of the front and back and send the copies.
