rcmp criminal records check

Timeline

just to be safe i went in and got my prints done with the OPP station to send away to the RCMP, since i dont live in town i'm under the OPP jurisdiction so had to deal with them. So anyways i got my prints back and its not what im was expecting plus they got my application type listed as landed Immigrant status, Now when i was at the OPP station i told them what it was for how it was for a US visa how i was moving to the states, i reread everything that was on the from and it didnt say anywhere that this was for landed immigrant status tell now heres what is says.

Dear sir/madame:

This certifies that a search of the National Criminal Records repository and Fingerprint Repository maintained by the RCMP concerning the Citizenship Applicant whose fingureprints, name, and date of birth appear below could not be associated to any Refugee Claimant or existing Criminal Record which maybe disclosed in accordance with Federal Law.

Application Type: Landed Immigrant Status

Date fingerprinted 2007-11-01

anyways you get the ideal so how bad do you think this screw up is going to be should i be getting it redone or do you think with the name check plus this screwed up one would be ok.

thats what the checks shows i had and absulate discharge from a shoplifting charge 14yrs ago so wanted to get the RCMP check done too just to be safe

oh ya i dont see anywhere on this page the CPIC letters im freaking out now

2. don't panic: send them both.

3. send only the non-RCMP one.

Well, hmmm, this is complicated. I'm afraid I'm not going to be of much help, hopefully someone will come along who has encounted something similar.

First thing I would do is get hold of the RCMP and tell them they have made a mistake and how devastating this is as you have already waited XX months for this check (lay it on thick!) and ask for a correction. Maybe the RCMP will see their folly and get a correct document out to you ASAP - I hope so!

Second thing is, I assume you are going to claim this charge on your DS-230, I don't know where you are up to in terms of submitting your documents?

If you are ready to send right now and aren't getting any joy from the RCMP I would certainly send in the two certificates you have and hope for the best. Then continue harrassing the RCMP for the correct documents.

I don't know... the letter from the RCMP sounds as if they treated the fingerprintee (a new made up word) as processing immigration to Canada, not the U.S. It just seems odd to me.

11/14/2008: online case status not updated since filing of AOS in July 2008

01/20/2009: Received another RFE for Affadavit of Support Info

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

02/19/2009: EAD card received in mail (no updates on Online Case Status ever made)

02/23/2009: AP received (again, no online updates)

02/26/2009: Received interview appointment letter for 4/6/09

04/06/2009: AOS approved for unconditional GC

04/21/2009: GC received

I wouldn't worry. If you have the Police Certificate and it says you have no criminal record, you will be fine.

I had the Police Certificate, Police background check and the fingerprints at the interview (I got the prints done because I was told by someone everyone had to)

All the guy who interviewed me looked at was the Police Certificate. That was the only thing he wanted.

My certificate came back with the following and you should be looking for the same, and I would definitely want them to change their reason for the certificate to "US IMMIGRATION" since this will be looked at and if not correct could result in a RFE delays.

1. The following is what the accompanying letter contained:

Dear Sir/Madame:

The attached fingerprint form is being returned to you.

This fingerprint form with our wet seal stamp and dry seal embossment will constitute a police certificate for the purpose of a foreign visa, foreign travel, foreign work permit or immigration.

Your truly.

2. At the bottom of the certificate on the left corner opposite the photo is the following stamp.

This certifies that a search of the national criminal records repository maintained by the Royall Canadian Mounted Police (RCMP) concerning the person whose fingerprints, name and date of birth appear above could not be associated to any existing criminal record of conviction which may be disclosed in accordance with Federal Laws.

Dated and signed the officer in charge.

If you got an absolute discharge then there are no charges on your record at all. It's pretty much wiped clean, like it would be if you were a young offender.

But I agree with everyone else when they say that the wording may be odd and you need to get that checked out.

Not exactly. On ds-230 you must declare it and the FBI and other US government computers do not recognize the sealing of records under a discharge in Canada. This normally isn't a problem unless you have committed a crime of moral turpitude (shoplifiting is one) or been found guilty of an indictable offence. On the ds-230, question 30b applies. Also you must declare any arrests on question 31 of ds-230.

Ontarkie, I think that the RCMP sent you the wrong form. Having said that, I agree with Len (hey, there's a first time for everything :lol: ), just send in the OPP form and see what happens. That way you're covered, if the USCIS wants fingerprints, then you'll have them, if they don't want them, you're ready also. :thumbs:

the same thing happened to us!!! my fiancé watched the dude write down "u.s. visa", we sent it out with the check, then got the check back like 2 weeks later. there was a letter saying that they don't charge for police certificates for canadian immigration purposes. we called the number on the letter and he left them a message telling them that it was for a u.s. visa and that they had sent his check back. we got a call a day or 2 later from some lady, he explained what happened to her and she told him that he had called the main reception desk and gave him the better number to call. she told him that they are super busy and that's probably why they made the mistake and also, that they were taking about 5 days to return messages. so, he calls and nobody ever returned called back. so we just left it at that, thinking maybe they corrected it and decided not to bother with him returning the check to them. we just got the prints a couple days ago and now instead of saying "canadian immigration", they say "landed permanent resident status". i guess that's good enough for me, cause technically that's what he's on the way to with the K-1.

May 19, 2008--move to the US

June 6, 2008--marriage

July 12, 2008--filed I-485 and I-765

July 14, 2008--NOA for both

October 3, 2008--work permit received

At least im not the only one that they messed up with. They did send my money order back too saying they dont charge for Canadian Immagration too but since i got out of surgery that day i wanted to call them till i was no longer out of it then i got my prints back. So I called again and was transfered i left a message with my full name and date of birth having to spell it all out so now i wait to see what happends.
