Any point to filing K-3 at this time?

I had thought about filing for K-3 after the NOA1 for the I-130 was received, but with the HUUUUUUUGE delay in getting the NOA1's issued, is their any point to doing this?

Personally I don't think so, from what I have seen.

Even if you did and by some miracle it sailed through, AOS is also taking much longer (my Brother in law has been waiting for his EAD since July). Also he has now been booked for his adjustment interview - in late February! So that's 7 months between applying and getting the interview.

He went for an infopass last week about the EAD and they said they are working on July now (it used to take around 90 days).

However, maybe your Husband working isn't an issue for you guys, still, generally, if your I-130 has already been approved they just sit on the I-129 anyway I've heard, so it would probably not be worth your while.

But! The way things are now there is no additional charge for filing the I-129 right? So if you think there is some chance it might move faster and your Husband working isn't a priority, I would go for it.

One thing I have noticed though, K3 interviews at Montreal seem to go to the back of the line (based on Liz's interview timeline).

If you would get sent to Vancouver it MAY benefit you time wise. We filed our I-129f without the I-130 NOA1. From what I have seen here on VJ, Vancouver schedules interviews anywhere between 1 week or a month from when they receive your checklist. I am not exactly sure what the Montreal wait time is for interviews...but i gather that it is about 5-6 months. On the otherhand, K3 is more expensive and more work after you enter the US then a CR1.

Sadly, my husband would be sent to Montreal either way. So, I think I will just stick with the I-130 and hope for a miracle.

Ya that is what i would do...Personally I think that CR1 is better than a K3. It is cheaper and you dont have to do an AOS later ( i think...not sure!). The only reason why we did a K# is because i live in Edmonton and I would be sent to Vancouver. Best of luck to you

So what is your timeline looking like anyway? If I am reading this correctly you are possibly looking at adjucation of your I-130 in May, then say 4 months at NVC then another 4-6 months for an interview?

What are you estimating?

I don't even have a clue how to estimate our case. Since the NOA1's aren't even being generated, I am thinking this could go well over 1 year.

I honestly hate to say it but I think you are right. I mean we got in well ahead of the rush (March) and this is now month 9 of fun and games. Granted we got messed around at NVC, but even best case it would have been approved say mid/end of October which would only have knocked a month and a half off - so still 7.5 to case complete at NVC.

Plus all those IR1's and CR1's will hit NVC around the same time.

I find it absolutely appalling, I really do and feel really bad for you and your Husband and Son.

Any chance you know someone one who lives in the west and maybe your Husband is 'staying there' too (for the K3)????

I actually asked him if he knew anyone, or knew anyone that knew anyone, that lived in western Canada. And that came up empty.

I honestly don't think our relationship can stand another prolonged immigration process. It nearly ended over my unhappiness waiting for CIC to do something. (On a side note, I read recently that the local office that was handling my Canadian processing had recently announced that their backlog had increased from 12 months to 15 months, so I would still be sitting around doing nothing even if I had waited it out.)

I really don't know what to do. I know my husband wants to get here like, yesterday. My son is coming at the end of the school year (he is a USC) in any event. I just don't know what will happen when my son moves here and my husband is left behind in Canada. Things will seriously fall apart. I haven't told him of my new projection of 1.5 - 2 year wait time yet because I am afraid of his reaction and that he will just get depressed and give up.

I hope what you are saying might happen never comes to be. You guys are in this together and failure is not an option! Keep thinking that. Even if it takes 12-15 months you will have years and years and YEARS of married happiness ahead of you.
