HELP!! need advice!! lots questions...

I want to apply for my fiancé in China. We were schoolmates from the past. I met him again two years ago. We now had a baby, 11month old (baby was born here; he was a citizen before I even became one:)). I thought it would be faster to apply for him through the I-129F, so we didn’t get marry. I finally became a citizen this November. I am in school, and didn’t think I could take care of him alone, so he is in China right now. This has been tearing me apart inside. I want to apply for him as soon as possible. I really don’t want any delay for the application process. I need to reunite with them as soon as possible. Or I will probably go insane…:(

My questions are:

1. Do I need to hire a lawyer to do the work for me? ……I have read related postings about this question from the forum. I don’t have a complicated case in the sense that we are singles (never married before), he never came here before, and neither of us has a criminal record. Though we have a son, will this cause a problem? I’ve heard something about the beneficiary can’t have any intend of immigrating to U.S., how would the son piece play into the application? Will it show his intend of staying here? Or does it even matter? Will it work towards my benefit (If it does, I can present photo of all three of us)?

2. Will they need my son’s birth certificate? I didn’t put my fiancé as the father. I left it blank when I was filling it out. Because I’ve heard problem of bring a child outside of the country would needed both parents to be present. If they do need the birth certificate, will it be a problem?

3. I am a really low income student who has no saving. And since I was pregnant last year, and I’ve spend half of the time this past two year staying in China. My income is around a thousand (or lower). Will this become a significant problem even if I can manage to find a co-sponsor?

4. Any idea of finding co-sponsor? People, even friends are kind of hesitated when it’s come to signing legal paper and sponsoring someone. I current have no one for the co-sponsor.

5. My Dad is in China, and he wants to come over, and expect me to apply for him as well. Will there be a problem for applying for both I-129F and I-130 at the same time?

2006, Jan29, first day of the year of the dog. Officially meet for the first time, at middle school class reunion. (1st Trip)

2006, May20, has to go back to U.S. Realize I got pregnant a few days before I left China

2006, Sep06, five months pregnant. Throw up all five months, work all five months, earn the money, go back to China. (2nd Trip)

2006, Nov09, left China.. Tummy got really really big...

2007, Jan09, Happy 1st birthday to my little angle boy... cutest thing in the world (birthing him alone, with his daddy on the phone)

2007, Feb08, travel back to China with baby (3rd Trip)

2007, May31, wean baby off breast completely, and went back to U.S. to work (cried a lot. miss baby and his daddy)

2007, Oct 23, became a citizen, Nov15, pledge at the ceremony and got the certificate

2007, Dec11, finally file for K1...

2008, Jan09, Happy Birthday for my 1 year old angle!!

12/13/2007 : Sent letter request correction for a typo :( worrying...

1. You dont need a lawyer, but if you do decide to use one, caveat emptor.

2. You don't really need to involve your son in the visa process. Other than indicating him on the forms where needed.

3. If you can get a co-sponsor you should be fine.

4. Your friends or family are going to be the most likely candidates.

5. Yes you can, but showing support will be a bit more complicated. It might be a good idea to wait until you have established yourself here in the US before sponsoring your Dad.

These answers are all correct except in number 2, your son's name will never come up in the process.

I would add for number 5 that it will take quite a long time for a visa to become available for your dad, so you might as well file as soon as you are able and get him on the waiting list.

Nothing you mentioned as a complication is actually a complication. Two people who never married before is about as simple as it gets. Your issue is with sponsorship.

With regard to Q1, your fiance obviously has an intent to immigrate, as all of our fiance's do. The whole point of filing a K1 is to enter the US legally with intent to immigrate. If they didnt want to move here to be with us, then we wouldn't be filing in the first place. Your son shouldn't have any bearing on the case, except at the consulate stage, he might be good evidence of a real relationship ;)
