OK... I don't know what to do... right now we have been waiting in AP since his interview Oct 17th.. almost two months

My fiance requested his passport back temporarily from the embassy because since it is taking so long, his German student visa is almost expiring also. Well i have been emailing them religiously every two weeks to ask about the status of our case and if they need any additional documents.... i emailed them yesterday to make sure they responded to my fiances request for a passport and to let them know I would be coming to Germany... this is the response I received:

Please note, that the administrative processing related to your fiancé's visa case is still not complete.

We have received his email that he would like to get his passport returned on 04 December 2007. The passport has been returned via German registered mail on the same day.

Every other time I have been told if we need anything additional, we will contact you... so i told my fiance all happy that they mailed it to him, and he calls me and tells me he received a letter today, written yesterday saying:

Our records show that you are the beneficiary of a K1 fiance visa petition. This office sent you a list of documents required to complete the processing of your visa. As of today you have not responded to our letter.

Ok first of all... WE NEVER GOT ANY LETTER ASKING FOR ADDITIONAL INFO?!?!?! he has been waiting and checking his mailbox every day waiting for the visa, and nothing.. then it goes on to say:

An approved K1 visa petition is valid for a period of 4 month from the date of approval. Since your petition was approved more than 4 months ago it is expired. It may be revalidated for an additional 4 month provided the consular officer concludes that the petitioner's and the beneficiary's intentions are still to get married. Please ask your fiance to send us a statement explaining why you have not pursued the fiance visa earlier, and stating that both of you remain legally free to marry and that you continue to intend to marry each other within 90 days after you admission in to the United States. Also inform us when you plan to travel to the United States. IF you do not contact us within 6 months, your petition will be destroyed.

OK.. so what the #######, none of this makes since to me... they are acting like he hasn't even had an interview yet?!! or sent back packet 3 & 4? Our interview was on the 17th of October, and we have been pursuing the stupid visa that they won't give us ever since then? On top of all that, since my NOA2 was in August, my stupid petition is expired because its been 4 months.

I don't know what to do... do I write a letter, email, call? I am leaving for Germany Monday, can I just show up at the embassy with that letter? I understand I need to send a statement, but I want to do a lot more than that! I am so angry that they are putting us through this, when I have been asking over and over again what i can do to speed up their "Administrative Processing"... should I contact my congressman? I think they are so screwed up, I would like to straighten it out in person with them...

Does anyone have any experience with this embassy, or how I should contact them? Do I have to have an appointment to go to that embassy? How hard is it to extend my petitions 4 month validation, since it was their fault? ugh.. he should have been here already, and just because they don't know how to do their job, this whole process has been held up for all these extra months...

This is all very confusing. Sorry you are going through this.

I don't know much about the Frankfurt embassy but here is my $0.02.

I thought the expiration on the NOA2 was for interviews only. I don't think it applies once you have had the interview. You need to get this straightened out ASAP. There seems to be some confusion on their end as to what stage in the process you are at. You need to make sure to clear this up because it is possible that this mess up is what is holding up the visa (just my guess).

I think that you should also go to the consulate yourself when you are in Germany to make sure they have it right. Take all the correspondence that you have had with them, your NOA2, copies of packets 3 and 4, everything that you have just so that it is burned into their brains that you have already had the interview.

I know that for most embassies there are times that USCs can just walk in but I'm not sure if they have specific times if you are walking in to discuss the visa process. You may want to check their website or call to make sure you go when you can talk to someone who is familiar, or even incharge of, the K1 process on that end.

If that doesn't work, I would suggest contacting your senators.

I would take everything with me, and your fiance too and go down there to talk to someone. And CRY! CRY HARD AND LONG RIGHT THERE SO THEY KNOW THAT THEY ARE BREAKING YOUR HEART! Demons! Make sure you have the letter reaffirming your intent to get married for their records and carry a log of all your phone calls and emails and no response regarding the AP with the embassy.

Thank you for all your responses! Its really nice to not be ignored :)... I already wrote an email to them, asking for a phone number and an appointment. They don't like giving out that info too freely from what I have found... my fiance is the diplomat of the two of us, and gracious words always stream from him. Me on the other hand, I just want them to pay! hehe, and while I was civil in my email, I was clearly saying they need to fix their mistake! I am planning on being as nice as can be though... in person :) i think just knowing that I will be with him again tuesday has made this not stress me out so much :) I have been praying, and I know it will be God if he gets to come home with me, but I have a feeling that may happen :) we will see :) and I will keep you guys updated! :) thank you all again sooo much!

Which part of Germany is your SO? I went to a Cameroonian shindig in Oldenburg a few years ago. I was also shocked to know that they have huge buildings called Asylums where they keep immigrants until they are finished with their German paperwork. Can't imagine how that would work here.

Alright now sweetie! Don't tear up Germany! Enjoy your time with your fiance and good luck bringing him home. Carry an extra large suitcase just in case you have to pack him with your luggage! Keep us up to date and I'm sending my wishes for God's angels to stay by your side. (if for nothing else but to hold you back from strangling a consular official.)

Haha!! THanks for those prayers and wishes :).. i sent them a rather long email yesterday, and here is the reply I got today:

Please note, that the letter your fiancé has received is an automated letter created by the computer after the validity time of the K1 visa petition is over. Please follow the instructions and submit a letter of intent with you original signature. This way, the petition will be revalidated for another four months.

However, as we have informed you before, there is currently no further documentation needed from either your or your fiancé's side. We will contact you, in case there is additional documentation needed. So far, the administrative processing related to your fiancé's case is still not complete.

You may return the passport in person any workday between 8:00 and 11:30am. There is no need to set up an appointment. Please note, that the Consulate is closed on weekends and the German and American Holidays.

So I am happy to know that at least we will be able to get inside without being shot ;).. lol... I am going to try and speak with someone when we are there, and make them feel sorry for us :) anyways... i hope that is what it will do...

He spent a few years in Oldenburg, and has many friends there! He moved to Kassel, but he still calls Oldenburg his "home" in Germany :) I got to travel there with him when we were there last, and he was talking about going this week there also :).. we will see!!

Well I am back from Germany... kind of sad because now i just have to miss him some more..

We went to the American Embassy on Monday, and returned his passport back and left 2 more letters of intent. I tried asking the girl if there was anyone we could talk to or if she could let us know what was taking so long, and we just got the typical "admin processing" speech and they didn't know how much longer it would be. She said she would make a note that I was there, but I don't know if that will do any good or not...

We have a wedding planned for march 1st and now i am beginning to wonder if that is going to happen.. considering contacting my congressman and seeing if that will do any good or not...

It was so great being able to see him again after all this time though... it was hard leaving again though... i miss him :(

I am happy that you got to see your loved one and I can understand your pain. Be strong and we are here to help you thru the difficult times. Hopefully your visit will speed things up alittle. I will keep you in my prayers...but most important...stay strong and focus on all the positive (I know easier said then done) things.

To Blessed to be stressed:) I realize that all things have a purpose and a time.....have faith and the Lord Almighty will provide... when the time is right, he NEVER fails!
