Hello VJs,

I have a questions right now. I got my K1 visa las sep 4th and it is valid until march 6 2008.

I am planning on travelling to US next February cause i need to finish some stuff here until then. So we are planning to get married in May (spring) since Winter is very cold in North Dakota.

I am wondering now if I need my K1 visa valid for getting married, cause in may it will have already expired... should i get married before march 6? On the other hand....should i need my visa valid to start my AOS process? o get my SSn and driver's license?

Please... help me to solve this...

No problem. Once your visa is used, it is dead. The expiration date has no meaning. Upon entry, you will get an I-94 card stapled to your passport that expires in 90 days. You are required to marry within that 90 days to fulfill the terms of the already dead visa.

If you've planned a marriage for May, make sure you enter the US less than 90 days before the marriage and soon enough to allow time to obtain the marriage license and any waiting period after.

If you plan to visit the USA in February, the visa thats inside your passport will be stamped / used at that time at the POE (port of entry), from that date (the day you enter US soil) you will have 90 days to get married, plan your marriage around that for the end of April or begining of May. You will not be able to leave the USA once you are here unless you apply for Advanced Parrole (I-131 Application for Travel Document).

The other option is to see if you can get the Visa extended at your Embassy in your country.

Kem,

you must enter US before your visa expires, which you plan to do. So you are ok there. Once you enter the US, visa and the date on it has nothing to do with anything you do :)

From the date you enter you have 90 days to get married. That's what you need to worry about. So... adjust your travel date and your wedding date to fit... and you will be fine. When you get to the AOS stage and interview... they will check those dates to make sure you complied with visa requirement which is: marry within 90 days of entry.

I entered April 4 this year and married July 1 (my I-94 expired July 3). At AOS interview we were asked if there was a particular reason for that "last minute" wedding. We gave a simple explanation and all was ok.

SSN - 30 October '07 (married name), applied Oct 18, same day I got my EAD

DL - 11 December '07 - driving test at DMV San Francisco. Yay! Now I can drive on the "wrong" side of the road!

Hi Kem,

You need to

*Enter the US before March 6 (if you fly in February, then you'll be fine).

*Get married within 90 days after your arrival

*File for AOS as soon as possible after marriage

*No need to have your SSN or driver's license before filing for AOS. In fact, chances are you might not be able to obtain a driver's license until after you receive your EAD card or green card, depending on your state's regulations.

Marry within 90 days of entering the country.

There is no required date/time that you must complete AOS, after marrying as a K-1 though many file right away to obtain the LPR and EAD.

If your fiance enters at JFK, a temporary work permit stamp will be issued though again, that is only valid for a short period of time.
