Filed: K-1 Visa Country: Thailand
Timeline

Hello,

I realize that this is a Brazilian forum intended for Portuguese speakers. I hope you don't mind my intrusion here. I could really use some help.

I am in the process of obtaining a K-1 visa for my Thai fiancee. I am counting the days until she can come and join me in our new life together in the US. We just got our NOA2 recently, so we are very excited about that and looking forward to getting her visa.

Well, the reason I am writing here is as follows. I was previously married to a Brazilian woman for 17 years. She is from Recife. We have 3 children. During our marriage we moved around a lot - we lived in Canada, US and Israel. We got divorced last summer (July 2008) in Israel. After the divorce she returned to her original home in Recife with the children. This was with my agreement - in our divorce agreement we agreed to all the terms of support and visitation, etc. including that she would move to Brazil. What was also part of the agreement is that she promised to have an Internet connection with Skype and with a webcam so that I would be able to see and talk with my kids. She has not kept that part of the bargain, and also many other conditions that she has ignored. I'm sure that all of us separated from our loved ones quickly appreciated the value of Internet communications with a faraway loved one. I could not imagine how I'd deal without Skype and chat to my fiancee in Thailand. But that is the situation I am facing now with my own children in Recife. My ex-wife has now not only removed Skype from their computer, she has apparently even disconnected the phone line so that when I call their house I can no longer reach them even by phone.

Well, if she and I lived in the same country, and were divorced in that country, this would be easy. I would simply go to my lawyer and ask that the courts enforce our agreement. However our divorce was in Israel, the document is in Hebrew, she and the children are in Brazil, I am now living in the US, and I do not speak Portuguese.

This makes things much more complicated. What I thought I would do is to try to find a competent lawyer in Recife who (1) speaks English (2) has expertise in family law and child custody matters. Then I would get this lawyer's advice on how best to defend my rights as a father.

Anyone on this list who can recommend such a lawyer - please PM me.

Thanks!!
