OK... I don't know what to do... right now we have been waiting in AP since his interview Oct 17th.. almost two months

My fiance requested his passport back temporarily from the embassy because since it is taking so long, his German student visa is almost expiring also. Well i have been emailing them religiously every two weeks to ask about the status of our case and if they need any additional documents.... i emailed them yesterday to make sure they responded to my fiances request for a passport and to let them know I would be coming to Germany... this is the response I received:

Please note, that the administrative processing related to your fiancé's visa case is still not complete.

We have received his email that he would like to get his passport returned on 04 December 2007. The passport has been returned via German registered mail on the same day.

Every other time I have been told if we need anything additional, we will contact you... so i told my fiance all happy that they mailed it to him, and he calls me and tells me he received a letter today, written yesterday saying:

Our records show that you are the beneficiary of a K1 fiance visa petition. This office sent you a list of documents required to complete the processing of your visa. As of today you have not responded to our letter.

Ok first of all... WE NEVER GOT ANY LETTER ASKING FOR ADDITIONAL INFO?!?!?! he has been waiting and checking his mailbox every day waiting for the visa, and nothing.. then it goes on to say:

An approved K1 visa petition is valid for a period of 4 month from the date of approval. Since your petition was approved more than 4 months ago it is expired. It may be revalidated for an additional 4 month provided the consular officer concludes that the petitioner's and the beneficiary's intentions are still to get married. Please ask your fiance to send us a statement explaining why you have not pursued the fiance visa earlier, and stating that both of you remain legally free to marry and that you continue to intend to marry each other within 90 days after you admission in to the United States. Also inform us when you plan to travel to the United States. IF you do not contact us within 6 months, your petition will be destroyed.

OK.. so what the #######, none of this makes since to me... they are acting like he hasn't even had an interview yet?!! or sent back packet 3 & 4? Our interview was on the 17th of October, and we have been pursuing the stupid visa that they won't give us ever since then? On top of all that, since my NOA2 was in August, my stupid petition is expired because its been 4 months.

I don't know what to do... do I write a letter, email, call? I am leaving for Germany Monday, can I just show up at the embassy with that letter? I understand I need to send a statement, but I want to do a lot more than that! I am so angry that they are putting us through this, when I have been asking over and over again what i can do to speed up their "Administrative Processing"... should I contact my congressman? I think they are so screwed up, I would like to straighten it out in person with them...

Does anyone have any experience with this embassy, or how I should contact them? Do I have to have an appointment to go to that embassy? How hard is it to extend my petitions 4 month validation, since it was their fault? ugh.. he should have been here already, and just because they don't know how to do their job, this whole process has been held up for all these extra months... :(

04/19/2008 - 3 NOAs received!

05/09/2008 - Biometrics Appt in SATX

05/14/2008 - Case transfered to CSC

06/11/2008 - EAD & AP Approved CRIS email

06/17/2008 - AP received in mail

06/21/2008 - EAD received in mail

01/21/2009 - FINALLY AOS APPROVED!!!!!!!!!!

Please note their request:

"....It may be revalidated for an additional 4 month provided the consular officer concludes that the petitioner's and the beneficiary's intentions are still to get married. Please ask your fiance to send us a statement explaining why you have not pursued the fiance visa earlier, and stating that both of you remain legally free to marry and that you continue to intend to marry each other within 90 days after you admission in to the United States. Also inform us when you plan to travel to the United States. IF you do not contact us within 6 months, your petition will be destroyed."

So do this:

1) Call and see if your fiance can make an appointment with the Consulate

2) Then print out the emails saying visa is in AP. Include these with the statement your fiance will send.

3) Write a statement like the one shown below. Bring it with the email print outs to the Consulate or send it by courier.

To Whom it may concern:

Reasons why previous visa was not collected by me:

A) Email inquiries to the Embassy requesting an answer when administrative processing would be completed. Attached papers are print outs of email replies from you specifying "adminsitrative processing is still not complete." Therefore it was our understanding our visa was still in Administrative Processing and not ready for issuing.

B) I received nothing in the post from the US Consulate. Please ensure you have the correct address. It is listed below my signature at bottom of page. Additionally, my telephone and email are listed.

C) Both my fiance and I remain legally free to marry and intend to marry within 90 days after my admission to the USA.

D) My travel dates will be (give time frame here - example: two weeks - January 5 to 10, 2007) after I recieve my visa from US Consulate.

E) I am sending this statement to you by delivery method that requires signature by person receiving it. This will provide confirmation this statement within the specified time 6 month time period noted.

F) It would be preferable for me to pick up my US visa at the Consulate instead of mailing it to me to avoid another error and delay in issuing the visa. Please advice me if this is at all possible.

Thank you for your post, and for taking the time to help!!

I can't believe how mixed up they are there. I am the fiance, and I will write the statements saying we wish to continue. Since I am actually going to be there, I want to go to the consulate with my fiance, but I assume I will need an appointment to get in. I will call tomorrow, if i don't get a satisfactory response to my email... it feels good that I will be with him soon, and has made me not stress about this so much.
