Hi

I am a bit confused about my legal process and may be someone can help me out through this maze !

Married in January 2006, filled legal paperwork I 485, I 130 , I765 in May 2006.

Interviewed in August 2006.

Fingerprintings in November 2007.

December 2007 received that letter in the mail granting lawful permanent residence stating the alien registration card will be mailed witin the next 2 to 4 weeks.

Attached to this letter , another letter referring to Section 216 Notice, reminding me for I 751 which must be filed within 90 days preceding the expiration of conditional status.

\Does it mean I am still temporary status or not?

What is the next step for me to happen ?

What should I do now ?

Sounds to me as though your case has been approved (conditional permanent resident) and you will be receiving your green card in the mail soon. You will need to file form I-765 90 days prior to the expiration of your green card (should be good for two years) to remove the conditions from your green card and be issued a 10 year green card.

when do i haveto file form I 765 ? I thought it was I 751 as they say in the letter they sent me. I did not receive any green card so far !

is it 90 days prior to 2 years temporary green card anniversary or 2 year wedding anniversary I have to file?

Do I have to renew my work permit in april 2008 if I received my 2 year temporary green card soon or can you work without a working permit by using this temporary green card ?

receiving your green card overrides your work authorization card, you will not need it anymore.

Sorry, typo on my part. You have to file form I-751 90 days before your green card expires.

So you mean I have 2 year from now on to file an I751 BUT 90 DAYS before expiration ?

What does this petition contains? Do I need to fill it with some evidence?

What does it have to show ?

We plan to have different residences for the future. Is it a big deal?

Do I need to have my passport stamped so I can travel outside the US ? How does it work ?

When a marriage is less than 2 years old, you are granted permanent resdident status with conditions. USCIS gives a 2 yr limit to ensure that the marriage is for legitimate reasons and not fraud. 90 days before your 2 yr card expires, you need to file to remove those conditions and become a permanent resident without conditions. Giving the 2 yr conditional card allows a couple to be together and start their life, opposed to having to live apart. Your are fine for now. It is pertinent that you file to remove conditions 90 days before your 2 yr card expires. If you fail to do so, they can start deportation proceedings. Your 2 yr card over rides your work permit because the card is gratning you staus as a resident of the US. Hope this helped you a little.

In 2 years, 90 days before the expiration date that will be on your greencard, you can file for removal of conditions.

The guides at the top of the page have all the info that you will need.

As a permanent resident anytime you move you must notify the USCIS of a address change within 10 days. You can efile this.

When travelling you will need your greencard to re-enter the USA. With that document you do not need a stamp.

thank you. so now it makes sense. I thought the 2 year started at the day of the marriage so actually it is the day the case has been approved which is when I will be receiving my 2 year temporary green card, correct?

Do I need an attorney to file in two years or do it myself/ what can of evidence do you have to produce? do you have to go through an interview in 2 years again / thanks

You CAN have diffferent residences but you'll need very very strong proof that your relationship is bonafide - not always the easiest thing to do if you're living separately. Your passport doesn't have to be stamped, and for more information on the I-751 requirements, :guides:

You can also find form I-751 and its instructions here. You can file them by yourself, without the help of a lawyer.

Thanks for all the info.

One more question, while I wait to file for I 751 , Can I file for US citizenship before that as we will celebrate our 2nd year marriage anniversary in february 2008. I heard one can apply for citizenship after 3 year of marriage,correct?
