Okay, here goes...

Me and my wife were married on March 15th, 2006. She is currently on an F1 visa and has an EAD to work with that visa as well. She even has a social security number. This EAD expires in Mid-July of 2006. I am reading all kinds of posts and information here basically dealing with people who are K-1 or K-3 etc... I am so confused as to what our classification is. I am a US citizen. I was told that I need to file the following forms: I-130, I-485 and all supporting forms for I-485 (I-693, I-765, G-325A, I-864, I-131). I am also under the impression that I can file all of them at the same time to the Chicago Lock Box. Can someone please help me understand the convaluted process...

1) What category do we fall under?

2) Will she be able to continue to work after mid-July and, if not, is there anything we can do to speed up the process? If she cannot, this may cause financial hardships... :(

3) Can we file all the forms together?

Thanks so much in advance to any help you can offer... This board is GREAT!!!

Step-by-Step Guide on How to File an I-130 for a Spouse Inside the US

If your wife wants to stay in the US to live/work, she must become a Permanent Resident (Green Card). She does this by "Adjusting Status"/AOS from F-1 to PR. Depending on where you live, this can take 3 months to 3 years to complete.

Many instructions also on uscis.gov

1) What category do we fall under?

On the I-485, you check the basis of "on an approved I-130 petition" For the I-765, you are applying under category C 9

2) Will she be able to continue to work after mid-July and, if not, is there anything we can do to speed up the process? If she cannot, this may cause financial hardships... :(

There is a notation on the I-9 that states that there is a 90 day grace period between the expiry date of the old EAD and when the new EAD has to be produced for a renewal EAD... she can apply for a new EAD with her C 9 category.. However, it may or may not be issued by the time that 90 day window passes...

3) Can we file all the forms together?

Yes.. you file all of the forms together at the Chicago lockbox..
