Hi all,

I know this is the wrong site to be posting this kind of thing but i dont know where else to go. I originally entered the US on a K-1 visa in November 2004 after selling my house and quitting my job. I got married to my USC wife in February 2006 but not long after following a huge fallout between her and her mother(whom I was to be employed by) she told me I should return to the UK to work until she was sure she could be married to me.

I did not have AP and eventually my wife filed the I-130 in September 05. We are now only a week away from the K-3 interview and my wife has told be she does not want to be married. She has always had insecurities about being married and the responsibilities that go along with it and even had some counselling about her anxiety.

I do not want to lose her but at the moment it sounds like I have no chance. I have been living with my sister in the UK for the past 13 months working temporary jobs every now and then to keep money coming in. I do not have a lot left and now have no house. She is now talking about divorce and I would like to know what the process is in America if she does file??

From your other post it sounds as the the main issue your wife has may have to do with signing the affidavit of support. Have you considered maybe trying to find a co-sponsor so that the burden wouldn't all be on your wife?

I dont know why it has taken her so long to eventually come to this decision. I can only guess she feels guilty that I gave up so much for her and she couldnt bring herself to finally end it...I'll probably never find out.

I will definitely suggest a co-sponsor, it could only be her mother so I'm not sure if that will work. I'm not going to give up easily though, but the affidavit wasnt a problem when going through K1.

When you say 'wondering what the process is in America when she does file' do you mean 'files for divorce'?

Forgive me if I'm acting to type (blonde) but Im not sure what angle your question is coming from...are you worried she will take more cash from you? Or worried about something else entirely?

June 14th - Interview 10am - APPROVED 1pm!!

June 16th - Visas received in my hot little hands 1pm :)

July 19th - flying to US!

Because of the past, ie moving there last year(selling up etc.) i dont have anything, I have some savings but not a lot.

When we spoke on the phone she said she would be filing and I wont have to do anything? I dont really want to be difficult but I have to think of myself and I gave up a lot for her.

It will depend on the laws of the state she's filling for divorce in. For example, whether it is a community property state or not. You won't have to do anything if you want to just sign the divorce papers. You don't even have to go to the court house if the case is unprotested. If you want to get some sort of settlement, prepare to spend a lot more money, and make an appearance in the court room.

August 26th -- interview date - we need to complete a I-601 waiver so it's back to waiting again

January 6, 2005 i-601 waiver approved!!!!

January 21, 2005 VISA IN HAND

February 12, 2005 WEDDING!!!!!

March 10, 2005 mailed AOS and EAD applications to Chicago

April 18, 2005 EAD and AOS receipt dates for NOA

June 30, 2005 AOS RFE evidence submitted (translated birth certificate)

August 10, 2005 ---EAD approved via infopass appointment

October 18, 2005 - AOS interview in St. Louis - received an RFE for vaccination supplement

February 9, 2006 - denial for AOS letter due to the wrong form being submitted from the doctor. PLEASE MAKE SURE THIS DOESN'T HAPPEN TO YOU!!

February 16, 2006 - USCIS accepts the motion to reopen without an additional fee - finally something goes right! We should hear from USCIS St. Louis office within 2 weeks.

April 3, 2006 - Received welcome to America letter in the mail!

April 8, 2006 - Received GC in the mail - done for 2 years!!!!

March 1, 2008 - mailed off I-751

March 3, 2008 NSC delivery confirmation

March 10, 2008 NOA 1

March 28, 2008 Biometrics appointment

Legal Permanent Resident - just waiting for time to pass for him to have eligibility for citizenship.
