I just got off the phone with my lawyer regarding Devine Mercy recent cancellation of her I129F/K3, which worried me because I had such and early approval of my I130. He stated that now that the I130's are getting approved sooner they want to avoid double the paperwork so they are moving forward with the I130. My lawyer stated that he is fighting three client's cases who are in the similar situations. He asked if I wanted to hold off on filling out the affidavit off support papers, because the more they have done they might not work the 129F for us. I told him to keep this moving along.

But I am still pursuing the K3.

Cheers hun thanks, when we get that far I will go for anything even a taco salad without the salad - or wait, make that a salad without the taco - its nutz - and this week I am taking a break from even calling USCIS or my lawyer - too frustrating.

NVC JOURNEY BEGINS

4/07 NV Case number assigned

4/08 AOS, DS and all fees paid online

6/09 tax transcript for 2007 just became available -whoot

6/20 NVC receives everything nothing more to give them now just close eyes and pray

6/23 NVC enters into system

6/26 NVC - RFE uggh - wants all three years of Federal tax return listed and they lost originals or so they say - DING DING ROUND TWO

7/25 NVC Case completed whooottttttttt

8/7 Case forward to US EMBASSY LONDON OH YEAHHHHHHHH -

Embassy - case out for delivery to embassy via DHL sneaky us lol

08/10Received

08/19 Medical Exam completed - healthy oh yeah!!!!!!!!

9/26 @8am -Interview - approved VISA IN HAND OMG WHOOT!!! HELLO AMERICA MY LUV

POE- Atlanta then MCO - October 15th with the cat "GIT" on board lol - POE SUPER SWEET

I suggest that you ask the lawyer to send you dates and tracking numbers to everything he mails out for you. This hold him accountable to getting your stuffout in a timely manner. My lawyer added two months to are waiting time, because he did not mail our K3/I129 out till two months after my reciept date of the I130.

We have the same case, my I-130 got approved mid Sept. but was put aside as we were waiting for the I-129F . I read about Divine Mercy's case and my husband checked with the USCIS doing the RFE trick and indeed confirmed that our I-129F was administratively closed because of the I-130 approval. He called his congressman's office and spoke to an immigration specialist lawyer who even said he didn't know about this new order of events. So the lawyer called Vermont and indeed confirmed that our case has been closed. We even got a letter 5 days later from the lawyer, stating that it was cancelled. My daughter has not been filed an I-130 because we were just waiting for the I-129F. So after 3 months of not touching the I-130, we are moving on to complete it plus we are starting another I-130 for my daughter. A lot of time has been lost. 3 months is still 3 months. I'm just thankful for visajourney and divine mercy's post if not we would still be dreaming of the K3 approval.

Well the funny thing is that this summer the USCIS has waived the fee for the I129F. I believe they realize they were doing double the paper work for the same outcome. USCIS must do the same process for either petition and passed some other items to the NVC and embassy. If your I130 and I129F are their relitivly close they will approve both at the same time I have seen. I am not sure what the result of those situations were though. I am thinking that they could move forward with the k3.
