switch from k3 to cr1??

I'm thinking of switching our visa to a cr1. I really think we're in for a 9 month to 1 year wait here in AP based on the comparison of others in my similar situation and I think it'll be a waste of time to just keep with the K3, wait THAT long for him to get here and then wait AGAIN for the green card.

Has anyone from Egypt done this and if so could you tell me your experience, i.e. how long it took to get the I130 from your service center to NVC, how long it took after the interview to the day visa was in hand.

I also want opinions on if this will delay our visa process further or not. I don't want to screw things up but it makes me sick to think that we could be working on something like this while we sit on our hands waiting.

I don't know either... but it really does suck waiting all this time and then having to apply for AOS :( ...

I do know that most people who apply for CR1 apply for K-3 after they have recieved their approvals, I wonder if it would work the other way around?

Have you filed the I-824 yet?

No because I wasn't intending on following through with the I130 until I thought about it this morning. I did just look at the vermont service center processing time for the I-824 though and it's 6 months. That's 6 months just to put the already approved I-130 in the mail to the NVC. :( I figured it was automatic and the I130 would take about two to three months once it got to the NVC but 6 months just to get it there........inshalla I won't be still waiting for the visa by then since that would be 10 1/2 months of ap but who knows. I'll have to think this one through a bit more.

I would talk to an immigration attorney for sure....the cr1 is a long long long path

2/20/2008 on US soil :)

5/27/08 checked the website for the third time today -says AP and EAD approval letter sent 5/24- it was not updated online till today - and no e-mail update either

5/29/08 AP touch

5/29/08 email EAD card production ordered

6/02/08 AP in hand

6/03/08 email EAD card mailed

6/05/08 EAD card in hand :)

7/28/08 AOS letter received

9/02/08 AOS interview

9/10/08 card production ordered email :)

9/17/08 welcome letter email and snail mail arrive same day

9/19/08 Greencard in hand :)

Ok I"m rethinking this again.

Say I file the I-824 and by some miracle it pushes the I-130 to the NVC by the end of January. (ha I know this is just a make pretend scenario though)

Then we start with the steps at NVC filing the forms, paying the fees, etc. but then midstream WHAMMO by some act of God we get the K-3 approved and in hand.

What happens to all those fees and extra forms that were filed with the I130? Are they all wasted?

Yes they are all wasted the fee's i am talking about. I filled both I-130 and I-129 and my husband interviewed on the K3 then I thought we where getting the visa (only cos they told him to send it in) then he got it back I was frantic and then I got a letter saying that he had another interview for CR-1. Well I am very thankful to God that this happend becuase he came on the CR-1 and after a week he had the Social Secuirty Card and no more fee's yet and I can actually say until next year to lift conditions. Don' t know that this helps but I know that the 2 different petitions don't have contact with the other if that makes since. One will not slow down the other form what I have been told. The only reason that it stopped him coming on the k3 was that the other arrived before the k3 visa was issued. I belive that God was watching out for me and had an Angel in the Embassy.

May 20, 2007 Embassy called for Hasan to send in his passport!!!

May 24, 2007 Recieved Interview date of June 5th for CR1?

June 05, 2007 Interviewed and she said he was approved, kept passport and said will recieve in 4 days.

June 12, 2007 VISA IN HAND !!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

June 21, 2007 Hasan arrived in the USA and so very happy!

July 25, 2007 Green Card in Hand!

June 6, 2009 Removal of Conditions Approved!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!

July 17, 2009 10 Year Green Card in hand!

So I guess the fees wouldn't be waisted except for the one to pay for the transfer from vsc to nvc which is around $350 or so. That sucks that it used to just go to the nvc automatically and now we have to pay a HUGE amount just to have them slap a stamp on the frikkin' thing. :angry:

We aren't from Egypt so I'm not sure if it is different or not , but, we abandoned the K-3 and pursued the CR-1 and I'm thankful we did. No more fees until Lifting of Conditions, He came into the USA with status already adjusted so he was able to work as soon as he got his SSC (which was, if I remember correctly, only a couple of weeks).

My girlfriend applied for K-3 the month after we did but didn't abandon it and do CR-1 and their petition took 7 months longer than ours AND THEN they had to do AOS and all that stuff..They had a rough time.

I can't speak for what is best for u but for me, I'm happy with the way we did ours.
