Filing K-3 with no home address in U.S

Currently I'm living with my husband in the U.K and have been for a year, the UK visa has just over a year to run, so we need to start filing our K-3, but as I'm living here in the U.K, I have no address in the states to provide on the G-325A.

So can I use my parents address? If not, what can I do?

Why not file the I-130 directly to the US embassy in London? DCF, this results in the superior IR-1 IMMIGRANT visa, no adjusting status in the USA, and NO waiting for an EAD to work. DCF is faster than K-3 and IR-1 CR-1 filed in the USA.

I concur with YuandDan - if you both legally reside in the UK, it is waaaay better -and faster and cheaper- to go the DCF route. Check out the Direct Consular Filing forum for more info!

Timeline

To do DCF you need to do a few things either before filing or while waiting for the Embassy to process your case.

  • You need to reestablish domicile in the USA, use your parents home, if you receive mail there get the mail to show that address as domicile, also state drivers licesence can be used, as well as US bank accounts.
  • File any IRS returns that you may have not done, you may be exempt from paying US taxes on foreign income, but are not exempt from filing an anual return with the IRS. You can file late.

US domicile and IRS returns are needed for the affidavit of support, and the I-864 affidavit of support is needed for the visa.

You can use someone in the USA as a joint sponsor for the I-864.

As far as I knew, you had to be resident in the U.K for two years before DCF.

Nope, times have changed. It's now perfectly acceptable to file DCF with Limited Leave to Remain.
